HomeMy WebLinkAboutR-18-0412City of Miami 1 i.RR cl Legislation alldl 1 l + Resolution: R-18-0412 File Number: 4789 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/27/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY, AS AMENDED ("CODE"), BY A FOUR FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS ATTACHMENT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY"), WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 4 COMMISSIONER'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE ("API"), IN A TOTAL AMOUNT NOT TO EXCEED THREE HUNDRED FORTY SIX THOUSAND EIGHT HUNDRED FORTY DOLLARS ($346,840.00) TO SUNSHINE FOR ALL, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("SUNSHINE FOR ALL"), IN SUPPORT OF SUNSHINE FOR ALL'S MEALS ON WHEELS PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Manolo Reyes WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, Sunshine for All, Inc., a Florida not for profit corporation ("Sunshine for All"), is seeking funding in support of Sunshine for All's Meals on Wheels Program ("Program"); and WHEREAS, the City's District Four Commissioner ("Commissioner') wishes to provide grant funds from the Commissioner's share of the City's API in an amount not to exceed Three Hundred Forty Six Thousand Eight Hundred Forty Dollars ($346,840.00) ("Funds") for the Program; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City, as amended ("Code"), the City Manager has made written findings, attached and incorporated as Attachment "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all documents necessary, in a form acceptable to the City Attorney, for said allocation of Funds for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 4789 (Revision:) Printed On: 12/4/2018 File ID: 4789 Enactment Number: R-18-0412 Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the Code, by a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Attachment "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized to allocate Funds from the Commissioner's share of the City's API to Sunshine for All in an amount not to exceed Three Hundred Forty Six Thousand Eight Hundred Forty Dollars ($346,840.00) for the Program. Section 4. The City Manager is further authorized to execute any and all documents necessary, in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.
