A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A,"
THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE
NOT PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY"),
PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED ("CODE"); WAIVING THE REQUIREMENTS FOR
SAID PROCEDURES; AUTHORIZING THE CITY'S DEPARTMENT OF HUMAN
SERVICES ("DEPARTMENT") TO DEVELOP AND DEPLOY A HEATING,
VENTILATION, AIR-CONDITIONING, AND REFRIGERATION (HVAC/R)
TRAINING PILOT PROGRAM ("PILOT") PURSUANT TO SECTION 2-33(C)(9)
OF THE CITY CODE WITH MICROSOFT CORPORATION, A WASHINGTON
FOR PROFIT CORPORATION ("MICROSOFT"), AND WATSCO, INC., A
FLORIDA FOR PROFIT CORPORATION ("WATSCO"), (COLLECTIVELY,
"PROVIDERS"), WHICH ARE QUALIFIED, RESPECTED, AND POSSESS THE
EXPERIENCE, INFRASTRUCTURE, AND PROGRAMMATIC KNOWLEDGE TO
COORDINATE AND IMPLEMENT THE PILOT AND CAN ASSIST WITH THE
PLACEMENT OF PARTICIPATING CITY RESIDENTS IN RELATED JOBS
THROUGHOUT WATSCO'S NETWORK; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A MEMORANDUM OF
UNDERSTANDING ("MOU") WITH THE PROVIDERS FOR THE PILOT, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE PERIOD
COMMENCING JUNE 1, 2019 THROUGH MAY 31, 2020, AND REQUIRING
FUTURE CITY COMMISSION APPROVAL FOR ANY REINSTATEMENT OF
THE PILOT, CONSISTENT WITH SECTION 2-33(C)(9) OF THE CITY CODE.

WHEREAS, the City of Miami ("City") is a leading convener and influencer in the South
Florida career pathway ecosystem, using its Workforce Opportunity Center to prioritize the
building of more "pathways to prosperity" for City residents; and
WHEREAS, Watsco, Inc., a Florida for profit corporation ("Watsco"), is the largest
distributor of equipment, related parts, and supplies in the Heating, Ventilation, Air -Conditioning,
and Refrigeration ("HVAC/R") industry with $4.5 billion in revenues, 5,200 employees in North
America, and a robust network of customer companies and entrepreneurs throughout the
country and is invested in developing stronger pathways into HVAC/R installer and technician
careers; and
WHEREAS, in the United States, twenty-two percent (22%) of the HVAC/R workforce
will retire by 2022 and demand for well-trained HVAC/R installers and technicians will be

increasing faster than the skilled job market can keep up with, resulting in a market demand
need of approximately 115,000 additional HVAC/R installers and technicians by 2022; and
WHEREAS, considering the vast industry shortage of HVAC/R installers and
technicians, the test cohort goal is a placement rate of at least eighty percent (80%) with an
approximate pay rate between $12.00 - $15.00 per hour that can rapidly escalate with
experience to an approximate average salary of more than $42,000.00 in Miami, Florida,
according to the United States Department of Labor Bureau of Labor Statistics; and
WHEREAS, pursuant to Section 2-33(c)(9) of the Code of the City of Miami, Florida, as
amended ("City Code"), the City's Department of Human Services ("Department"), as part of the
ACCESS Miami Program, wants to develop and deploy an HVAC/R Training Pilot Program
("Pilot") with Microsoft Corporation, a Washington profit corporation ("Microsoft"), and Watsco,
(collectively, "Providers"), which are qualified, respected, and possess the experience,
infrastructure, and programmatic knowledge to coordinate and implement the Pilot and can
assist with the placement of participating City residents in related jobs throughout Watsco's
network; and
WHEREAS, this Pilot advances skills -based hiring in partnership with the City, as an
anchor organization, Watsco, as an anchor funder supporting operational sustainability and
providing committed local HVAC/R employers, and Microsoft, as the lead on the technological
and technical skills building component and as provider of seed money for certifications,
technical curriculum, and technical equipment; and
WHEREAS, pursuant to Section 18-85(a) of the City Code, the City Manager has made
a finding, attached and incorporated as Exhibit "A", that competitive negotiation methods and
procedures are not practicable or advantageous to the City in addressing the Pilot and seeks a
waiver of the requirements for said procedures; and
WHEREAS, the City Manager is requesting authority from the City Commission to
negotiate and execute a Memorandum of Understanding ("MOU") with the Providers for the
Pilot, in a form acceptable to the City Attorney, for the period commencing June 1, 2019 through
May 31, 2020, and requiring future City Commission approval for reinstatement of the Pilot
pursuant to Section 2-33(c)(9) of the City Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 18-85(a) of the City Code, by a four-fifths (4/5ths)
affirmative vote, after an advertised public hearing, the City Manager's finding, attached and
incorporated as Exhibit "A," that competitive negotiation methods and procedures are not
practicable or advantageous to the City in addressing the Pilot and waiving the requirements for
said procedures is ratified, approved, and confirmed.
Section 3. Pursuant to Section 2-33(c)(9) of the City Code, the City Manager is
authorized to develop and deploy the Pilot with the Providers, which are qualified, respected,
and possess the experience, infrastructure, and programmatic knowledge to coordinate and
implement the Pilot and can assist with the placement of participating City residents in related
jobs throughout Watsco's network.

Section 4. The City Manager is further authorized' to negotiate and execute an MOU
with the Providers for the Pilot, in a form acceptable to the City Attorney, for the period
commencing June 1, 2019 through May 31, 2020.
Section 5. Any reinstatement of the Pilot pursuant to Section 2-33(c)(9) of the City Code
will require future City Commission approval.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

' The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
