(the "Applicant") 5200 NE 2 Avenue, Miami, Florida (the "Property") Letter of Intent for Street and Easement Closure Dear Francisco: Our firm represents Miami Jewish Health Systems, Inc., with respect to land use and zoning matters in connection with the above referenced Property. On behalf ol'the Applicant, we respectfully submit the enclosed Vacation and Closure Application for a portion of NE 52"d Terrace and NE Is` Avenue which traverses the Property (the "Street Closure") and as depicted in the image below. The Applicant is the record owner of all parcels abutting the portion of the alley that is the subject of the Vacation and Closure Application. Further, certain easements throughout the Property will be vacated and replaced by easements by instrument where required. The locations of the easements to be vacated are depicted below, with the sketch and legal descriptions of all easements and the street closure provided in Exhibit A. The purpose of the replat is to vacate the street and easements at the Property, as a part of the Miami Jewish Health Systems Special Area Plan. Any easements being vacated which still serve a purpose will be replaced with an easement by instrument. Further, the Plat and Street Committee voted in favor of approving the vacation and closure of the street and easements and has issued a recommendation of approval to the Planning, Zoning, and Appeals Board. The Plat and Street Committee determined that the application for alley and easements closures meets the criteria established in Section 55-10 of the City Code. I. Is it in the public interest, or would the general public benefit from the vacation of the right of way? Vacation and closure of the street would remove this portion of the street from the City's maintenance schedule, removing a burden on City services and the taxpayers. Furthermore, the street is located entirely within the boundaries of the Miami Jewish Health Systems Campus. The Special Area Plan proposes construction of the Empathicare Village over the vacated street which will replace the existing surface parking with a parking structure and a state of the art memory care center which will serve the community. The easements may be occupied by utility lines that only serve the Property. There are no utility lines within the easements that serve any other properties. As such, the vacation of the easements will have no impact on the general public, as the general public is not benefitted by the easements in any way. By vacating the easements and improving the campus, the general public. will be benefitted. The easements will be replaced by an easement by instrument where required. II. Is the general public no longer using the right of way, including public service vehicles, fire, or other emergency vehicles? The portion of the street being vacated is only utilized by Miami Jewish Health Systems staff to access the staff parking lots. Parking will be provided within the parking structure following vacation of the street and construction of the Empathicare Village. The general public and service vehicles do not use the street currently. As noted above, the general public does not utilize the easements, the easements are merely for utility lines serving the Property. Public service vehicles, including police and fire, do not use the easements. The easements will be replaced by an easement by instrument where required. 2 GREENBERG TRAURIG, P.A. Would there be no adverse effect on the ability to provide police, fire, or emergency services? As noted above, public service vehicles are not utilizing the street; however, the Empathicare Village will be reviewed by police, fire, and emergency services for compliance with their requirements. There will be no adverse effect on the ability to provide police, fire, or emergency services. Service vehicles do not utilize the easements, the easements are merely for utility lines serving the Property. There will be no adverse effect on the ability to provide police, fire, or emergency services, as these services are not utilizing the easements. IV. Would the vacation and closure of the right of way have a beneficial effect on pedestrian and vehicular circulation in the area? Through the platting process, subdivision improvements will be made which will improve circulation and the pedestrian realm along the public right of way. The street is not currently used for circulation of vehicles or pedestrians, and is utilized solely for access to the staff parking lots. The enhancements proposed through the Special Area Plan and platting process will benefit the pedestrian circulation through the implementation of the civic spaces along the border of the entire campus. The easements to be vacated are not used for pedestrian or vehicular circulation and are merely for underground utility lines. The vacation of the easements will have no effect on pedestrian or vehicular circulation. For the reasons stated above, and in connection with the City Plat and Street Committee's recommendation of approval of the street and easement vacation, we submit the enclosed Vacation and Closure Application for the portion of the streets located at 5200 NE 2 Avenue.
