("FISHER") FOR GROUP 1, FOR THE PROVISION OF ON-SITE AUCTION SERVICES, AND RENE BATES AUCTIONEERS, INC. ("RENE BATES"), FOR GROUP 2, FOR THE PROVISION OF INTERNET AUCTION SERVICES, FOR THE DEPARTMENT OF PROCUREMENT ("PROCUREMENT"), FOR AN INITIAL PERIOD OF THREE (3) YEARS, WITH AN OPTION TO RENEW FOR ONE (1) ADDITIONAL THREE (3) YEAR PERIOD ON AN AS -NEEDED CONTRACTUAL BASIS; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NEGOTIATED PROFESSIONAL SERVICES AGREEMENTS ("PSA"), IN SUBSTANTIALLY THE ATTACHED FORM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALLOCATIONS, APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY MADE, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING, THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH APPLICABLE REGULATIONS, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, the various City of Miami ("City") departments periodically have a need to dispose of surplus property that is no longer in use or has become obsolete; and WHEREAS, on May 4, 2018, Department of Procurement ("Procurement") issued Request for Proposals ("RFP") No. 824384 to secure qualified and experienced firms for the provision of public "on-site," and internet auction services; and WHEREAS, on June 7, 2018, the Office of the City Clerk received three (3) proposals in response to the RFP for Group 1, On -Site Auctions, and nine (9) proposals in response to the RFP for Group 2, Internet Auctions, one of which was deemed non-responsive; and WHEREAS, on October 3, 2018, the Evaluation Committee ("Committee") appointed by the City Manager convened to discuss and evaluate the three (3) responsive proposals for Group 1 and eight (8) responsive proposals for Group 2, following the guidelines established within the RFP, and ranked Fisher Auction Co., Inc. ("Fisher") as the highest ranked responsive proposer for Group 1, and Rene Bates Auctioneers, Inc. ("Rene Bates") as the highest ranked proposer for Group 2; and City of Miami Page 1 of 2 File ID: 5983 (Revision:) Printed On: 7/30/2019 File ID: 5983 Enactment Number: R-19-0268 WHEREAS, on November 19, 2018, the City Manager concurred with the recommendation of the Committee and authorized Procurement to enter into negotiations for a PSA for each of the two (2) Groups for the provision of auction services; and WHEREAS, Procurement and a designated negotiating team have successfully completed negotiations with Fisher and Rene Bates, and have recommended to the City Manager the execution of two (2) PSA's with Fisher for Group 1, and Rene Bates for Group 2; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Proposals received June 7, 2018, pursuant to RFP No. 824384 from Fisher for Group 1, for the provision of on-site auction services, and Rene Bates for Group 2, for the provision of internet auction services, for Procurement, for an initial period of three (3) years, with an option to renew for one (1) additional three (3) year period on an as -needed contractual basis, are accepted. Section 3. The City Manager is authorized' to execute the negotiated PSA's, in substantially the attached form. Section 4. The City Manager is further authorized' to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the City Code, including the City's Procurement Ordinance, Anti - Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 i ria i "ndez, City Attor ey 6/2612019 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
