WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, as amended ("Miami 21 Code"); and WHEREAS, Section 7.1.2.8 of the Miami 21 Code provides that all amendments, including rezoning, shall maintain the goals of the Miami 21 Code to preserve neighborhood and provide transitions in intensity, density, building height, and scale; and WHEREAS, it has been determined that modifications to the Miami 21 Code, Article 4 are required to further advance the intent of the Miami 21 regulations by reducing the parking requirement for certain Civic Uses; and WHEREAS, consideration has been given as to whether the proposed changes will further the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and WHEREAS, the proposed amendments will allow the development of new open space opportunities throughout the City of Miami; and WHEREAS the proposed amendments allow the City to provide additional green spaces at a neighborhood scale, improving the quality of neighborhoods throughout the city; and WHEREAS, consideration has been given to the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary; and WHEREAS, Planning, Zoning, and Appeals Board ("PZAB") has considered whether the proposed amendment will further the goals, objectives, and policies of the Miami Comprehensive Plan, the Miami 21 Code, and other City regulations. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2.
