Subject: Sole Source - M -VAC Forensic DNA Collection System
Purpose of Item:
The nature of this item is to authorize a Resolution of the Miami City Commission, by a
four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the Code of the City of
Miami, Florida, as amended, after an advertised public hearing, ratifying, authorizing,
and confirming the City Manager's finding of a sole source; waiving the requirements for
competitive sealed bidding procedures and approving the purchase of one (1) M -Vac
Forensic DNA Collection System ("MVAC"), from M -Vac Systems, Inc. ("MVAS"),
including, but not limited to, training services, maintenance, and support for a period of
three (3) years; allocating funds from the FY 17 Edward Byrne Memorial Justice
Assistance Grant (JAG), Award No. 2456, Project No. 19-190011, Task No. 1,
Organization 191602 and Account No. 12000.191602.664000.0.0. of the Police
Department, subject to the availability of funds and budgetary approval at time of need.
Background of Item:
The City of Miami's Police Department is in need of a system that will allow for the
collection of Deoxyribonucleic Acid ("DNA") with better results than the traditional
methods of swabbing, taping or cutting. WAS is the only manufacturer, distributor and
patent holder of the MVAC system in the world. The MVAC system is capable of
extracting DNA from non -porous surfaces, like rocks and fabric. Traditional methods do
not capture enough cells to make a viable match. The MVAC system is currently in use
in Police and Sheriff's Departments locally, nationally and internationally. Some of the
local users are the Police Departments of Boca Raton, Coral Springs, Davie, Miami
Beach and Pembroke Pines, as well as Sheriff's Departments of Broward, and Collier
County. All of these contracts were established via a Sole Source. The MVAC System is
the only system currently capable of extracting DNA from rocks and collects more DNA
than traditional methods. This system will add another tool to aid in solving crimes in the
City.

A RESOLUTION OF THE CITY COMMISSION, BY A FOUR-FIFTHS (4/5THS)
AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING,
RATIFYING, AUTHORIZING, AND CONFIRMING THE CITY MANAGER'S FINDING
OF A SOLE SOURCE, ATTACHED AND INCORPORATED AS EXHIBIT "A," WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND
APPROVING THE PURCHASE OF ONE (1) M -VAC FORENSIC
DEOXYRIBONUCLEIC ACID ("DNA") COLLECTION SYSTEM ("MVAC"), FROM M-
VAC SYSTEMS, INC. ("MVAS"), FOR A ONE TIME PURCHASE PRICE OF
$37,335.00, INCLUDING BUT NOT LIMITED TO TRAINING SERVICES,
MAINTENANCE, AND SUPPORT FOR A PERIOD OF THREE (3) YEARS;
ALLOCATING FUNDS FROM THE FISCAL YEAR 2017 EDWARD BYRNE MEMORIAL
JUSTICE ASSISTANCE GRANT ("JAG"), AWARD NO. 2456, PROJECT NO. 19-
190011, TASK NO. 1, ORGANIZATION 191602 AND MIAMI POLICE DEPARTMENT
ACCOUNT NO. 12000.191602.664000.0.0., SUBJECT TO THE AVAILABILITY OF
FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED.
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer has made a finding that M -Vac Systems
("MVAC"), Inc. is the sole source manufacturer, seller, and patent holder of the M -Vac
Deoxyribonucleic Acid ("DNA") Forensic Collection System; and
WHEREAS, The Miami Police Department ("MPD") has a need to purchase one (1) M -
Vac DNA Forensic Collection System to assist the MPD in investigating crimes in the City of
Miami ("City"); and
WHEREAS, the findings of the Chief Procurement Officer have been approved and
adopted as the finding of the City Manager, attached and incorporated as Exhibit "A"; and
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirements for competitive sealed bidding procedures be waived and that the procurement of
the above system, as specified, be approved as a sole source procurement; and
WHEREAS, following a published notice made at least fifteen (15) days prior to the
award, the City Commission is ratifying and approving, by a four-fifths (4/51h) affirmative vote,
the waiver of competitive sealed bidding procedures as a sole source procurement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City
Code, after an advertised public hearing, the City Manager's finding of a sole source, attached
and incorporated as Exhibit "A," is ratified, approved, and confirmed, the requirements for
competitive sealed bidding procedures are waived, and the request to purchase an M -Vac for
the MPD, from M -Vac Systems, Inc., the sole source manufacturer, seller and patent holder of
the M -Vac DNA Forensic Collection System, for a one time purchase price of $37,335.00, is
approved.
Section 3. Funds in the amount of $37,335.00 to be allocated from Fiscal Year 2017
Edward Byrne Memorial Justice Assistance Grant ("JAG'), Award No. 2456, Project No. 19-
190011, Task No. 1, Organization 191602 and MPD Account No. 12000.191602.664000.0.0.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
