HomeMy WebLinkAboutOrdinance 13561Vop City of Miami F .. * '8601is,s.,"�� * Legislation ° R `O Ordinance: 13561 File Number: 15-00678A2 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/24/2015 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, NAMED THE MIAMI 21 CODE ("MIAMI 21 CODE"), BY CHANGING THE ZONING CLASSIFICATION FROM "D2" INDUSTRIAL ZONE TO "D1" WORK PLACE; FROM "D2" INDUSTRIAL ZONE TO 75-0" URBAN CENTER ZONE OPEN; FROM "D1" WORK PLACE TO 75-0" URBAN CENTER ZONE OPEN; FROM 75-0" URBAN CENTER ZONE OPEN TO 76-8-0" URBAN CORE ZONE OPEN; FROM 76-8-0" URBAN CORE ZONE OPEN TO 75-0" URBAN CENTER ZONE OPEN; FROM "D1" WORK PLACE TO 76-8-0" URBAN CORE ZONE OPEN; FROM 75-L" URBAN CENTER ZONE LIMITED TO 75-0" URBAN CENTER ZONE OPEN; FROM 75-L" URBAN CENTER ZONE LIMITED TO 76-8-0" URBAN CORE ZONE OPEN, FOR CERTAIN PARCELS OF APPROXIMATELY 171.00 ACRES, AND FOR THE CREATION OF THE NEIGHBORHOOD REVITALIZATION DISTRICT 1 ("NRD-1") OF APPROXIMATELY 166.94 ACRES, BOUNDED APPROXIMATELY BY INTERSTATE 95 ON THE WEST, NORTHWEST 29TH STREET ON THE NORTH INCLUDING SPECIFIC PARCELS FRONTING NORTHWEST 29TH STREET ON THE NORTH, AND THE FLORIDA EAST COAST RAILWAY CORRIDOR ON THE EAST, THE NORTHERN BOUNDARY OF THE SOUTHEAST OVERTOWN/PARKWEST COMMUNITY REDEVELOPMENT AGENCY WEST OF NORTHWEST 1 PLACE ON THE SOUTH AND AS DEPICTED IN EXHIBIT "A" EAST OF NORTHWEST 1 PLACE ON THE SOUTH, MIAMI, FLORIDA, AS DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, WITH NRD-1 MODIFYING THE TRANSECT ZONE REGULATIONS THAT ARE APPLICABLE TO THE SUBJECT PARCELS EXCEPT FOR THOSE PARCELS OF PROPERTIES SOUTH OF NORTHWEST 20 STREET AND EAST OF NORTHWEST 1 PLACE, AS DESCRIBED IN EXHIBIT "B", AS AMENDED ATTACHED AND INCORPORATED; FURTHER AMENDING THE MIAMI 21 CODE BY ADDING "APPENDIX J: NEIGHBORHOOD REVITALIZATION DISTRICTS", CONTAINING THE REGULATIONS SET FORTH THEREIN, ATTACHED AND INCORPORATED; MAKING FINDINGS OF FACT AND STATING CONCLUSIONS OF LAW; PROVIDING FOR BINDING EFFECT; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, Ordinance No. 13114, as amended, was adopted as the City of Miami's ("City's") Zoning Ordinance ("Miami 21 Code"); and WHEREAS, the Neighborhood Revitalization District 1 ("NRD-1") consists of approximately 166.94 ± acres of selected parcels, as described in Exhibit "A", hereby attached; and WHEREAS, on May 7, 2015, a public workshop was held to discuss the proposed NRD-1 with the Wynwood Business Improvement District ("BID"), the general public, and interested parties; and City of Miami Page 1 of 3 File Id. I5 -006787t2 (Version: 4) Printed On: 3/23/2018 File Number: 15-00678zt2 Enactment Number: 13561 WHEREAS, Neighborhood Revitalization Districts ("NRDs") are needed to assist in revitalizing unique and distinctive areas of the City that exhibit a certain defined character worthy of enhancements; and WHEREAS, the proposed NRD-1 will transition an industrial district into a diverse, mixed-use, residential neighborhood; and WHEREAS, the NRD-1 will also preserve the unique street art and industrial characteristics of the current Wynwood District while promoting a 24-hour environment where people work, live, and play; and WHEREAS, the Miami Planning, Zoning, and Appeals Board ("PZAB"), at its meeting of June 17, 2015, Item No. PZAB 6, following an advertised hearing, adopted Resolution No. PZAB-R-15-038 by a vote of nine to zero (9-0), recommending APPROVAL, with a modification, of the Neighborhood Revitalization District 1 (NRD-1); and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Zoning Atlas of the Miami 21 Code, is hereby amended, by changing the zoning classification from "D2" Industrial Zone to "D1" Work Place; from "D2" Industrial Zone to 75-0" Urban Center Zone Open; from "D1" Work Place to 75-0" Urban Center Zone Open; from 75-0" Urban Center Zone Open to 76-8-0" Urban Core Zone Open; from "76-8-0" Urban Core Zone Open to "75-0" Urban Center Zone Open; from "D1" Work Place to 76-8-0" Urban Core Zone Open;; from 75-L" Urban Center Zone Limited to 75-0" Urban Center Zone Open; from 75-L" Urban Center Zone Limited to 76-8-0" Urban Core Zone Open, for certain parcels of approximately 171.00 acres, and for the creation of the Neighborhood Revitalization District 1 ("NRD-1 ") of approximately 166.94 acres, bounded approximately by Interstate 95 on the west, Northwest 29th Street on the north including specific parcels fronting Northwest 29th Street on the north, the northern boundary of the Southeast Overtown/Parkwest Community Redevelopment Agency on the south west of NW 1 Place and consistent with Exhibit A on the south east of NW 1 Place, and the Florida East Coast Railway Corridor on the east, Miami, Florida, as described in Exhibit "A", attached and incorporated, with NRD-1 modifying the transect zone regulations that are applicable to the subject parcels except for those parcels of properties south of Northwest 20 Street and east of Northwest 1 Place, as described in Exhibit "B", attached and incorporated; Section 3. The NRD-1, as described in Exhibit "B", attached and incorporated hereto, is approved subject to the conditions specified herein. Section 4. The Miami 21 Code is hereby amended by adding the following: "Appendix J: Neighborhood Revitalization Districts" attached and incorporated hereto. City of Miami Page 2 of 3 File Id. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Miami 21 Code, provisions may be renumbered or relettered and that the word 'ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Section 7. This Ordinance shall become effective thirty-one (31) days after second reading and adoption thereof, pursuant and subject to §163.3184, Florida Statutes.{1} Footnotes: {1} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
