A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT AND APPROPRIATE
GRANT FUNDS IN AN AMOUNT NOT TO EXCEED ONE MILLION, FIVE
HUNDRED THOUSAND DOLLARS ($1,500,000.00) ("GRANT FUNDS") FROM
THE STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL
PROTECTION ("FDEP") FOR THE "IMMEDIATE FLOOD CONTROL:
INSTALLATION OF BACKFLOW VALVES (PHASE I)," OFFICE OF CAPITAL
IMPROVEMENTS ("OCI") PROJECT NO. 40-B193800 ("PROJECT") AND THE
CONSTRUCTION OF THE MIAMI BISCAYNE TIDAL WAVES AND
STORMWATER IMPROVEMENTS; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A GRANT AGREEMENT, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, TO ACCEPT THE GRANT
FUNDS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS,
AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS TO THE
GRANT AGREEMENT, ALL IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR SAID PURPOSE.
WHEREAS, the Miami City Commission adopted Resolution No. 19-0187 on May 9,
2019 authorizing funding and an amendment of the City of Miami's ("City") list of expedited
projects pursuant to Section 18-117 of the Code of the City of Miami, Florida, as amended,
for the purpose of including upcoming capital improvement solicitations and projects from
the Miami Forever Bond; and
WHEREAS, the "Immediate Flood Control: Installation of Backflow Valves (Phase
I)," Office of Capital Improvements ("OCI") Project 40-13193800 ("Project") was one of the
projects included in Resolution No. 19-0187; and
WHEREAS, pursuant to Chapter 2019-115, Laws of Florida, attached and
incorporated as Exhibit "A," the Florida Legislature appropriated One Million, Five Hundred
Thousand Dollars ($1,500,000.00) ("Grant Funds") for the Project for the construction of the
Miami Biscayne Bay Tidal Waves and Stormwater Improvements; and
WHEREAS, the Florida Department of Environmental Protection ("FDEP") requires
that the City execute a Grant Acceptance Agreement ("Agreement") in order to receive the
Grant Funds; and
WHEREAS, it is appropriate for the City Manager to accept and appropriate the
Grants Funds and to execute the Agreement, in a form acceptable to the City Attorney, to
set forth terms and conditions relating to the use of the Grant Funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF

MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to accept and appropriate Grant Funds
in an amount not to exceed One Million, Five Hundred Thousand Dollars ($1,500,000.00)
for the Project and the construction of the Miami Biscayne Bay Tidal Waves and
Stormwater Improvements.
Section 3. The City Manager is further authorized' to negotiate and execute an
Agreement, in a form acceptable to the City Attorney, for the acceptance of said Grant
Funds.
Section 4. The City Manager is further authorized' to negotiate and execute any
and all other necessary documents, amendments, extensions, renewals, and modifications
to the Agreement, all in a form acceptable to the City Attorney, for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor.2

' The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
