HomeMy WebLinkAboutO-13864City of Miami City Hall Legislation 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Ordinance: 13864 File Number: 6155 Final Action Date: 10/10/2019 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE XI OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "ADMINISTRATION/BOARD, COMMITTEES, COMMISSIONS," TO REALIGN THE MIAMI COMMISSION ON THE STATUS OF WOMEN, THE PARKS AND RECREATION ADVISORY BOARD, THE CITY OF MIAMI BEAUTIFICATION COMMITTEE, THE EDUCATION ADVISORY BOARD, AND THE SENIOR CITIZENS' ADVISORY BOARD INTO THE COMMISSION ON THE STATUS OF WOMEN AND THE QUALITY OF LIFE COMMITTEE ("COMMITTEE"); MORE SPECIFICALLY BY ADDING DIVISION 6, SECTIONS 2-1011 TO 2-1019 TO CREATE THE COMMITTEE; REPEALING IN ITS ENTIRETY DIVISION 8, TITLED "MIAMI COMMISSION ON THE STATUS OF WOMEN;" REPEALING IN ITS ENTIRETY DIVISION 11, TITLED "PARKS AND RECREATION ADVISORY BOARD;" REPEALING IN ITS ENTIRETY DIVISION 13, TITLED "CITY OF MIAMI BEAUTIFICATION COMMITTEE;" REPEALING IN ITS ENTIRETY DIVISION 207 TITLED "EDUCATION ADVISORY BOARD;" REPEALING IN ITS ENTIRETY DIVISION 23, TITLED "SENIOR CITIZENS' ADVISORY BOARD;" CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there are a number of committees, commissions, and boards ("Committees") that have been created since 1999; and WHEREAS, the ordinances creating these Committees have not been significantly updated and realigned to serve with the City of Miami's ("City") current vision and mission; and WHEREAS, many of the Committees have overlapping duties and functions, which strain the limited resources of the City; and WHEREAS, on March 28, 2019, the Miami City Commission directed the City Manager to reduce/consolidate the number of Committees; and WHEREAS, the City Commission has determined that the functions of the Miami Commission on the Status of Women, Parks and Recreation Advisory Board, City of Miami Beautification Committee, Education Advisory Board, and Senior Citizens' Advisory Board should be combined and realigned with the newly formed Commission on the Status of Women and Quality of Life Committee; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by referenced and incorporated as if fully set forth in this Section. Chapter 2/Article XI/Division 6 of the Code of the City of Miami, Florida, as amended ("City Code"), is further amended in the following particulars:' "CHAPTER 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS DIVISION 6. RESER\'€DCOMMISSION ON THE STATUS OF WOMEN AND QUALITY OF LIFE COMMITTEE. Sec. 2 -1011 -Reserved Established. There is herebv established an advisory committee to the Citv to be known as the "Commission on the Status of Women and Qualitv of Life Committee" which shall hereinafter be referred to as the "Committee." Sec. 2-1012. Purpose, powers, and duties. The purpose, powers, and duties of the Committee are: (1) To serve in an advisory capacity to the Citv Commission, Mavor, and Citv Manaqer; (2) To advise on anv possible barrier which may impede the participation of women in city -sponsored programs and activities; support legislation granting women equal rights and equal opportunities; inspire in women the desire for self-improvement and pride of being, regardless of age, marital status, race, color, or creed: seek for every woman the opportunities eaual to her potential and responsibility; and seek opportunities for and to encourage the active involvement of women in matters relating to communitv progress and to encouraae capable women in roles of leadership; (3) To provide periodic review of all existina and potential Citv parks, recreational facilities, transportation, and capital voiects includina eau0ment, programs, and activities; (4) To advise and make recommendations to the Citv Commission concernina subiects of particular interest to senior citizens such as health, nutrition, medical services, recreation, transportation, housing, utilitv rates, emplovment, and other matters related to the safetv and welfare of senior citizens; (5) To serve in an advisory capacity to the Citv Commission and recommend, in writing, anv proposed policv chances that would enhance the beautification and aesthetic appeal of the Citv, includina the issuance of recommendations to the Citv Manager or desianee on anv actions taken by the Citv as it pertains to beautification and aesthetic enhancement: (6) To coordinate with the Citv and Miami -Dade Countv Public Schools regarding the use of schools and parks as communitv hubs; develop ioint-use aareements where the Citv's parks and public schools can share resources to provide additional or expanded ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. City of Miami Page 2 of 5 File ID: 6155 (Revision: B) Printed on: 12/3/2019 File ID: 6155 Enactment Number: 13864 programming to the community; coordinate activities of the Citv with those activities of local public schools, colleges, and universities to promote educational opportunities for citizens and residents of the Citv; and develop recommendations regarding programs which may be created to enhance educational opportunities in the Citv; (7) To recommend to the Citv Commission, Mavor, and Citv Manager such ordinances, resolutions, and policies to carry out the purposes of the provisions set forth herein; (8) To submit an annual report to the Citv Commission, Mavor, and Citv Manager; and (9) To make recommendations regardinq