Subject: Sole Source - Vacuum Metal Disposition
Purpose of Item:
The nature of this item is to authorize a resolution of the Miami City Commission, with
attachment(s), by a four-fifths ("4/5ths") affirmative vote, pursuant to Section 18-92 of
the Code of the City of Miami, Florida, as amended, after an advertised public hearing,
ratifying, approving and confirming the City Manager's finding of a sole source; waiving
the requirements for competitive sealed bidding procedures and authorizing the City
Manager to execute the Vacuum Metal Deposition 560 Latent Fingerprint Development
System ("VMD560") agreement from West Technology Forensics, Inc. ("West
Technology") for initial term of one (1) year period with the option to renew for three (3)
additional (1) year periods, allocating funds from FY 17 Edward Byrne Memorial Justice
Assistance Grant (JAG), Award No. 2456, Project No. 19-190011, Task No. 1,
Organization 191602 and Account No. 12000.191602.664000.0.0, subject to the
availability of funds and budgetary approval at the time of need; further authorizing the
City Manager to negotiate and execute all other documents, including any amendments,
renewals, and extensions, subject to allocations, appropriations, and budgetary
approval having been previously made, and in compliance with applicable provisions of
the City Code, including the City of Miami's Procurement Ordinance, Anti -Deficiency
Act, and financial integrity principles, all as set forth in Chapter 18 of the City Code, in a
form acceptable to the City Attorney, and in compliance with applicable regulations, as
may be necessary for said purpose.
Background of Item:
The City of Miami's Police Department ("Police") has a need to purchase one (1)
VMD560 to process latent fingerprints from difficult surfaces. The Department of
Procurement ("Procurement") has found that West Technology, it is the sole source
manufacturer and distributor of the VMD560. The VMD560 chamber has a semi-
automatic control system and advanced fingerprint vacuum technology that provides
quick and easy processing of evidence. The VMD560 has been designed by forensic
scientists to ensure consistent and uniform latent fingerprint development on even the
most difficult of surfaces including flexible plastic packaging, plastic bottles, glass,
fabrics, firearms, glossy paper, thermal paper, wood etc. Fingermarks developed by the
system are of a much higher definition and have superior contrast than marks
developed using the cyanoacrylate fuming technique. VMD560's control system and
advanced vacuum technology provides quick and easy processing of evidence, typically
in less than ten (10) minutes and produces results that can be photographed
immediately. Purchasing a VMD560 system will assist Police in solidifying evidence and
expediting the investigation process conducted by Police's Crime Scene Investigation
Unit.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"),
AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND
CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE, ATTACHED
AND INCORPORATED AS EXHIBIT "A"; WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AND AUTHORIZING THE CITY
MANAGER TO EXECUTE THE VACUUM METAL DEPOSITION 560 LATENT
FINGERPRINT DEVELOPMENT SYSTEM ("VMD560") AGREEMENT FROM WEST
TECHNOLOGY FORENSICS, INC. ("WEST TECHNOLOGY") AND CITY OF MIAMI'S
ADDENDUM, FOR AN INITIAL TERM OF ONE (1) YEAR PERIOD WITH THE OPTION

SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT
THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALLOCATIONS,
APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY
MADE, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CITY
CODE, INCLUDING THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI-
DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH
IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, AND IN COMPLIANCE WITH APPLICABLE REGULATIONS, AS MAY BE
NECESSARY FOR SAID PURPOSE.
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer has made a finding that West
Technology, is the sole source authorized dealer of the Vacuum Metal Deposition 560 Latent
Fingerprint Development System ("VMD560"); and
WHEREAS, the Miami Police Department ("MPD") has a need to purchase one (1)
VMD560 system to obtain latent fingerprints from difficult surfaces, an important feature of
effective law enforcement and the gathering of reliable evidence; and
WHEREAS, the purchase of the VMD560 system will assist in expediting the
investigation process by MPD's Crime Scene Investigation Unit; and
WHEREAS, the findings of the Chief Procurement Officer have been approved and
adopted as the finding of the City Manager, attached and incorporated as Exhibit "A"; and
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirements for competitive sealed bidding procedures be waived and that the procurement of
the above system, as specified, be approved as a sole source contract; and
WHEREAS, following a published notice made at least fifteen (15) days prior to the
award, the City Commission is hereby ratifying and approving, by four-fifths (4/5th) affirmative
vote, the waiver of competitive sealed bidding procedures as a sole source;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA"
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City
Code, after an advertised public hearing, the City Manager's finding of a sole source, is ratified,
approved, and confirmed, the requirements for competitive sealed bidding procedures are
waived, and the request to purchase VMD560 for Police, from West Technology, the sole
source manufacturer of equipment, is approved.
Section 3. Funds to be allocated from Fiscal Year 2017 Edward Byrne Memorial Justice
Assistance Grant ("JAG"), Award No. 2456, Project No. 19-190011, Task No. 1, Organization
191602 and Account No. 12000.191602.664000.0.0., subject to the availability of funds
budgetary approval at time of need.
Section 4. The City Manager is authorized' to execute the VMD560 agreement and the
City of Miami's Addendum, in substantially the attached form, with West Technology, the only
manufacturer, authorized service provider, and agent.
Section 5. The City Manager is further authorized' to negotiate and execute all other
documents, including any amendments, renewals, and extensions, subject to allocations,
appropriations, and budgetary approval having been previously made, and in compliance with
applicable provisions of the City Code, including the City of Miami's Procurement Ordinance,
Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City
Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations,
as may be necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

' The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
2 This Resolution shall become effective as specified herein unless vetoed by Mayor with ten (10) days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
