HomeMy WebLinkAboutR-19-0161City of Miami 1 i.RR cl Legislation alldl 1lm Resolution: R-19-0161 File Number: 5679 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 4/25/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, ACCEPTING THE PLAT TITLED "AWANA FOREST," A REPLAT IN THE CITY OF MIAMI OF THE PROPERTY DESCRIBED IN ATTACHMENT "1," SUBJECT TO SATISFACTION OF ALL CONDITIONS REQUIRED BY THE PLAT AND STREET COMMITTEE AS SET FORTH IN EXHIBIT "A," ATTACHED AND INCORPORATED, AND THE PROVISIONS CONTAINED IN SECTION 55-8 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; ACCEPTING THE DEDICATIONS SHOWN ON THE PLAT; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT AND CAUSE THE RECORDATION OF THE PLAT IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA. WHEREAS, the Plat and Street Committee ("PSC'), established pursuant to Chapter 55 of the Code of the City of Miami, Florida, as amended ("City Code"), at its meeting of September 25, 2017 and subsequent meetings of February 7, 2019 and March 7, 2019, reviewed the proposed plat titled "Awana Forest" and determined that all technical requirements have been met; and WHEREAS, the PSC recommends the acceptance of the aforesaid plat; and WHEREAS, the Planning, Zoning and Appeals Board (TZAB"), at its meeting on June 6, 2018, adopted Resolution No. PZAB-R-18-031 recommending approval of closing, vacating, abandoning, and discontinuing for public use a street located at Northeast 14 Terrace between Biscayne Boulevard and North Bayshore Drive within the plat; and WHEREAS, the City Commission, at its meeting on September 27, 2018, adopted Resolution No. 18-0426 approving the closure, vacation, abandonment, and discontinuance for public use a street located at Northeast 14 Terrace between Biscayne Boulevard and North Bayshore Drive within the plat; and WHEREAS, the purpose of the street vacation/closure is for the expansion of the existing Miami -Dade County Omni Bus Terminal; and WHEREAS, the vacated/closed Northeast 14 Terrace, in its entirety, will become property of Miami -Dade County and be used for a public purpose as a part of the Miami -Dade County transportation system; and WHEREAS, the Applicants are Resorts World Miami LLC and Miami -Dade County ("Applicant" or "Applicants"); and WHEREAS, the Applicant shall repay any restricted funds in accordance with Sections 55-15(a) and 55-16(c) of the City Code unless the City Code is amended to provide otherwise before recordation of the final plat; and City of Miami Page 1 of 2 File ID: 5679 (Revision: A) Printed On: 5/10/2019 File ID: 5679 Enactment Number: R-19-0161 WHEREAS, the Applicant shall either retain the trees on the Property or relocate the trees on the Property to a suitable location at the Applicant's sole expense; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The plat titled "Awana Forest," a replat of the property described in Attachment 1," which plat by reference, in substantially the attached form, and subject to satisfaction of all conditions required by the PSC as set forth as Exhibit "A," attached and incorporated, and the provisions contained in Section 55-8 of the City Code and herein, is accepted. Section 3. The dedications shown on the aforesaid plat together with the dedications to the perpetual use of the public of all existing and future plantings, trees, and shrubbery on said dedications are hereby accepted and confirmed by the City of Miami. Section 4. The City Manager and City Clerk are authorized' and directed to execute the aforesaid plat and cause the same to be recorded in the Public Records of Miami -Dade County, Florida. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 iria i t_- eU�zky AAttor ey 5/9/2019 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
