WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, the City Commission, pursuant to Resolution No. 19-0305 adopted on July 25, 2019 ("Authorizing Resolution"), approved the "Single Family Code Compliance Elderly Loan Assistance Pilot Program" ("Pilot Program"), a summary of which is attached and incorporated herein as Exhibit "A;" and WHEREAS, the purpose of the Pilot Program is to provide elderly homeowners in City Commission District 1 assistance with correcting code compliance violations on their properties; and WHEREAS, pursuant to the Authorizing Resolution the City allocated funds in an amount not to exceed Five Hundred Thousand Dollars ($500,000.00) ("Program Funds") from the District 1 Commissioner's share of the City's API Funds for the Pilot Program; and WHEREAS, Rebuilding Together Miami -Dade, Inc., a Florida not for profit corporation ("Rebuilding Together'), has provided home repair and modification services for Miami -Dade County and has the expertise to tackle critical home repairs; and WHEREAS, Rebuilding Together has the expertise to determine the adequate scope and cost of work and review income eligibility requirements as it relates to the Pilot Program and the City wishes to engage Rebuilding Together to help implement the Pilot Program; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, as amended ("City Code"), the City Manager has made a written finding, attached and incorporated herein as Exhibit "B," that competitive negotiation methods and procedures are not practicable or advantageous for the City and has recommended to the City Commission that such findings be adopted and that competitive bidding methods and procedures be waived for the Pilot Program; and WHEREAS, the City Manager is requesting authority to allocate and appropriate the Program Funds, which are inclusive of fees and cost of work to correct code violations, for the term of the Pilot Program to Rebuilding Together to implement the Pilot Program; and WHEREAS, the City Manager is further requesting authority from the City Commission to negotiate and execute any and all documents necessary, in a form acceptable to the City Attorney, with Rebuilding Together to implement the Pilot Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendations and written findings that Rebuilding Together is a sufficiently qualified and respected firm that has the expertise to implement the Pilot Program, attached and incorporated as Exhibit "B," and that competitive negotiation methods and procedures are not practicable or advantageous and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate and appropriate the Program Funds, which are inclusive of fees and cost of work to correct code violations, for the term of the Pilot Program to Rebuilding Together to implement the Pilot Program. Section 4. The City Manager is further authorized' to negotiate and execute any and all documents necessary, in a form acceptable to the City Attorney, with Rebuilding Together for said purpose for the term of the Pilot Program. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
