This law firm represents Jose and Gisela Soberon in relation to the request for Miami
Neighborhood Comprehensive Plan (MCNP) amendment and extending of the T4 -R zoning to
our property presently zoned T3 -R. Please allow this to serve as the required letter of intent in
connection with the request for the extension of the T4 -R zoning to the above property. Exhibit
"A" is the map of the boundary survey.
Property. This property is located just west of S.W. 28 and east of S.W. 29th Ave. The
property is located within the City of Miami. It is presently a vacant lot (photo #1). It is south of
S.W. 10 st, the second lot on the block from the north side of this block. The lot is
approximately 8100 sq. ft. The Miami Dade folio number is 01-4109-019-0370. The property
appraiser summary report is attached as Exhibit "B" and a copy of the warranty deed attached
as Exhibit "D".
The property is zoned T3 -R. The property's future land use is designated on the Future
Land Use Map (PLUM) as duplex residential. The Property is not historically designated, nor
within a historic district. Further, the Property is not located within an archeological
conservation area.
To the west of the Property for one block the zoning is T3 -R and the next zoning is T5 -R.
The Property is bordered to the north with multi -family residential zoned T4 -R. To the south of
the Property the properties are zoned T3-0.
Request. The applicant seeks a Miami Comprehensive Plan (MCNP) amendment to
amend the 2020 Future Land Use Map (FLUM) and Section 62-8 of the Municipal Code for the
City of Miami from Duplex Residential to remain low Density Multifamily Residential. The
applicant is seeking to rezone from T3 -o (Sub -Urban -Open) Transect Zone to T4 -R (General
Urban -Restricted). The applicant intends to construct a 2 -story residential building in
accordance with all requirements of the T4 -R.
Section 7.1.2.8(0 of Miami 21 states that a rezoning of land will only be considered
where the proposal involves an extension of an existing transect boundary, unless the rezoning
involves at least 40,000 square feet of land area or 200 feet of street frontage. The applicant is
requesting an extension of an existing transect boundary for the Property.
Analysis Pursuant to Article 7, Section 7.1.2.80(2)(g) of Miami 21. The applicant
intends to construct a two story multi -family residential building in accordance with medium
density and all requirements of the T4 -R zoning. The properties immediately to the north are
similarly designated. For only one block to the east the properties are zoned T3 -o but
immediately west of that block the properties have a zoning of TS -R. To the east of the
Property starting on its border the properties are zoned T4 -R.
The radius area has a to the north and east many multi -family units with T4 -R compliant
units. The radius area to the west and south have multi -family residential units. The radius area
appears to be in need of redevelopment. Many of the properties appear to have after the fact
living units as evidenced by the large number of doors and parking spaces in what appear to be
duplex buildings.
Enclosed please find photographs of the properties within a 300 -foot radius of the
property. Attached photos numbered 2 thru 16.
Further pursuant to policy LU -1.6.3 of the MCNP the proposed zoning will continue the
residential character of the neighborhood, however it will greatly improve and enhance the
physical character and appearance of the neighborhood, the granting of this request would
serve as a catalyst for other property owners to redevelop their properties in furtherance of the
objectives of the Miami 21 code. It will positively influence on the living conditions in the
neighborhood. The proposed change is in harmony with the established land use pattern. The
change requested is not out of scale with the needs of the city. Moreover, the Property is
located within 2 blocks of S.W. 8st a street. A street full of commercial establishments offering
opportunity for employment and furthering the transportation goals of the MCNP by providing
pedestrian accessibility for employment.
Code Violations and/or liens. The Property has no outstanding code violations or liens.
ZoninjR Verification Letter. The zoning verification letter has been ordered on line from
the City of Miami. Upon receipt of same it will be annexed to this letter.
Nearest Transit Station. The Property is located within 516 feet to a Miami Dade
County bus stop located directly east of the property. The property is located approximately
1.57 miles from the nearest Metrorail station located at s.w. 27th avenue and US 1.

The applications are subject to review and compliance with the requirements of all City
departments, as applicable. The following comments are intended to assist and expedite
applications based on the applicant's modifications of the applications suggested herein.
These applications have been reviewed for the following:
o Application for a Comprehensive Plan Amendment pursuant to Policy LU -1.6.4 of the
Miami Comprehensive Neighborhood Plan (MCNP) to amend the 2020 Future Land Use
Map (FLUM) and Section 62-8 of the Municipal Code for the City of Miami from Duplex
Residential to Medium Density Multif�Residential.
o Application for Rezone pursuant to Article 7, Section 7.1.2.8.c of the Miami 21 Zoning
Code which states that except where the proposal for the rezoning of property involves an
extension of an existing Transect bou d ry, no rezoning of land shall be considered which
involves less an o y thou -sand (40,000) square feet of land area or two hundred (200)
feet of street Frontage on one 1 street. The applicant is requesting to rezone frdWW
(Sub -Urban -Open) Transect Z General Urban -Restricted).
The following Planning comments must be addressed and provided to the Office of
Planning so that the permitting process can continue:
General:
PursuantoArticle 7, Section 7.1.2.8.c.2.g p#ease provide an analysis of the properties
within a one-half mile radfus of the subject property regarding the existing condition of
,le radius properties and the current zoning and Future Land Use designations of the
radius properties. The anaiysishall include photos of Building elevations of both sides
of the street extending three hundred (300) feet beyond all boundaries of the site. An

2. The proposed parcel being rezoned equal a total of 8100 sq. ft.. however the parcel
meets the requirement of extension to an existing boundary. While the minimum. criteria
to submit a Rezone Application and a Comprehensive Plan Amendment have been met,
this letter in no way indicates staffs support recommending approval of the proposed
amendments.
