You will only be responsible for providing the documents as instructed below in order to meet the filing
criteria. You will not need to obtain signatures from any of your neighbors before, during, or after the
public hearing process.

I am writing on behalf of Sunshine Land Development, LLC, to update our previously -
submitted formal Letter of Intent and Vacation and Closure Application. Upon review of the
Application package by City Staff, and upon exchange of comments via the e -File portal, as well
as the pre -application / application conference with Luiz G. Vicentini, the following two points
are clarified here.
First, the latest Tentative Plat & Survey submitted by our Surveyor Mark Johnson now
expressly reflects the square footage to remain (790 square feet) as requested.
Second, the explanation for the Right of Way to Be Dedicated as depicted on the Tentative
Plat & Survey (312 square feet) is that this area is south of the City of Miami Base Building Line
for this Property. This area on the other side of the Base Building Line would be so dedicated for
any project.
The foregoing supplemental information, together with our original Letter of Intent,
Application package submitted via e -Plan, Staff Comments and Applicant Responses in e -Plan,
and additional documents and drawings submitted via e -Plan constitute our Application. We
respectfully request that the City act favorably on it and set this item for hearing before the
Planning, Zoning and Appeals Board. For ease of reference, our analysis of the four Code -based
criteria for Vacation established in Section 55-15 of the City of Miami Code of Ordinances is
recited below.

Vacation of the of the subject "brow" on the Property will benefit the publi-CM�
addressing what appears to be a mistake and discrepancy between the original plat
depicting a cul-de-sac, and the real-world facts and conditions on the ground along
N.E. 83 Street. The requested vacation will provide the City as well as the affected
property owners with certainty with respect to this issue and will consequently
benefit and encourage the orderly development of this valuable section of the City
along N.E. 83 Street.
11. Is the general public no longer using the right-of-way, including public service
vehicles, fire, or other emergency vehicles?
A review of the aerial photos of the Property, as well as the street level photos of
the Property provided by the Applicant., establish that the old cul-de-sac is
unimproved and treated in every respect as part of the grass and lawn of the subject
residential lot. The area to be vacated is a scrivener's feature of the original plat,
only. Put another way, there is no restriction of existing public access or service
vehicle access because there is no such access.
Ill. Would there be no adverse effect on the ability to provide police, fire or
emergency services?
As noted above, no vehicles whatsoever including public service vehicles are
accessing the subject area to be vacated. All emergency and other public service
vehicles now use the existing right-of-way and alignment of N.E. 8' ) Street, and
will continue to do so upon vacation of the subject "brow" shaped portion of the
old cul-de-sac. The accomplishment of the requested vacation will not change any
existing use or condition at the subject Property or surrounding areas.
IV. Would the vacation and closure of the rights-of-way or easements have a
beneficial effect on pedestrian and vehicular circulation in the area?
The ultimate development of the subject Property with two residential structures
will help improve circulation by providing the necessary curb cuts, drives and other
required improvements for the development of the parcels. Because the requested
vacation works only to correct a legal anomaly and results in no real-world change
to the current alignment and use of N.E. 83 Street, the requested vacation will not
hinder any existing use or circulation and will only enhance the use and
development of the Street.
For all of the foregoing reasons, and in furtherance of the approval of the Tentative Plat by
the Plat and Street Committee, we respectfully submit the enclosed Vacation and Closure
Application for the requested vacation of the area portion of the old cul-de-sac identified with a
cross -hatch on the Tentative Plat and Survev.

24. Public Hearing/Planning, Zoning and Appeals Board (PZAB).
a. An Opinion of Title as to reversionary rights for the right-of-way to be closed and vacated
will be required by the PZAB (does not apply for easement within private property). The
Opinion of Title must also address whether or not there are individuals, in addition to the
abutting property owners, having an interest in the right-of-way to be closed and vacated. A
copy of the Opinion of Title must be provided to the Public Works Department, prior to
acceptance of the application.
b. The PZAB will require a sketch and legal description with a square footage, on an 8 %2" X
11" paper, for the proposed closure. Contact the Office of the Hearing Boards, at 305-416-
2030. Provide a copy to the Public Works Department.
25. The Plat and Street Committee has reviewed this tentative plat and determined that all technical
requirements contained in the Miami City Code Subdivision Regulations have been met and has
approved the tentative plat. The members of the Plat and Street Committee have further considered
the request for vacation and closure of the street with respect to Miami City Code requirements and
have voted 6 (six) in favor and 0 (zero) in denial of this vacation and closure request.
26. Obtain a confirmation ("Confirmation") from the City's Office of Capital Improvements and the
Department of Resilience and Public Works regarding whether the City expended any funds for
improvements on the right(s)-of-way proposed to be vacated. If the Confirmation indicates that
funds were expended, the City's Finance Department and Office of Management and Budget will
determine the amount of the City's expenditure, including expenditure of restricted funds (bonds
funds, grant funds, or otherwise) for such improvements, and the City Manager, or his or her
designee, will issue an amount confirmation ("Amount Confirmation") with the total amount of
funds expended. The Amount Confirmation shall specify the amount that the Subdivider must
repay to the City. Proof of a cleared payment in the total amount indicated on the Amount

