Background of Item: An easement and corresponding lease agreement is required to complete a Florida Inland Navigational District (FIND) for Design by May 24, 2019. The City Commission previously approved Resolution RE.7; File ID 5528; Enactment No. R-19-0126 on March 28, 2019 authorizing the City Manager to submit a grant reimbursement application to FIND. The project is a Phase 1 for design and permitting of an over -the -water section underneath the 1-395 MacArthur Causeway connecting Museum Park (1191 Biscayne Blvd) in the south to the FDOT ROW parcel in the north. FERRE PARK TO FUTURE UPLAND BAYWALK SECTIONS NORTH OF INTERSTATE 395. WHEREAS, the City of Miami ("City") seeks to add an additional safe method of transportation for residents, tourists, pedestrians, and bicyclists under the south side of the MacArthur Causeway between Maurice A. Ferre Park and the upland property north of the MacArthur Causeway; and WHEREAS, in order to do so and to provide a recreational amenity to the City's residents and visitors, the City wishes to construct a section of the City's baywalk system over the water underneath the MacArthur Causeway at a point just east of where Florida Department of Transportation's (TDOT") upland portion of Interstate 395 ("1-395") meets Biscayne Bay; and WHEREAS, on March 28, 2019, the City Commission adopted Resolution No. 19-0126, which authorized the City Manager to seek grant funding for said project from the Florida Inland Navigational District ("FIND"); and WHEREAS, the City Commission wishes to enter into a lease agreement to lease a portion of the MacArthur Causeway right-of-way, within Biscayne Bay and under the current fixed bridge to Watson Island, in order to construct and maintain this portion of the baywalk upon future funding becoming available; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to negotiate and execute a lease agreement, in a form acceptable to the City Attorney, including any renewals thereof, with FDOT to allow for the construction and maintenance of an overwater baywalk connection just east of where 1-395 meets Biscayne Bay between Maurice A. Ferre Park and the uplands located north of 1-395. ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 Un ndez, City Attor iey 4/29/2019 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
