Purpose of the Item: It is respectfully recommended that the Miami City Commission adopt the attached resolution, by a four-fifths (4/5ths) affirmative vote, ratifying, confirming and approving the City Manager's emergency finding that it is most advantageous for the City to waive the competitive sealed bidding procedures, pursuant to section 18-90 of the Code of the City of Miami, Florida; further approving the retroactive selection of Ynigo Landscaping and Lawn Services, Inc. ("Ynigo") and Visualscape, Inc. ("Visualscape") for the provision of tree restoration services, for a total expenditure amount not to exceed $150,000. Background Information: As a result of Hurricane Irma, City of Miami ("City") was impacted by high forced winds, which damaged trees along the right-of-ways. The Planning Department ("Planning") was tasked to assess the landscape damage and concluded that there was a need to restore approximately 419 trees. The damaged trees were reset, braced, pruned, and watered in order to preserve as much tree canopy as possible, and ensure the safety of City residents. The tree restoration services were approved as an emergency purchase under the City Manager's authority. The restoration services were funded through the Tree Trust Fund (P: 15-110136A, A: 2061). WHEREAS, during Hurricane Irma, City of Miami ("City") was impacted by high force winds that damaged approximately four hundred and nineteen (419) trees along the right-of-way and WHEREAS, the damaged trees were reset, braced, pruned, and watered in order to preserve as much tree canopy as possible, and ensure the safety of City residents; and WHEREAS, maintenance of the tree canopy is essential for the wellbeing of the environment, and promotes resiliency and the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan and the Miami 21 Code, the Zoning Ordinance of the City of Miami, Florida, as amended; and WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended ("City Code"), approved an emergency purchase to provide these services; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-90 of the City Code, the City Manager's emergency finding, attached and incorporated as Exhibit "A," is ratified, retroactively approved, the requirements for competitive sealed bidding procedures are waived, and the emergency award for tree restoration services from Ynigo Landscaping and Lawn Services, Inc., a Florida profit corporation, and Visualscape, Inc., a Florida profit corporation, for the Planning Department, is approved, for a total expenditure amount not to exceed $150,000.00. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
