Purpose of Item:
It is respectfully recommended that the Miami City Commission adopt the attached
resolution, by a four-fifths (4/5ths) affirmative vote, ratifying, confirming and approving
the City Manager's emergency finding that it is most advantageous for the City to waive
the competitive sealed bidding procedures, pursuant to section 18-90 of the Code of the
City of Miami, Florida; further approving the retroactive selection of SRT Supply, LLC
("SRT"), for the provision of replacement armor and accessories ("Armor") for the Police
Department ("Police"), for an expenditure amount not to exceed $170,918.24.
Background of Item:
Police was in need of Armor to ensure the safety of its Special Weapons and Tactics
Detail ("SWAT") Officers during high-risk operations. The body armor currently in use by
SWAT has become obsolete. Invitation for Bid 893381 was issued on May 23, 2018. By
the closing date of June 18, 2018, no responses were received. The purchase of Armor
was approved as an emergency by the City Manager pursuant to Section 18-90 of the
City Code.

AFFIRMATIVE VOTE, RATIFYING, CONFIRMING, AND RETROACTIVELY
APPROVING THE CITY MANAGER'S EMERGENCY FINDING, ATTACHED AND
INCORPORATED AS EXHIBIT "A," THAT IT IS MOST ADVANTAGEOUS FOR THE
CITY TO WAIVE THE COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT
TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA; FURTHER
APPROVING THE RETROACTIVE SELECTION OF SRT SUPPLY, LLC, A FLORIDA
LIMITED LIABILITY COMPANY, FOR THE PROVISION OF REPLACEMENT ARMOR
AND ACCESSORIES, FOR A TOTAL EXPENDITURE AMOUNT NOT TO EXCEED
$170,918.24.
WHEREAS, the Miami Police Department ("Police") needed to replace outdated body
armor and accessories (collectively, "Armor") for its Special Weapons and Tactics Detail
("SWAT"), to protect Officers during high-risk operations; and
WHEREAS, Invitation for Bid ("IFB") No. 893381 for the purchase of SWAT armor and
accessories was issued on May 23, 2018, and closed on June 18, 2018; and
WHEREAS, no bids were received in response to IFB No. 893381, resulting in its
cancellation; and
WHEREAS, the armor currently being used by SWAT has become obsolete and can no
longer reliably protect the lives of SWAT Officers; and
WHEREAS, as provided in Section 18-90 of the Code of the City of Miami, Florida, as
amended ("City Code"), Police, as the using agency, provided a full explanation of the
circumstances in this emergency to the Chief Procurement Officer and City Manager, which
emergency, unless immediately addressed, is a serious impediment to safeguarding the lives of
SWAT Officers; and
Whereas, the City Manager approved such emergency finding and has found this
purchase to be justified under Section 18-90 of the City Code; and
WHEREAS, the City Manager, pursuant to Section 18-90 of the City Code, approved an
emergency purchase to procure Armor;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-90 of the City

Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-90 of the City
Code, the City Manager's emergency finding, attached and incorporated as Exhibit "A," is
ratified, confirmed, and retroactively approved, the requirements for competitive sealed bidding
procedures are waived, and the emergency award for the provision of Armor from SRT Supply,
LLC, a Florida limited liability company, for Police, is approved, for a total expenditure amount
not to exceed $170,918.24.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
