The Property consists of six (6) lots; Lots 3, 28, 29, 30, 31, and 32 of the Eden Park Subdivision. Lots 3, 30, 31, and 32 are zoned T5 -L and have a Comprehensive Plan designation of Restricted Commercial (the "76 Property"). Lots 28 and 29 are zoned T4 -R and have a Comprehensive Plan designation of Medium Density Multi -Family Residential (the "75 Property"). This correspondence constitutes the Applicant's Letter of Intent and analysis pursuant to the requirements of Article 7.1.2.8(c) (2) (g) of Miami 21. Specifically, the Applicant is requesting a zoning change of the T6 Property from T5 -L to T6 -8-L and a zoning change of the T5 Property from T4 -R to T5 -L pursuant to the successional zoning requirements of Section 7.1.2.8 of Miami 21 and in compliance with Section 7.1.2.8(c)(1) of Miami 21 for the extension of an existing Transect boundary, and a comprehensive plan change from Medium Density Multi -Family Residential ("MDMR") to Restricted Commercial ("RC") for the T5 Property. T6 PROPERTY INFORMATION According to the enclosed survey prepared by J. Hernandez & Associates, Inc., dated February 7, 2018, the T6 Property is approximately 20,310 square feet or 0.466 acres in net lot area and consists of a multistory commercial structure. The Applicant seeks to develop the T6 Property as a proposed mixed-use structure. The T6 Property abuts a fast food restaurant to the North, a vacant land to the West, and commercial structures to the South and East. Hernandez & Associates, Inc., dated February 7, 2018, the T6 Property is approximately 13,770 square feet or 0.316 acres in net lot area and consists of a multistory commercial structure and vacant land. The Applicant seeks to develop the T5 Property as a proposed mixed use structure in connection with the T6 Property. The T5 Property also abuts a fast food restaurant to the North, a vacant land to the West, and commercial structures to the South and East. ANALYSIS OF REQUEST FOR REZONING Per Miami 21, the current zoning for the T6 Property is T5 -L. The Applicant requests to rezone the T6 Property from T5 -L to T6 -8-L pursuant to the successional zoning requirements of Section 7.1.2.8 of Miami 21. Per Miami 21, the current zoning for the T5 Property is T4 -R. The Applicant requests to rezone the T5 Property from T4 -R to T5 -L pursuant to the successional zoning requirements of Section 7.1.2.8 of Miami 21. Section 7.1.2.8(c)(1) of Miami 21 permits the rezoning of property for the extension of an existing Transect boundary. Please see Image 1 below. The proposed mixed-use structure will be located on both the T6 and T5 Properties, with each portion of the project being constructed within the applicable constraints of the T5 -L and T6 -8-L zoning regulations. For the reasons outlined below, we believe the proposed rezoning is appropriate for the T6 Property and T5 Property and should be approved. An analysis of the T6 Property shows that the existing condition of the surrounding properties supports the rezoning to T6 -8-L The Applicant proposes an eight -story mixed structure with retail and residential uses at the T6 Property. Please note that general commercial and residential uses are currently permitted by right on the T6 Property under the T5 -L regulations. The Applicant proposes a unified site consisting of an eight (8) Story building at the T6 Property fronting NW 7 Avenue and NW 35 Street and a five (5) Story building on the T5 Property with general commercial and residential uses, see Image 2. The proposed T6 -8-L transect designation, would allow a maximum of eight (8) stories by Right. Please see the T5 Property highlighted in Blue and the T6 Property highlighted in yellow in Image 2 below. NW 7th Avenue is classified as a Minor Arterial Roadway per Map TR -2 of the City's Comprehensive Neighborhood Master Plan, attached hereto as Exhibit "A." NW 7th Avenue is a major thoroughfare consisting of mainly commercial and retail uses including accessory surface parking facilities. The T6 Property is less than 100 feet from the intersection of NW 7th Avenue and NW 36 Street (also known as US -27). NW 36th Street is a Major Thoroughfare which connects from Biscayne Bay on the East to the Florida Turnpike on the West. Over its thirteen 3 3516 NW 7 Avenue, Miami, Florida Rezoning Letter of Intent (13) miles, NW 36th Street traverses the entire City of Miami city limit, the City of Virginia Gardens, and Doral (NW 36°i Street becomes NW 41St Street in Doral). This analysis considers the immediate surrounding properties and area including those sites that front onto NW 7 Avenue in the same manner as which the T6 Property. For example, please see the following sites as located within the immediate area of the T6 Property and their current uses: • The property located at 