grants and donations on behalf of the Citv from foundations and other entities and individuals for the purpose of carrvinq out the above listed functions, subiect to approval by the Citv Commission. Sec. 2-1013. Membership and qualifications. (1) The Committee shall consist of nine (9) members. (2) Each Citv Commissioner shall nominate one (1) person to the Committee. The Mavor shall nominate one (1) person to the Committee. The Citv Manager shall nominate one (1) person to the Committee. There shall be two (2) at -large members who shall be appointed by the Citv Commission. All nominated members must be confirmed by a maioritv vote of the Citv Commission. All members must reside, own a propertv, own a business, or work in the Citv and otherwise comply with Section 2-884 of the Citv Code. (3) The term of each member shall terminate when the nominatinq Citv Commissioner, Mavor, or Citv Manager leaves office. (4) Board members shall continue to serve until their successors have been appointed and qualified. (5) In order to fill a vacancv due to death, resignation, or removal, the Citv Commission shall appoint the replacement as originally set forth in Section 2-1013(2) of the Citv Code. (6) There shall be no alternate members. Sec. 2-1014. Quorum and voting; meetings; and attendance requirements. (1) Quorum and voting. At all meetinqs of the Committee, a minimum of five (5) members shall constitute a auorum for the transaction of business. Each member shall have one (1) vote on every issue submitted to a vote of the Committee. The decision of a maioritv of the votina members present at a meetina at which a quorum is present shall be the act of the Committee. (2) Meetings. The Committee shall hold reaular auarterly meetinas and may hold such other meetinas as it deems necessarv. All meetinas of the Committee shall be public. Minutes of the proceedings of all actions taken at the meeting of the Committee shall be submitted to the Citv Clerk. (3) Attendance reauirements. A votina member shall be automaticallv removed if (a) in a aiven calendar vear, the votina member is absent from three (3) consecutive meetinas or (b) the votina member is absent from four (4) properly noticed meetinas within a twelve (12) month period without an excused absence or does not comply with Section 2-886 of the Citv Code. A member shall be deemed absent when the member is not present at the meeting_ at least seventv-five percent (75%) of the meetina's duration. The application of the provisions of this Section may be waived by four-fifths (4/5ths) vote of the members of the Citv Commission. Sec. 2-1015. Officers and staff. The Committee may also elect from among its members such other officers as deemed necessary or appropriate. Officers shall serve a term of (1) vear or until a successor is elected. (2) The Office of the Citv Attornev shall provide legal services to the Committee as may be necessary and requested by the Committee. (3) The Citv Manaqer shall provide administrative support to the Committee, which shall include the services of an individual to keep minutes of the meetings, maintain Committee correspondence, post meeting notices, file reports, and perform anv and all necessary support functions. Sec. 2-1016. Bvlaws. (1) The Committee shall adopt such bvlaws as it deems necessary for the conduct of its business. The bvlaws may include procedural rules, the designation of regular meeting dates, and the procedures for calling special meetings. (2) Bvlaws, as well as anv amendments thereto: (a) Must be consistent with this Chapter: and (b) Mav be adopted onlv by a maioritv vote of the entire membership, provided that, in each case, at least twenty (20) dans' written notice of the proposed amendment has been provided to all Committee members. Sec. 2-1017. Subcommittees. The Committee may create such subcommittees as it deems necessary for the conduct of its business. Sec. 2-1018. Compensation. Members of the Committee shall serve without compensation but shall be reimbursed for expenses necessarily incurred in the performance of the member's duties subiect to the prior written approval of the Citv Manager. Sec. 2 -1019 -Sunset review. The Committee will be initiallv reviewed in 2023 and thereafter be reviewed every four (4) vears. *„ Section 3. Chapter 2, Article XI, Division 8 of the City Code, titled "Administration/Boards, Committees, Commissions/Miami Commission on the Status of Women," is hereby repealed in its entirety and reserved. Section 4. Chapter 2, Article XI, Division 11 of the City Code, titled "Administration/Boards, Committees, Commissions/Parks and Recreation Advisory Board," is hereby repealed in its entirety and reserved. Section 5. Chapter 2, Article XI, Division 13 of the City Code, titled "Administration/Boards, Committees, Commissions/City of Miami Beautification Committee," is hereby repealed in its entirety and reserved. Section 6. Chapter 2, Article XI, Division 20 of the City Code, titled "Administration/Boards, Committees, Commissions/Education Advisory Board," is hereby repealed in its entirety and reserved. Chapter 2, Article XI, Division 23 of the City Code, titled "Administration/Boards, Committees, Commissions/Senior Citizens' Advisory Board," is hereby repealed in its entirety and reserved. Section 8. If any section, part of a section, paragraph, clause, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 9.
