A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE ESTABLISHMENT OF A PERMANENT SENIOR RENTAL
ASSISTANCE PROGRAM, AS MORE PARTICULARLY DESCRIBED IN
EXHIBIT "A," ATTACHED AND INCORPORATED, TO ASSIST ELIGIBLE LOW
INCOME CITY OF MIAMI ("CITY") SENIOR RESIDENTS IN MITIGATING RENT
INCREASES; ALLOCATING AND APPROPRIATING THE FUNDS
GENERATED EACH YEAR, SUBJECT TO THE AVAILABILITY OF FUNDING
AT THE TIME OF NEED, FROM THE APPLICABLE HISTORIC
PRESERVATION SCHEDULE OF FEES PAID INTO THE PUBLIC BENEFITS
TRUST FUND, IN ORDER TO FUND THE SENIOR RENTAL ASSISTANCE
PROGRAM, IN FURTHERANCE OF THE SENIOR RENTAL ASSISTANCE
PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN FORMS
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE(S), IN
COMPLIANCE WITH ALL APPLICABLE FEDERAL, STATE OF FLORIDA, AND
LOCAL LAWS.

WHEREAS, pursuant to Resolution No. 19-0488, adopted on November 21, 2019, the City
Commission approved the creation of the Senior Rental Assistance Pilot Program ("Pilot
Program") and allocated one million dollars ($1,000,000.00) from the general fund in order to
fund the Pilot Program; and
WHEREAS, the goal of the Pilot Program is to alleviate the burden caused by rent
increases for the City of Miami's ("City") senior residents who are on a fixed income; and
WHEREAS, it is the will of the City Commission to make the Pilot Program permanent in
nature ("Senior Rental Assistance Program") and to fund the Senior Rental Assistance Program
using the funds generated and allocated from the Historic Preservation Schedule of Fees
attributable to transfers of development rights and density paid into the Public Benefits Trust
Fund, with a priority of five (5%) of such funds to be expended for the City's Senior Rental
Assistance Program; and
WHEREAS, there is an explicit authorization to allocate funds to the Senior Rental
Assistance Program in section 62-32(o) in the Code of the City of Miami Florida, as amended
("City Code"); and
WHEREAS, funding for the Senior Rental Assistance Program, as detailed in this
resolution, may be revised by the City Commission from time to time, as is practicable and
warranted; and
WHEREAS, the City desires to make the Pilot Program a permanent Program, thereby
creating the permanent Senior Rental Assistance Program, and this Resolution authorizes its

establishment of this as a permanent Program utilizing the funds generated and budgeted each
year from the Historic Preservation Schedules of Fees attributable to certain transfers of
development rights and density paid into the Public Benefits Trust Fund in order to fund the
Senior Rental Assistance Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Senior Rental Assistance Program, as more particularly described in
Exhibit "A," attached and incorporated, which assists eligible low-income City senior residents in
mitigating rent increases, is approved as a permanent Program.
Section 3. The funding will be allocated and appropriated from the applicable section of
the Historic Preservation Fees, subject to the availability of funding at the time of need, utilizing
the funds generated and budgeted each year from the Historic Preservation Schedules of Fees
attributable to transfers of development rights and density paid into the Public Benefits Trust
Fund, in order to establish permanent funding for the Senior Rental Assistance Program is
authorized.'
Section 4. The City Manager is authorized' to negotiate and execute any and all
necessary documents, in forms acceptable to the City Attorney, for said purpose(s), in
compliance with all applicable federal, State of Florida, and local laws.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

' The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
