WHEREAS, the City of Miami's ("City") Jose Marti Park includes recreation space under 1-95 that is currently bisected by Southwest 5th Street; and WHEREAS, the City Commission wishes to designate that portion of Southwest 5th Street bounded by Southwest 3rd Avenue to the east and the western limits of the 1-95 limited access right-of-way to the west as a play street, closed to vehicular traffic, in order to add recreational space to Jose Marti Park; and WHEREAS, pursuant to Sections 2-95.1 and 2-96.1 of the Code of Miami -Dade County, Florida, the Director of Miami -Dade County's Department of Transportation and Public Works is vested with exclusive jurisdiction over traffic engineering and street closures; and WHEREAS, the City Commission finds that it is in the best interest of the general welfare of the City and its residents to designate this portion of Southwest 5th Street as a play street; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' and directed to designate as a play street, closed to vehicular traffic, that portion of Southwest 5th Street bounded by Southwest 3rd 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. Avenue to the east and the western limits of the Interstate 95 (1-95") limited access right-of-way to the west, abutting the Florida Department of Transportation's 1-95 right-of-way currently improved as a part of Jose Marti Park, within fourteen (14) days of adopted of this Resolution by the City Commission Section 3. The City Clerk is directed to transmit a certified copy of this Resolution to the Director of Miami -Dade County's Department of Transportation and Public Works within fourteen (14) days of adopted of this Resolution by the City Commission. Section 4. The City Manager is directed to transfer all construction and maintenance obligations of said play street to the City's Department of Parks and Recreation upon approval and construction of the same. Section 5. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