730 NW 36 Street, abutting the T6 Property on the North, consists of a fast food restaurant. • Located to the West of the T6 Property are eight (8) Lots that were rezoned from T5 -L to T6 -8-L in 2016 and to be developed as an eight (8) Story Lodging use. See Image 3 below. • Located South of the T6 Property and abutting NW 7 Avenue, the parcels at 3454, 3440, 3430, and 3414 NW 7 Avenue contain commercial uses that will be enhanced by a mixed-use structure at the T6 Property. See Image 4 below. These structures have undergone remodeling recently and a pedestrian friendly development at the T6 Property will benefit the neighboring properties. S 3516 NW 7 Avenue, Miami, Florida Rezoning Letter of Intent • Directly East of the T6 Property and abutting NW 7 Avenue, the parcels at 3501, 3511, and 3521 NW 7 Avenue contain fast food restaurants and intense industrial uses. These neighboring properties are zoned D2, which permits up to 10 Stories. As depicted above, the T6 Property abuts and is surrounded by commercial, retail, and industrial uses. The proposed rezoning of the T6 Property is consistent with the surrounding context and evolution of the neighborhood. 2. An analysis of the T5 Property shows that the existing condition of the surrounding properties supports the rezoning to T5 -L. The Applicant proposes a five (5) Story mixed use structure at the T5 Property connected to the mixed-use structure at the T6 Property. The proposed T5 -L transect designation, would allow general commercial and residential uses at the T5 Property. • A vacant parcel is located to the South of the T5 Property, at 720 NW 35 Street. The property fronts the same street as the T5 Property. 3516 NW 7 Avenue, Miami, Florida Rezoning Letter of Intent The properties abutting the T5 Property to the West were rezoned from T4 -R to T5 -L in 2016 and are substantially similar to the T5 Property. 6 3516 NW 7 Avenue, Miami, Florida Rezoning Letter of Intent • Also abutting the T5 Property to the South, located at 736 NW 35 Street, is a twelve (12) unit multifamily housing structure. As depicted above, the T5 Property is currently in an area which has become increasingly commercial in nature as the street traffic continues to rise to accommodate the rapid growth of the surrounding areas. Additionally, there is precedent in the area for mixed uses abutting multi- family residences in the area, as this area becomes less suited for residential uses and evolves into a commercial corridor as the gateway to Midtown and the Design District. 3. The zoning change request for the Property is only to the next intensity Transect Zones and maintains the goals of Miami 21. The proposed rezoning to the next intensity Transect Zone is being requested in order to extend the existing Transect boundary. The development of the NW 36 Street corridor has outgrown the current Transect Zone and warrants a higher intensity than that which is currently designated. Abutting the T6 Property's present T5 -L zoning is a D 1 Transect Zone on the West and a D2 Transect Zone on the East, with a T6-8-0 Transect Zone abutting the D2 Transect Zone across Interstate 95. The thirteen (13) story affordable housing complex in the nearby T6-8-0 contains more height than the proposed T6 Property plans along with a multi -story parking facility which abuts a T4 -L Transect Zone and duplex residences. The City's growth and evolution over time have inevitably required changes to this Transect Zone. With the rapid expansion and development of both Midtown and the Design District, NW 36 Street serves as the gateway to both areas. This growth as a gateway to Midtown and the Design District is reflected in the traffic counts (provided by KSS Fuels, via Google Earth) showing that the average annual daily traffic count of 15,900 cars in 2005 increased to an average annual daily traffic count of 22,132 cars in 2012 (the last year for which data is available). This represents a daily traffic count increase of nearly 40% from 2005 through 2012. 7 3516 NW 7 Avenue, Miami, Florida Rezoning Letter of Intent The rapid growth of the surrounding area supports and demands the zoning change to a higher intensity. The area abutting NW 36 Street is no longer suited for strictly residential uses and is better suited for mixed uses to revitalize the area and create jobs. 4. The zoning change request for the T5 Property is only to the next intensity Transect Zone and maintains the goals of Miami 21 The proposed rezoning to the next intensity transect zone is being requested in order to extend the existing Transect Boundary to provide an appropriate intensity and density on the T5 Property. As detailed above, the changes in development patterns in the surrounding NW 36 Street corridor have rendered the T4 -L zoning inadequate for appropriate development. 