HomeMy WebLinkAboutPZAB (2677) ResolutionCity of Miami City Hall .F 3500 Pan American Drive PZAB Resolution Miami, FL 33133 www.miamigov.com f'(A.1'ifi Enactment Number: PZAB-R-18-027 File ID: 2677 Final Action Date: 6/6/2018 A RESOLUTION OF THE MIAMI PLANNING, ZONING, AND APPEALS BOARD, WITH ATTACHMENTS, RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM T3-0, "SUB -URBAN TRANSECT ZONE -OPEN", TO T4 -R, "GENERAL URBAN TRANSECT ZONE -RESTRICTED", FOR THE PROPERTY LOCATED AT APPROXIMATELY 1015 SW 29 AVENUE, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the property located at approximately 1015 SW 29 Avenue, Miami, Florida ("Property") has a current zoning classification of T3-0, "Sub -Urban Transect Zone -Open"; and WHEREAS, the Property is located within the Coral Way NET area and is located within the Citrus Park Subdivision; and WHEREAS, Jose and Gisela Sobero ("Applicant") submitted a request to change the zoning classification to T4 -R, "General Urban Transect Zone -Restricted"; and WHEREAS, the proposed change of zoning classification will disrupt the established character of the surrounding single and duplex residential neighborhood; and WHEREAS, the proposed change of zoning classification will result in an increase in residential density from 18 units per acre to 36 units per acre and will allow multifamily housing by Right, and WHEREAS, the size and scale of the adjacent uses and structures within the existing neighborhood do not support the proposed increase in density and intensity; and WHEREAS, the Applicant voluntarily proffered to limit any development to two (2) stories and six (6) units, which will be memorialized in a Declaration of Restrictive Covenants to be reviewed and approved by Planning and reviewed and approved as to legal form and correctness by the City Attorney; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has considered the goals, objectives, and policies of the Miami Comprehensive Plan, the Miami 21 Code, and all other City regulations; and WHEREAS, the PZAB gave full consideration to the Director's recommendations; and City of Miami Page 1 of 3 File ID: 2677 (Revision: A) Printed On: 612612018 WHEREAS, the PZAB has considered the voluntarily proffered conditions by the Applicants limiting the development of the Properties; and WHEREAS, the PZAB considered the relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan and whether the proposed change will further the goals, objectives, and policies of the Comprehensive Plan, the Miami 21 Code, and other City regulations; and WHEREAS, the PZAB considered the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed changes necessary; and WHEREAS, the PZAB finds that the request maintains the goals of the Miami 21 Code to preserve neighborhoods and to provide transitions in intensity, density, building height and scale; and WHEREAS, the PZAB, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants to recommend that this this change of zoning classification with the conditions as voluntarily proffered by the Applicant as hereinafter set forth be approved; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The PZAB recommends, with conditions, approval of the Ordinance amending the Zoning Atlas of Ordinance No. 13114, as amended, by changing the zoning classification from T3-0, "Sub -Urban Transect Zone- Open", to T4 -R, "General Urban Transect Zone -Restricted", for the Property, as more particularly described in Exhibit "A", attached and incorporated. Section 3. This Resolution shall become effective upon adoption by PZAB.