order before submitting the final plat package.
34. Be advised that if all requirements for scheduling the final plat for City Commission action are not
in order, the final plat will not be scheduled for a City Commission meeting.
35. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat
approval (see contact sheet). The tentative plat name and tentative plat number must be included on
the application form.
36. A letter from Miami -Dade Water and Sewer Department is required to release the final plat in
connection with water and sewer service agreements.
37. For informational purposes, provide two 8 '/z" x 11" sketches of the division of the land; one sketch
of the existing divisions before the plat is recorded and one sketch of the divisions after the plat is
recorded.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public rights-
of-way when property is platted. These subdivision improvements include paving, drainage,
landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your
part.
REQUIRED: The submission of an electronic file of the tentative plat, in an AutoCAD, to the City
of Miami Public Works Department, Development and Roadway Plans Section will EXPEDITE the
preparation and enhance the ACCURACY of the subdivision improvement letter required for the
final plat approval.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat is recorded or
as authorized by the City of Miami Code Section 55-10(i). Also, the Temporary Certificate
Occupancy and/or Certificate of Occupancy for any building construction will be issued only after
all the required subdivision improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the
issuance of a building permit.
5. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents,
in writing, of the project starting and completion dates at the time of issuance of permits. The
contractor/developer may coordinate the notification of residents with the local City of Miami NET
Service Center.

27. A letter from Comcast is required to determine if any adjustments to their facilities or ca
required.
28. Verify with Miami -Dade County that the proposed plat name is acceptable.
29. All encroachments across proposed tract and/or lot lines must be removed prior to final plat
submittal.
30. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided at the time of
final plat submittal.
31. Current backup documentation will be required for all who execute the final plat. A resolution for
authority to execute documents and a Certificate of Good Standing from the Secretary of State are
required, if applicable.
32. Tentative plat application must be made with Miami -Dade County after receiving approval from the City of
Miami Plat and Street Committee. Provide a copy of the notice of action to Public Works.
33. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his/her surveyor and attorney to assure that everything is in
order before submitting the final plat package.
34. Be advised that if all requirements for scheduling the final plat for City Commission action are not
in order, the final plat will not be scheduled for a City Commission meeting.
35. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat
approval (see contact sheet). The tentative plat name and tentative plat number must be included on
the application form.
36. A letter from Miami -Dade Water and Sewer Department is required to release the final plat in
connection with water and sewer service agreements.
37. For informational purposes, provide two 8 '/z" x 11" sketches of the division of the land; one sketch
of the existing divisions before the plat is recorded and one sketch of the divisions after the plat is
recorded.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public rights-
of-way when property is platted. These subdivision improvements include paving, drainage,
landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your
part.
REQUIRED: The submission of an electronic file of the tentative plat, in an AutoCAD, to the City
of Miami Public Works Department, Development and Roadway Plans Section will EXPEDITE the
preparation and enhance the ACCURACY of the subdivision improvement letter required for the
final plat approval.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat is recorded or
as authorized by the City of Miami Code Section 55-10(i). Also, the Temporary Certificate
Occupancy and/or Certificate of Occupancy for any building construction will be issued only after
all the required subdivision improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the
issuance of a building permit.
5. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents,
in writing, of the project starting and completion dates at the time of issuance of permits. The
contractor/developer may coordinate the notification of residents with the local City of Miami NET
Service Center.

ACKNOWLEDGEMENT BY APPLICANT
1. The Department of Resilience and Public Works, Transportation, Coordinated Review Committee and other City
and County agencies review zoning public hearing requests and provide input, which may affect the scheduling
and outcome of my hearing. These reviews may require additional hearings before other City and County
boards, which may result in the modification of plans, studies and/or the proffering of agreements to be
recorded. The submission and acceptance of a request for public hearing means that the application is ready to
be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision-making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.

Dear Director Dodd and Director Williamson:
I am writing on behalf of the Applicant Sunshine Land Development, LLC, to respectfully
request confirmation as to any City funds expended for the Plat referred to above, pursuant to
Ordinance No. 13793 which requires applicants for vacation and closure of a right-of-way to obtain
a confirmation from the City's Office of Capital Improvements and the Department of Resilience
and Public Works, as to whether the City expended any funds for improvements on the right-of-
way proposed to be vacated. Attached for your reference is: Exhibit A (Legal Description and
Sketch of area to be vacated) and Exhibit B (Tentative Plat).
Finally, I note that this particular Application seeks to vacate an area consisting of what
appears to be a mistake on the original Plat. This area is a cul-de-sac or part of a cul-de-sac, which
is not reflected in the real world. The present existing street is a linear East-West street, with 90
degree angles, with no cul-de-sac areas. The partial cul-de-sac area to be vacated is referred to by
our Professional Surveyor as a "brow." Put another way, the Application seeks only to correct this
depiction on the original Plat, and no actual right-of-way is being charged or closed. The roadway,
sidewalks, curb cuts and all other actual features are to remain unchanged from their present
configuration, as they have been for known history.

A violation may become a lien when the property owner does not timely remedy the
violation. This report may include two types of liens: Certified liens and non -certified
liens. Certified liens have a set amount to be paid. Conversely, most non -certified liens
continue to accrue interest or a per diem fine; therefore, those liens must be satisfied
with the City as quickly as possible.
All outstanding violations and liens must be satisfactorily resolved before the City can
issue a Certificate of Use (CU); however, the City inspects all properties prior to the
issuance of a CU and those inspections may yield additional items, which must be
addressed by the owner at the property prior to issuance of a CU.
This search does not include encumbrances, other liens, restrictions or the like,
recorded in the Public Records of Miami -Dade County, Florida. Please contact
Miami -Dade County for the aforementioned items.
