AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS,
AMENDING CHAPTER 14/ARTICLE II OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED ("CITY CODE"), TITLED "DOWNTOWN
DEVELOPMENT/DOWNTOWN DISTRICT/GENERALLY;" MORE
PARTICULARLY BY AMENDING SECTION 14-27 IN ITS ENTIRETY AND
CREATING NEW TERRITORIAL BOUNDARIES AS SET FORTH IN EXHIBIT
"A", ATTACHED AND INCORPORATED, TO INCLUDE THE RIGHT-OF-WAY
LANDS UNDERNEATH THE MIAMI METRORAIL, ALSO KNOWN AS THE
UNDERLINE, FROM THE MIAMI RIVER TO SE 15TH ROAD; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, pursuant to Chapter 65-1090, Laws of Florida, the City of Miami ("City")
created the Downtown Development Authority of the City of Miami, Florida ("DDA") and
established the original territory, which was subsequently amended by Ordinance No. 12307
adopted on December 12, 2002, to establish the territorial boundaries of the DDA ("DDA
District") within which the DDA may exercise its powers; and
WHEREAS, the Board of Directors of the DDA ("DDA Board") and the City Commission
find that establishing new territorial boundaries for the DDA District as set forth in Exhibit "A",
attached and incorporated, to include the right-of-way lands underneath the Miami Metrorail,
also known as "The Underline", from the Miami River to SE 15th Road (collectively, "Underline
Adjacent to the DDA Area"), as more particularly described in Exhibit B, attached and
incorporated, into the current DDA District as set forth in Exhibit "C", attached and incorporated,
will revitalize and preserve property values in the DDA District and its surrounding areas; and
WHEREAS, the City Commission finds that such expansion is in the best interests of the
City, and most particularly, the DDA; and
WHEREAS, pursuant to Section 166.0479, Florida Statutes (2019), the City Commission
adopted Resolution No. R-19-0318 on July 25, 2019 declaring its intent to expand the
boundaries of the DDA District to include the Underline Adjacent to the DDA Area, as more
particularly described in Exhibit "B", attached and incorporated; and
WHEREAS, today's public hearing was noticed on Tuesday, August 27, 2019 in the
Dailv Business Review, a copy of which notice is attached and incorporated as Exhibit "D," and
such public hearing has been held by the City Commission;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and are incorporated as if fully set forth in this Section.
Section 2. Chapter 14, Article 11, Division 1 of the Code of the City of Miami, Florida, as
amended ("City Code"), titled "Downtown Development, Downtown District, Generally," is further
amended by repealing the current Section 14-27 in its entirety and replacing and substituting
new Section 14-27, as set forth in Exhibit "A," attached and incorporated, thereby establishing
the new boundaries for the DDA District to include the Underline Adjacent to the DDA Area as
follows:'
"CHAPTER 14
DOWNTOWN DEVELOMENT
ARTICLE 11. DOWNTOWN DISTRICT
DIVISION 1. GENERALLY
Section 14-27. Boundaries designated.
The Downtown District described as follows shall be under the iurisdiction and control of
the Downtown Development Authoritv:
Beqin at the intersection of the centerline of NW 5th Street and NW 3rd Avenue (east of 1-95);
thence run southerly along the centerline of NW 3rd Avenue and the easterly side of 1-95 to the
centerline of West Flaaler Street; thence westerly along the centerline of said West Flaaler
Street to the centerline of the Miami River; thence meandering southeasterly along the
centerline of said Miami River to a point of intersection with the westerly Right-of-Wav line of
Metro Rapid Transit Riaht-of-Wav (formerly Florida East Coast (FEC) Railroad Riaht-of-Wav)
said Riaht-of-Wav line beina 50 feet westerly of and parallel with the centerline of said Metro
Rapid Transit Riaht-of-Wav; thence run southerly and southwesterly along said westerly Riaht-
of-Wav line of Metro Rapid Transit to the intersection with the centerline of SW 151h Road;
thence southeasterly alona the centerline of 15th Road to a point of intersection with the
southerly prolongation of the westerly line of Costa Bella Development Subdivision (107-14):
thence northeasterly, northwesterly, and northeasterly along said westerly line of Costa Bella to
the intersection with the southerly Riaht-of-Wav line of SE 14th Lane: thence southeasterly,
northeasterly, northerly, and northwesterly along said southerly and easterly Riaht-of-Wav line
of SE 14th Lane and SE 14th Terrace to the intersection with the northwesterly property line of
Lot 31, Block 2 of Amended plat of Point View as recorded in Plat Book 2 at Paae 93 of the
' Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be
added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

Section 3. If any section, part of section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.

Section 4. This Ordinance shall become effective thirty (30) days after final reading and
adoption hereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
