City of Miami City Hall a 3500 Pan American Drive 14 PZAB Resolution Miami, FL 33133 I i�il li 11 [ -.yr www.miamigov.com u.+ Enactment Number: PZAB-R-18-041 File ID: 4436 Final Action Date: 9/5/2018 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM 74-L" GENERAL URBAN TRANSECT ZONE -LIMITED, TO "75-0" URBAN CENTER TRANSECT ZONE—OPEN, FOR APPROXIMATELY .318 ACRES OF REAL PROPERTY LOCATED AT APPROXIMATELY 201 NORTHWEST 21 STREET, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the property located at approximately 201 Northwest 21St Street, Miami, Florida ("Property") has a current zoning designation of 74-L" — General Urban Transect Zone - Limited and 75-0" — Urban Center Transect Zone -Open; and WHEREAS, 201 NW 21 Street LLC ("Applicant") submitted a request to change the zoning designation of the "74-L" — General Urban Transect Zone -Limited portion of the Property ("Subject Property") to 75-0" — Urban Center Transect Zone -Open; and WHEREAS, the site of the Subject Property is 0.318± acres in size and is within the Overtown neighborhood, on the border with the Wynwood arts district; and WHEREAS, the Property fronts Northwest 2nd Avenue, an important corridor in the neighborhood; and WHEREAS, the proposed amendment would unify the Property under one zoning designation; and WHEREAS, the unification of the zoning designation on the Property would enable the redevelopment or adaptive reuse of the Property in a manner which is in line with the pattern of development on either side of the Property; and WHEREAS, the proposed zoning change is appropriate in light of the intent of the Miami 21 Code and particularly in relation to the effects on adjoining properties; and WHEREAS, the Planning Zoning and Appeals Board ("PZAB") has considered the relationship of the proposed amendment to the goals, objectives and policies of the Miami Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the Comprehensive Plan, the Miami 21 Code, and all other City regulations; and City of Miami Pagel of 2 File ID: 4436 (Revision:) Printed On: 911912018 WHEREAS, the PZAB has considered the need and justification for the proposed change, including changing and changed conditions that make the passage of the proposed change necessary; and WHEREAS, the proposed change maintains the goals of the Miami 21 Code to preserve neighborhoods and provide transitions in intensity and building height; and WHEREAS, the PZAB, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami ("City") and its inhabitants to recommend approval of this amendment as hereinafter set forth; WHEREAS, the PZAB has found that there is competent substantial evidence to recommend approval of this zoning change, as hereinafter set forth, to the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Planning, Zoning and Appeals Board ("PZAB") recommends that the City Commission amend the Zoning Atlas of Ordinance No. 13114, as amended, by changing the zoning classification from 74-L" — General Urban Transect Zone -Limited to 75-0" — Urban Center Transect Zone — Open, for the property located at approximately the western portion of 201 NW 21 Street, Miami, Florida, as more specifically described in "Exhibit A", attached and incorporated. Section 3.
