HomeMy WebLinkAboutR-18-0480City of Miami 1 i.RR cl Legislation �a�lldl 1 l + Resolution: R-18-0480 File Number: 4981 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/25/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AND WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 2 COMMISSIONER'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE IN A TOTAL AMOUNT NOT TO EXCEED FIFTY THOUSAND DOLLARS ($50,000.00) TO REBUILDING TOGETHER MIAMI-DADE, INC., A FLORIDA NOT FOR PROFIT CORPORATION, IN SUPPORT OF LOW-INCOME SINGLE-FAMILY REHABILITATION IN THE WEST GROVE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Vice Chair Ken Russell WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, Rebuilding Together Miami -Dade, Inc., a Florida not for profit corporation ("Rebuilding Together'), seeks funding to support low-income, single-family home rehabilitation in the West Grove ("Program"); and WHEREAS, the District 2 Commissioner ("Commissioner') wishes to provide grant funds from the Commissioner's share of the City's API in an amount not to exceed Fifty Thousand Dollars ($50,000.00) ("Funds") for the ("Program"); and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made a written finding, attached and incorporated as Exhibit 'A" that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all documents necessary, in a form acceptable to the City Attorney, for the allocation of Funds for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are City of Miami Page 1 of 2 File ID: 4981 (Revision:) Printed On: 12/20/2018 File ID: 4981 Enactment Number: R-18-0480 adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written finding, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate Funds from the Commissioner's share of the City's API to Rebuilding Together in an amount not to exceed Fifty Thousand Dollars ($50,000.00) for the Program. Section 4. The City Manager is further authorized' to execute any and all documents necessary, in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 "na dez, City Attar iey 10/16/2018 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
