WHEREAS, Section 200.065, Florida Statutes ("Statute"), sets forth requirements for the "Truth in Millage" ("TRIM") notice and requires each taxing authority to establish a proposed millage rate and to determine the statutorily defined rolled -back rate; and WHEREAS, the Statute stipulates that said proposed millage rate and statutorily defined rolled -back rate be submitted to the Miami -Dade County Property Appraiser ("Property Appraiser") and the Miami -Dade County Tax Collector ("Tax Collector"); and WHEREAS, said proposed millage rate will reflect the levy necessary to fund the Miami Downtown Development Authority of the City of Miami, Florida's ("DDA") tentative budget other than the portion of the budget to be funded from sources other than ad valorem taxes; and WHEREAS, the Statute defines the "rolled back millage rate" as a millage rate which, with certain specified exclusions, will provide the same ad valorem tax revenue for each taxing authority as was levied during the prior year less the amount, if any, paid or applied as a consequence of an obligation measured by the dedicated increment value; and WHEREAS, the exclusions to the rolled back millage rate are "new construction, additions to structures, deletions, increases in the value of improvements that have undergone a substantial rehabilitation which increased the assessed value of such improvements by at least 100 percent, property added due to geographic boundary changes, total taxable value of tangible personal property within the jurisdiction in excess of 115 percent of the previous year's total taxable value, and any dedicated increment value"; and WHEREAS, the proposed millage rate submitted to the Property Appraiser and the Tax Collector is not binding but is necessary for the purpose of preparation of tax notices; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 6050 (Revision: B) Printed On: 7/31/2019 File ID: 6050 Enactment Number: R-19-0314 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The DDA's rolled back rate is 0.4491 mills. Section 3. The proposed millage rate for the DDA for the Fiscal Year beginning October 1, 2019 and ending September 30, 2020 is 0.4681 mills, which is 4.23% more than the rolled back rate. Section 4. The Executive Director is hereby authorized' to submit forthwith the rolled back rate and the proposed millage rate for the DDA to the Property Appraiser and to the Tax Collector together with the date, time, and place at which the City Commission will hold public hearings to consider the proposed millage rate and the DDA's tentative budget for said fiscal year as follows: September 12, 2019 at 5:05 P.M. and September 26, 2019 at 5:05 P.M. in the Commission Chambers at City Hall, 3500 Pan American Drive, Dinner Key, Miami, Florida. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: Barnaby L. Min, Deputy City Attorney 7/30/2019 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. City of Miami Page 2 of 2 File ID: 6050 (Revision: 8) Printed on: 7/31/2019 RESOLUTION NO. 017/2019 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE MIAMI DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA ("MIAMI DDA") APPROVING THE PRELIMINARY ANNUAL BUDGET OF THE MIAMI DDA FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2019 AND ENDING SEPTEMBER 30,2020; REQUESTING THAT THE MIAMI CITY COMMISSION ESTABLISH THE MILLAGE TO SUPPORT TIE FINANCIAL REQUIREMENTS OF THE BUDGET; AUTHORIZING THE EXECUTIVE DIRECTOR OF THE MIAMI DDA TO EXPEND FUNDS FOR THE BUDGET; DIRECTING THE EXECUTIVE DIRECTOR TO FILE A DETAILED STATEMENT OF THE PROPOSED EXPENDITURES AND ESTIMATED REVENUES FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2019 AND ENDING SEPTEMBER 30, 2020 WITH THE CITY CLERK OF THE CITY OF MIAMI ("CLERK") AFTER ADOPTION AND ESTABLISHMENT OF THE MILLAGE BY THE MIAMI CITY COMMISSION; AND FURTHER PROVIDING THAT A COPY OF THIS RESOLUTION BE FILED WITH THE CLERK. WHEREAS, the Miami Downtown Devclopment Authority of the City of Miami, Florida ("Miami DDA") has prepared a preliminary budget for the Fiscal Year beginning October 1, 2019 and ending September 30, 2020 ("Fiscal Year"); and WHEREAS, the Board of Directors of the Miami DDA has reviewed said budget on the Estimated Tax Roil provided by Nfiami-Dade County; and WHEREAS, the Board of Directors of the Miami DDA finds that the proposed budget is necessary in order to further the objectives of the Miami DDA, as authorized by the Code of the City of Miami, Florida, as amended; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE MIAMI DOWNTOWN DEVELOPMENT AUTHORITY OF TBI CITY OF MIAMI, FLORIDA: Section 1. The recitals are true and correct and are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The preliminary budget of the Miami DDA, as submitted by the Executive Director is made part of this Resolution and is hereby approved and shall be known as the "Annual Budget of the Miami Downtown Develapment Authority; Fiscal Year. October 1, 2019 through September 30, 2020". Section 3. The Executive Director is directed to submit a eopy of this preliminary budget as well as this Resolution to the Miami City Commission and to request the Miami City Commission to adopt said preliminary budget and establish the millage, authorized by law, to support the financial requirements of this budget. Section 5. The Executive Director is authorized to expend funds, including new salary rates, as provided in' said budget, after adoption and establishment of the millage by the Miami City Commission, beginning October 1, 2019. Section G. The Executive Director is directed to prepare and file with the.City Clerk of the City of Miami, Florida ("Cleric") a detailed statement of the proposed expenditures and estimated revenues for the Fiscal Year 2019-2020, which shall be entitled "Annual Budget of the Miami Downtown Development Autholrity: Fiscal Year October 1, 2019 through September 30, 2020", Section 7. A copy of this Resolution and the attachment(s) shall be filed with the Clerk after adoption of the millage by the Miami City Commission. Section S.
