Gonzalez, Ph.D. City Manager FROM: Daniel Rotenberg Director of Real Esta Asset Management DATE: November 5, 2018 SUBJECT: Approval of finding to waive competitive sealed bidding methods for the presentation of the Ultra Music Festival at Marine Stadium and Virginia Key Beach REFERENCES: ENCLOSURES: On November 15, 2018, the Miami City Commission is being asked to consider the approval of a Revocable License Agreement between the City of Miami ("City") and Event Entertainment Group, Inc. for the presentation of the Ultra Music Festival at the Miami Marine Stadium site and Virginia Key Beach site beginning March 2019. The Department of Real Estate and Asset Management ("DREAM") respectfully requests your recommendation and approval for the action of the Miami City Commission by a 4/5ths affirmative vote, after an advertised public hearing ratifying, approving, and confirming the City Manager's recommendation, and finding that competitive bidding/negotiation methods are not practicable or advantageous to the City, pursuant to Section 18- 85(a) of the Code of the City of Miami; waiving the requirements for said procedures; authorizing the City Manager to enter into a Revocable License Agreement, in substantially the attached form, with the City and Event Entertainment Group, Inc., a Florida for profit corporation, subject to City Commission approval. The Ultra Music Festival ("Ultra") has operated in the City at Bayfront Park since March 2001, and in March 2018, the music festival held its 20th anniversary at Bayfront Park. Commencing in March 2019, Event Entertainment Group, Inc. would like to produce Ultra at Virginia Key, inclusive of the Miami Marine Stadium site as well as the Virginia Key Beach site. Ultra is a local, home-grown event, that is world-renowned, and which generates substantial funds for Miami through hotel room bookings, airline travel, restaurants, car services, cleaning services, other personal services, and City of Miami police and fire services, etc. It is a well- established, unique entertainment event that focuses worldwide attention on Miami. For reasons stated above, as required by Section 18-85(a) of the Code of the City of Miami, DREAM recommends that competitive sealed bidding/negotiation methods are not practicable or advantageous to the City for the aforementioned Ultra Music Festival. If you concur with these recommendations and findings, please acknowledge your approval by executing below, and presenting these written findings to the City Commission for the required 4/5ths vote approval.
