HomeMy WebLinkAboutPZAB (4765) ResolutionCity of Miami City Hall 3500 Pan American Drive PZAB Resolution Miami, FL 33133 www.miamigov.com Enactment Number: PZAB-R-18-064 File ID: 4765 Final Action Date: 12/19/2018 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 10544, AS AMENDED, THE FUTURE LAND USE MAP OF THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN OF THE CITY OF MIAMI, PURSUANT TO AN EXPEDITED STATE REVIEW PROCESS PURSUANT TO SECTION 163.3184(3), FLORIDA STATUTES, BY CHANGING THE FUTURE LAND USE DESIGNATION FROM "MEDIUM DENSITY MULTIFAMILY RESIDENTIAL" TO "RESTRICTED COMMERCIAL" OF THE PROPERTIES LOCATED AT APPROXIMATELY 1415 NORTHWEST 63 STREET AND 1200 NORTHWEST 62 LANE, MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the properties located at 1415 NW 63 Street and 1200 NW 62 Lane, Miami, Florida ("Properties") have a current future land use designation of "Medium Density Multifamily Residential'; and WHEREAS, Miami -Dade County ("Applicant") submitted a Comprehensive Plan Amendment application to change the future land use designation to "Restricted Commercial' for approximately 22.07 acres of the Properties containing approximately 49.35 acres; and WHEREAS, the Properties are located in the Liberty Square public housing development in the Liberty City neighborhood and the Model City Neighborhood Enhancement Team area (NET); and WHEREAS, Liberty Square is the oldest segregated public housing development in the southeastern United States, with many persistent problems with the existing buildings; and WHEREAS, in 2015 Miami -Dade County, through a request for proposals, selected Related Urban to develop and implement a redevelopment plan for the entirety of the Liberty Square neighborhood; and WHEREAS, Liberty Square, before redevelopment, contained over 700 dwelling units and the redevelopment plan seeks to demolish and construct a much greater number of units, providing housing to those residents currently living in Liberty Square and providing new housing options to future tenants; and WHEREAS, the amendment would allow the redevelopment of portions of Liberty Square in such a way as to enliven the street environment by allowing a mix of uses for the community and increase the availability and types of affordable housing, meeting the intent of Housing Policy HO -1.2.3 of the Miami Comprehensive Neighborhood Plan; and City of Miami Page 1 of 3 File ID: 4765 (Revision:) Printed On; 1212612018 WHEREAS, the amendment would increase the allowed residential density from 65 dwelling units per acre to 150 dwelling units per acre; and WHEREAS, Planning, Zoning and Appeals Board ("PZAB") has considered the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the Miami 21 Code, and all other City regulations; and WHEREAS, PZAB has considered the need and justification for the proposed change, including changing and changed conditions that make the passage of the proposed change necessary; and WHEREAS, PZAB, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami ("City") and its inhabitants to recommend approval of this Comprehensive Plan Amendment to the Future Land Use Map as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. PZAB recommends to the City Commission to approve the amendment to Ordinance No. 10544, as amended, the Future Land Use Map of the Miami Comprehensive Neighborhood Plan, pursuant to Expedited State Review procedures in §163.3184(3), Florida Statutes, by changing the Future Land Use designation of 22.07 ± acres of real property at 1415 NW 63 Street and 1200 NW 62 Lane, Miami, Florida from "Medium Density Multifamily Residential" to "Restricted Commercial", as described in "Exhibit A", attached and incorporated. Section 3. It is found that this Comprehensive Plan designation change: (a) Is necessary due to changed or changing conditions; (b) Follows an Expedited State Review Process pursuant to §163.3184 (3), Florida Statutes; (c) Is one which is not located within an area of critical state concern as designated by §380.0552, Florida Statutes or by the Administration Commission pursuant to §380.05(1), Florida Statutes; (d) Will have the density allowed in "Restricted Commercial", 150 dwelling units per acre, pursuant to the Miami Neighborhood Comprehensive Plan, as amended, and intensity will be as established in Article 4 of the City's Zoning Ordinance, the Miami 21 Code, as amended; and City of Miami Page 2 of 3 File ID: 4765 (Revision:) Printed On: 1212612018 (e) Complies with the applicable acreage and density limitations set forth in the Local Government Comprehensive Planning and Land Development Regulation Act.
