RE: Proposed ordinance amending Sections 2-358 and Sections 53-1 of the Code of
the City of Miami, Florida, as amended ("City Code"), and repealing, in its
entirety, Chapter 53/Article III thereby removing reference to the Coconut Grove
Expo Center from the City Code.
The attached proposed ordinance amends Sections 2-358 and Sections 53-1 of the
Code of the City of Miami, Florida, as amended ("City Code"), and repeals, in its entirety,
Chapter 53/Article III thereby removing reference to the Coconut Grove Expo Center from the
City Code.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
2/ARTICLE IV/DIVISION 7/SECTION 2-358 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED ("CITY CODE"), TITLED
"ADMINISTRATION/DEPARTMENTS/CONFERENCES AND CONVENTIONS AND
PUBLIC FACILITIES DEPARTMENT/ORGANIZATION OF DEPARTMENT," AND
CHAPTER 53/ARTICLE I/SECTION 53-1 OF THE CITY CODE, TITLED "STADIUMS
AND CONVENTIONS CENTERS/IN GENERAL/TICKET SURCHARGE ON PAID
ADMISSIONS TO EVENTS," TO REMOVE REFERENCES TO THE COCONUT
GROVE EXPO CENTER AND UPDATE THE NAME OF THE REAL ESTATE AND
ASSET MANAGEMENT DEPARTMENT; FURTHER REPEALING IN ITS ENTIRETY
CHAPTER 53/ARTICLE III OF THE CITY CODE, TITLED "STADIUMS AND
CONVENTIONS CENTERS/COCONUT GROVE EXPO CENTER"; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in or around 2013, the Coconut Grove Expo Center was demolished and
Regatta Park was built in its place; and
WHEREAS, it is appropriate to repeal any reference to the now extinct Coconut Grove
Expo Center throughout the Code of the City of Miami, Florida, as amended ("City Code");
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 2/Article IV/Division 7 of the City Code is amended in the following
particulars.'

Sec. 2-358. Organization of department.
The functions and duties of the ^nforonnoc ^nrl GGAIABn+innc and P 1hlin f^r+i1i+ioc Real
Estate and Asset Management department are to be carried out by the office of the director of
the department and the following divisions:
(3) Public facilities division: The public facilities division shall have the planning,
development, management, maintenance and supervision of the day-to-day operations
of the city marinas, GraRge BGWI Stadi6irn, and the Miami Marine Stadium ;;Ad the
Greve Expo ('on+or, including the coordination and management of planning,
development, and construction efforts at all city facilities. The division shall have the
duty of planning and management of promotions, negotiations, and bookings of special
events such as concerts, sports, and other exhibitions and competitions, and other
forms of entertainment as appropriate in those public facilities."
Section 3. Chapter 53/Article III of the City Code is amended in the following
particulars.'
"CHAPTER 53
STADIUMS AND CONVENTION CENTERS
ARTICLE I. IN GENERAL
Sec. 53-1. - Ticket surcharge on paid admissions to events.
(a) Applicability.
(1) To certain facilities. A ticket surcharge shall be imposed against all paid admissions to
city -owned facilities, including, without limitation, the Marine Stadium, the GeGeRut
GFeye Expo G^„+^r the Miami Convention Center, and the Bayfront Park
Amphitheater, and on tour boats operating at Miamarina at Bayside. Said surcharge
shall additionally apply where admission is charged for events conducted in city parks,
facilities therein, and/or community centers. However, no ticket surcharge shall be
imposed upon any event held at the Manuel Artime Community Center, regardless of
paid admissions. Unless specifically exempted below, and for the purposes of this
section, "events" shall include activities, programs, concerts, festivals, parties,
meetings and other gatherings for whatever social, entertainment, cultural, sport or
other purpose and for which attendees are expected to pay or make a donation in
order to attend. The application of the ticket surcharge shall commence upon the
effective date of this section, except for those events for which advance ticket sales
have the prior approval of the city manager, or designee.

Section 4. Chapter 53/Article III of the City Code is repealed in its entirety and said
Article is now reserved for future use.'

Section 5. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
