HomeMy WebLinkAboutO-13885File Number: 6561 City of Miami Legislation Ordinance: 13885 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 12/12/2019 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE II/SECTION 2-32 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "ADMINISTRATION/MAYOR AND CITY COMMISSION/TIME AND PLACE OF MEETING," TO CLARIFY WHEN PLANNING AND ZONING ITEMS MAY BE ADDRESSED BY THE CITY COMMISSION; CONTAINING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Ken Russell WHEREAS, there are many planning and zoning items that are time sensitive which need to be addressed by the City Commission; and WHEREAS, delays in addressing certain time sensitive planning and zoning items may have detrimental effects including a waste of economic and land resources, discourage sound capital improvement planning and financing, escalate the cost of housing and development, and discourage commitment to comprehensive planning; and WHEREAS, better certainty for planning and zoning items strengthens the public planning process, encourages sound capital improvement planning and financing, assist in assuring there are adequate capital facilities for development, encourages private participation in comprehensive planning, and reduces the economic costs of development; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 2/Article II of the City Code, titled "Administration/Mayor and City Commission," is amended in the following particulars:' "CHAPTER 2 ADMINISTRATION ARTICLE II. Enactment Number: 13885 (a) City hall, located at 3500 Pan American Drive, Miami, Florida, is hereby designated as the meeting place for the city commission. All meetings of the city commission shall be held on the first floor of city hall. The city commission may designate alternate meeting places and times from time to time as may appear appropriate by resolution. Such resolution shall specify the date, time, and place and shall be limited to one city commission meeting per resolution. The date so specified shall be not sooner than 30 days subsequent to the effective date of the resolution. (b) Regular meetings of the city commission shall be held on the second and fourth Thursdays of each month beoinnino at 9:00 a.m. except the months of August, November, and December and unless otherwise provided by city commission action. The city commission shall be in recess during the month of August. (c) The city commission may, by resolution, designate a substitute day or time upon which regular city commission meetings shall be held whenever, in the opinion of a majority of the members of the city commission, there is good cause for such substitution. *„ Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. The City Manager is directed to modify any administrative policies including but not limited to APM 2-77 to be consistent with this Ordinance.