5. Comprehensive Plan Amendment . The City's Future Land Use Map designates the Property as Medium Density Multi Family Residential ("MDMFR"). The Applicant now proposes and hereby submits the enclosed Application for an amendment to the City's Future Land Use Map of the City's Comprehensive Neighborhood Plan ("Comprehensive Plan") from "MDMFR" to Medium Density Restricted Commercial ("MDRC"). The MDRC designation permits commercial uses including uses that "generally serve the daily retailing and service needs of the public, typically requiring easy access by personal auto, and often located along arterial or collector roadways" including general retail, restaurants, cafes and transitional residential facilities such as hotels and motels. Accordingly, the Applicant's proposed mixed-use structure at the T5 Property is permitted under the MDRC designation of the City's Comprehensive Plan. The abutting properties to the North and the T6 Property are designated Medium Density Restricted Commercial as depicted below. Accordingly, the Comprehensive Plan change to MDCR is consistent with the land use designations in the immediate surrounding areas. 3516 NW 7 Avenue, Miami, Florida Rezoning Letter of Intent The change in the City's Comprehensive Plan from MDMFR to MDRC accomplishes the Objective LU -1.2, which is to promote, facilitate, and catalyze the redevelopment and revitalization of blighted, declining, or threatened commercial areas. The NW 36 Street corridor is lacking in mixed-use developments to accommodate the rapidly growing neighboring area. 6. Conclusion In light of the foregoing, the proposed development of mixed-use structure at the T6 Property, pursuant to the T6-8-0 rezoning Application is appropriate due to the location of the site in a commercial area, is in scale with the surrounding areas, is not contrary to the established land use pattern in the area, and is compatible with the surrounding uses because NW 36 Street is a major Thoroughfare consisting of mainly commercial and retail uses. In light of the foregoing, the proposed mixed-use structure at the T5 Property, pursuant to the rezoning Application to T5 -L and the Comprehensive Plan amendment to MDRC, is appropriate due to the location of the site in a commercial area, is in scale with the surrounding areas, is not contrary to the established land use pattern in the area, and is compatible with the surrounding uses because NW 36 Street is a major thoroughfare consisting of mainly commercial and retail uses. Pursuant to Article 7.1.2.8(c) (2) (g) of Miami 21, attached hereto as Exhibit "B", please find an analysis of the general planning principles and goals and objectives of the City's Comprehensive Plan finding that the proposed Comprehensive Plan Amendment and Rezoning of the Property are in conformity with the Comprehensive Plan, the established land use pattern for the adjacent properties in the area, and in scale with the needs of the neighborhood. Specifically, the attached analysis supports the Applicant's proposed Comprehensive Plan amendment and Rezoning as consistent with Miami 21's intent and the zoning and comprehensive plan designations for the adjoining properties and neighborhood. Enclosed please find the Comprehensive Plan Amendment Application, the Rezoning Application, a check payable to the City for the associated filing fees for the Applications, and a survey of the Property in connection with this submittal. The next step is to respond to the comments provided below by staff which need to be addressed in your formal submittal. The criteria for a Rezone is found in Article 7, Section 7.1.2.8 in the Miami 21 Zoning Code. To be eligible to apply for a successional Rezone the request must satisfy the following requirements: (A) the rezoning must include a land area of at least 40,000 square feet; or (B) the property has at least 200 feet of street Frontage on one street; or (C) the Rezone is an extension of an abutting Transect Zone. PRE -APPLICATION DESCRIPTION: Subject Property: The proposed Comprehensive Plan Amendment and companion Rezone application consist of two parcels of land with an approximate area of 34,080 square feet (0.78 acres). Currently the western portion of the site is designated for "Restricted Commercial" uses and is in the 74-R" (General Urban Zone— Restricted Transect Zone. Request: This application was reviewed for a change of transect designation, from T4 -R and T5 -L to T5 -L and T6 -8-L, respectively. The supporting request for a Comprehensive Plan amendment for the western portion of the site from Medium Density Multifamily Residential uses to Restricted Commercial uses. For both parcels, the requested transect designation would be an extension of an existing boundary