REQ UE T: Pursuant to Section 55-16{c}, of the City God of Ordinances, the applicant
requests the vacation, closure, and discontinuing the use of a public street. The street closure
request is accompanied by seven (7) easement vacations and, as required, the applicant will
replace any easements by instrument within the subject site. The reap below identifies the road
closure (blue) and easement closures (green). No.1 — Street Closure, Nos. 1, 2, 3. and 5 - Utility
Easement Closures, and Nos. 4, 5 and 7 — Emergency Access Easement Closures_

BACKGROUND
The Miami Jewish Health Systems (MJHS) has served the community for more than 75 gears at
its current location. The healthcare facility assists patients of all ages. MJHS provides 4 -hour
services, seven days a week that includes but not limited to the following: on-site hospital,
ambulatory, health clinic, specialized centers for biofeedback, mental health, rehabilitation,
memory centers, and assisted living facilities. MJHS currently provides 1014 Assisted Living
Facilities_ Its faciiities currently care for more than 12,000 patients within the community.
To improve the Miami Jewish Health Systems services to the community, the operators are
presently proposing a Special Area Plan (SAP) for the campus_ The SAP will allow expansion of
MJHS services, include lodging, involves modernization of services, provide centralized parking
facilities, and expansion of service capacities.
Associated with the proposed MJHS SAP, the applicant seeks to close, vacate, abandon, and
discontinue public use of a portion of NE Miami Place and NE 52 Terrace. The proposal also
includes tare vacation of seven (7) easements and, as required, the replacement of easements by
instrument within the MJHS properties_ The streets closure and easement vacations will occur by
the re -platting of the assemblage of contiguous properties consisting of approximately 20 acres
c 871,200 square feet located between NE 50 Terrace, NE 53 Street, NE Miami (Place, and North
Miami Avenue within the City of Miami's Little Haiti neighborhood through Enriching Lives By
Design Tentative Plat #1879.

The following is an evaluation of the request pursuant to Section 55-15(c) of the City Code of
Ordinances which states that in addition to technical requirements for vacation and closures, that
the Plat and Street Committee review four (4) public interest findings related to vacation and
closures. The Plat and Street Committee Findings for the street closure application are attached
as Exhibit A, and summarized below,
1 _ Public Interest Finding: Is it in the public interest, or would the general public benefit from
the vacation of the rights -of -ways or easements?
Flat and Street Committee Response. This proposed street closure is necessary ars part of
the facility/campus expansion for a Dementia Center. It is a major improvement for the area
and an update to the medioal campus that has been in existence for about 75 years. The
facilities employ significant numbers of people from neighboring community, Streets that are
proposed (a portion of NE Miarni Place and NE 52 Terrace) to be closed1vacated are currently
only servicing abutting lots awned by the applicant- Miami Jewish Health Systems, Inc, - and
are currently being used as part of campus.

including public service vehicles such as trash and garbage truck. police, fire or other
emergency vehicles'
Plat and Street Committer: Response: Streets are currently still being utilized for circulation
purposes. There are access points to the campus facilities from main streets.

3. Public Interest Finding: Would there be no adverse effect an the ability to provide police,
fire or emergency services'
Plot and Street Committee Response: Public service vehicles would be adversely affected;
however: the applicant has agreed to provide an emergency vehicle access master plan for
review and approval by corresponding departments. The facility is not being serviced by City
of Miami Solid Waste, It is being serviced by private solid waste company,
4_ Public Interest Finding: Would the vacation and closure of the rights-of-way or easements
have a beneficial effect on ,pedestrian and vehicular circulation in the area?
Plat and Street Committee Response: As part of a Special Area. Plan (SAP), the new facility
will create landscape public spaces resulting in better environment for pedestrians activities.
On January 19, 2017, The Plat and Street Committee members voted to recommend
approval, unanimously 5 to 0, of the requested closure and vacation of the streets and the
additional easements request subject to conditions.
In relation to the Pleat and Street Committee determined that the application for street and
easements closures meets the criteria established in Section 55-10 of the City Code, that
applicant has presented these findings to support the closure of the streets and easements as
follows..
Is it in the public interest, or would the general public benefit from the
vacation of the right of way?
Vacation and closure of the street would remove this portion of the street from the
City's maintenance schedule. removing a burden on City services and the
taxpayers. Furthermore, the street is located entirely within the boundaries of the
Miami Jewish Health Systems Campus. The applicant proposed a Special Area
Plan which includes the construction of the Empathicare Village over the vacated
street. The new building will replace the existing surface parking with a parking
structure and a state of the art memory care center which will serve the comm unity.
The easements may be occupied by utility lines that only serve the Property. There
are no utility lines within the easements that serve any other properties_ As such,
the vacation of the easements will have no impact on the general public, as the
general public is not benefitted by the easements in any way. By vacating the
easements and improving the campus, the general public will be benefitted_ The
easements wiiI be replaced by an easement by instrument where required.
II. Is the general public no longer using the right of way, including public
service vehicles, fire, or other emergency vehicles?
The portion of the street being vacated is only utilized by Miami Jewish Health
Systems staff to access the staff parking lots_ Parking will be provided within the
parking structure following vacation of the street and construction of the

