A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO
COLLABORATE WITH THE CITY OF MIAMI BEACH, THE VILLAGE OF KEY BISCAYNE,
AND MIAMI-DADE COUNTY ON VARIOUS METHODS TO ADDRESS WATER QUALITY
ISSUES IN BISCAYNE BAY INCLUDING, BUT NOT LIMITED TO, WATER QUALITY
TESTING, IDENTIFICATION OF CONTAMINANTS, AND IDENTIFICATION OF POTENTIAL
CONTAMINATION SOURCES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE A
MEMORANDUM OF UNDERSTANDING RELATED TO THE SAME, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY AND SUBJECT TO CITY COMMISSION
APPROVAL.

A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO COLLABORATE WITH THE CITY OF MIAMI BEACH, THE VILLAGE
OF KEY BISCAYNE, AND MIAMI-DADE COUNTY ON VARIOUS METHODS TO
ADDRESS WATER QUALITY ISSUES IN BISCAYNE BAY INCLUDING, BUT NOT
LIMITED TO, WATER QUALITY TESTING, IDENTIFICATION OF CONTAMINANTS,
AND IDENTIFICATION OF POTENTIAL CONTAMINATION SOURCES;
AUTHORIZING THE CITY MANAGER TO NEGOTIATE A MEMORANDUM OF
UNDERSTANDING RELATED TO THE SAME, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY AND SUBJECT TO CITY COMMISSION APPROVAL.
WHEREAS, in July 2018, swimming advisories were issued for, inter alia, Crandon
Beach in the Village of Key Biscayne and that portion of the City of Miami Beach from 80th
Street to 81s' Street by the Florida Department of Health ("FDOH") due to high levels of
Enterococci, a type of bacteria that usually inhabits human and animal intestinal tracts; and
WHEREAS, on July 4, 2018 and July 20, 2018, Virginia Key Beach received a swimming
advisory for the same reason; and
WHEREAS, on September 4, 2018, Crandon Beach received another swimming
advisory; and
WHEREAS, on September 11, 2018, FDOH issued swimming advisories for the
beaches at 53rd Street and Ocean Terrace, respectively, in the City of Miami Beach for the same
reason; and
WHEREAS, on September 17, 2018, FDOH lifted the swimming advisories for the
abovementioned locations; and
WHEREAS, the City of Miami ("City"), the Village of Key Biscayne, and the City of Miami
Beach directly abut Biscayne Bay; and
WHEREAS, Enterococci bacteria in Biscayne Bay may lead to adverse health impacts
for residents and visitors to the City; and
WHEREAS, the City wishes to collaborate and work with the Village of Key Biscayne,
the City of Miami Beach, and Miami -Dade County to support water quality testing, identification
of contaminants, and identification of potential contamination sources to improve the water
quality in Biscayne Bay;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is directed to collaborate with the Village of Key Biscayne,
the City of Miami Beach, and Miami -Dade County to support methods of improving the water
quality in Biscayne Bay, including, but not limited to, water quality testing, identifying
contaminants, and identifying potential contamination sources affecting Biscayne Bay.
Section 3. The City Manager is further authorized' to negotiate a Memorandum of
Understanding with the Village of Key Biscayne, the City of Miami Beach, and/or Miami -Dade
County to promote joint efforts to improve the water quality in Biscayne Bay, in a form
acceptable to the City Attorney and subject to City Commission approval.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

'The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