which complies with the minimum criteria for a rezone, as listed in Article 7, Section 7.1.2.8 (c). COMMENTS AND ADDITIONAL INFORMATION: In accordance with Article 7, Section 7.1.2.8.f (1) (b), please describe why the existing zoning is inappropriate, in light of the intent of the Miami 21 Code and particularly in relation to the effects on adjoining properties. Applicant response The existing zoning creates staggered height for the Property and its surrounding area. Located directly north is T6 -8-L, which permits 8 Stories and up to 12 through the use of Public Benefits. Across NW 7 Avenue from the Property, the adjoining properties are zoned D2, which permits 8 Stories. Please see the image below for a depiction of the existing condition. EXISTING ZONING AK4 PROJECT LOCATION The existing zoning limits the permitted uses at the site and the proposed zoning will permit a mixed use development that can serve the community along a major corridor (NW 36 St). Further, the City has designated both NW 7 Avenue and NW 36 Street as Transit Corridors, which is reflective of the degree of transit services available. The Guiding Principles of Miami 21 emphasize providing a framework for alternatives to automobile use and allowing independence for those who do not drive. Mixed use buildings should be centered within areas with a high degree of transit options, and the proposed rezoning will bring appropriate uses to the NW 7 Avenue corridor. 2 1 Page PR -18-071 — Eden Subdivision Applicant response: As depicted below, the proposed rezoning will create more appropriate zoning and permitted uses along a Transit Corridor which has been identified by the City of Miami as providing extensive mass transit options. In support of the request for a zoning and land use change provide a conceptual site plan. Applicant Response: See attached conceptual site plan attached. 8. The letter of intent indicates that the change would continue the Goals, Objectives and Policies of the Comprehensive Plan for this area. In support of this, explain the potential impact this request would have on the local housing availability and the local economy. Please refer to the US Census for accuracy. Applicant response: Miami -Dade County saw a 10.8% increase in the number of residents between 2000 and 2010, according to the latest data from the US Census. This growth rate represented an increase of 243,073 people which must be housed. All indications point to further growth of Miami -Dade County through 2018, which will be reflected in the upcoming US Census. The proposed rezoning will permit approximately 50 additional units to be constructed at the Property, increasing the housing availability. Further, the Property's location along two (2) Transit Corridors and nearby Metro Rail will create housing options for those who do not drive or rely on alternative modes of transportation. 9. In support of this request, provide a traffic impact analysis. Applicant response: A Traffic Impact Study will be provided prior to building permit issuance as agreed upon at the 3/23/18 meeting. 10. Please clarify how this request is in line with Florida Statute 163.3177 5 1 Page PR -18-071 — Eden Subdivision Applicant response: Florida Statute 163.3177 provides the requirements for the implementation of a comprehensive plan. The proposed comprehensive plan amendment is consistent with FS 163.3177 as the Property is required to accommodate anticipated growth, meets the availability of water supplies, public facilities, and services, discourages urban sprawl, and creates jobs, capital investment, and economic development that will strengthen the diversify the community's economy. 11. Please address how this request and the potential project discourages the proliferation of urban sprawl. In this response, please refer to: i. The intensity, density, and uses and suitability of such for the proposal. Applicant response: The proposed intensity, density, and uses are indicative of the degree of services available at the Property. The Property is located along two (2) Transit Corridors reflecting the need for more intensity, density, and diversity of uses at the Property. ii. The proposal's ability to adequately protect and conserve natural resources, such as wetlands, floodplains, environmentally sensitive areas, the natural groundwater aquifer recharge areas, and similarly sensitive areas. Applicant response: The Property is not located within a sensitive area. iii. The extent to which the proposal will maximize use of existing public facilities and services. Applicant response: The Property's location along two (2) Transit Corridors reflects the degree of services available of the project. The Property is also located within close proximity to a Fire Station and a City park. iv.
