A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE TWO (2)
TEMPORARY EVENT LIMITATION PER YEAR FOR A PRIVATE PROPERTY
PURSUANT TO SECTION 62-521(13)(4) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, TO ALLOW THE PROPERTY AT 3701 NORTHWEST 7TH
STREET, MIAMI, FLORIDA TO HOST TEMPORARY EVENTS CONSISTING OF THE
SALE OF CHRISTMAS TREES AND SPARKLERS BEGINNING DECEMBER 4, 2019
AND ENDING DECEMBER 31, 2019.
WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as
amended ("City Code"), titled "Planning and Zoning/Planning and Zoning Approval for
Temporary Uses and Occupancies; Permit Required," temporary events are limited to no more
than two (2) events per year per property, for a maximum of two (2) weeks per permit; and
WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events
can be waived upon affirmative vote of the City Commission; and
WHEREAS, the property located at 3701 Northwest 7th Street, Miami, Florida
("Property") wishes to have temporary events from November 20, 2019 to December 31, 2019
for the sale of Christmas trees and sparklers; and
WHEREAS, the Property requires a waiver pursuant to Section 62-521(b)(4) of the City
Code for temporary events to be held at the Property from December 4, 2019 to December 31,
2019; and
WHEREAS, the events will require permits to be issued by the City of Miami ("City") to
ensure life -safety and quality of life issues with appropriate conditions; and
WHEREAS, the proposed temporary events at the above location will be beneficial to
the City's residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Planning and
Zoning/Planning and Zoning Approval for Temporary Uses and Occupancies; Permit Required,"
the two (2) temporary event per year, per property limitation is hereby waived to allow the sale
of Christmas trees and sparklers at the property located at Property beginning December 4,
2019 and ending December 31, 2019.
Section 3. This Resolution does not waive any other requirements of the City Code,
including but not limited to, applicable fees, inspections, and permits.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

' If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