Ern pat hicare Village- The general public and service vehicles do not use the street
currently -
As noted above, the general public does not utilize the easements, the easements
are merely for utility lines serving the Property. Public service vehicles, including
police and fire. do not use the easements. The easements will be replaced by an
easement by instrument where required.
III. Would there be no adverse effect on the ability to provide police, fire, or
emergency services?
As noted above, public service vehicles are not utilizing the street: however, the
Empathicare Village will be reviewed by police, fire, and emergency services for
compliance with their requirements. There will be no adverse effect on the ability
to provide police„ fire, or emergency services -
Service vehicles do not utilize the easements, the easements are merely for utility
lines serving the Property, There will be no adverse effect on the ability to provide
police, fire, or emergency services, as these services are not utilizing the
easements,
IV. Would the vacation and closure of the right of way have a beneficial effect
on pedestrian and vehicular circulation in the area's
Through the platting process, subdivision improvements will be made which will
improve circulation and the pedestrian realm along the public right of way. The
street is not currently used for circuIartion of vehicles or pedestrians, and is utilized
solely for access to the staff parking lots. The enhancements proposed through
the Special Area Plan and platting process will benefit the pedestrian circulation
through the implementation of the civic spaces along the border of the entire
campus.
The easements to be vacated are not used for pedestrian or vehicular circulation
and are merely for underground utility lines. The vacation of the easements will
have no effect on pedestrian or vehicular circulation.
CONCLUSION.,
The proposed street and closures are consistent with the goals, objectives, and policies of the
Miaml Comprehensive Neighborhood Plan (MCNP). These closures will facilitate cohesive
development, economic growth, and revitalization, as the proposed development. Specifically,
MNP Policy LU -1,3,15 states, that the City will continue to encourage a development pattern
that enhances existing neighborhoods by developing a balanced mix of uses including areas for
employment, shopping, housing; and recreation in close proximity to each other -
The closure of the streets (NE Miami Place and NE 52 Terrace) and easements, as presented,
are important for the enhancement of the areas surrounded by allowing the Miami ,newish Health
Systems to further develop its campus to expand its services to the community. The street
closures will result in a positive impact for the neighborhood and for the City of Miami in general.

Based on the Plat and Strut Committee findings that the tentative plat of Enriching Lives By
Design — Tentative Plat #1879-B (Second Submittal) and determined that all technical
requirements contained in the Miami Code Subdivision Regulations have been met recommends
approval of the streetclosure and additional easements with conditions.
Therefore, based on the Plat and Street Committee's recommendation and staff's analysis, the
Planning and Zoning Department recommends the Approval of the request to close,. vacate,
abandon, discontinue from public use the streets and additional easements subject to the
following conditions -
1. The applicant, owner or their successor shall meet applicable development standards
identified in the Miami 21 Cade and all applicable local, county, state, and federal
regulations.
. The applicant shall provide an access plan for review and acceptance by the City's Fire -
Rescue: Police, Solid Waste Departments and the Capital Improvements Program/Office
Transportation.
3. A building permit, including phased permits, will not be issued an the property being
platted until the final plat is recorded or as authorized by the City of Miami Code Section
55-10(i),
4, A Certificate of Occupancy shall only be issued after all the required subdivision
improvements have been completed.
S. The applicant or thei r successor shall comply with the conditions of approval stated for the
Enriching Lives By Design Tentative Plat #1879-13, in a letter dated March 16. 2017 from
the Department of Public Works.
6. Prior the approval of the Enriching Lives By Design — Tentative Plat #1879, the applicant
shall have any easement that require replacement executed by instrument in compliance
with City Code, Miami -Dade regulations, and City of Miami Subdivision Regulations: as
applicable.
