City of Miami File ID: 4403 (Revision:) Printed On: 11/13/2018 File Number: 4403 City of Miami Legislation Ordinance Enactment Number: 13784 Final Action Date: 9/13/2018 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 10/ARTICLE I OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), ENTITLED "BUILDINGS/IN GENERAL," MORE PARTICULARLY BY AMENDING SECTION 10-4 OF THE CITY CODE, ENTITLED "BUILDING PERMIT FEE SCHEDULE," TO PROVIDE TEMPORARY CERTIFICATE OF OCCUPANCY FEES FOR A PHASED PROJECT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 10 of the Code of the City of Miami, Florida, as amended ("City Code"), entitled "Buildings," establishes building permit and certificate of occupancy fees; and WHEREAS, Chapter 10 of the City Code does not address the unique circumstances caused by Phased Projects; and WHEREAS, Phased Projects, as defined in Section 55-1 of the City Code, due to their scale and scope, have practical difficulties which should be addressed by the City Code, including temporary certificate of occupancy ("T.C.O.") fees; and WHEREAS, in order to alleviate said impracticality, Section 10-4 of the City Code should be amended to revise the T.C.O. fees for Phased Projects; and WHEREAS, any T.C.O. obtained for a Phased Project, including extensions of a previously issued T.C.O., shall be issued for the timeframes established herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 10, Article I, Section 10-4 of the City Code is further amended in the following particulars:' "CHAPTER 10 BUILDINGS ARTICLE I. IN GENERAL ' Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. City of Miami File ID: 4403 (Revision:) Printed On: 11/13/2018 Section 10-4 Building Permit Fee Schedule (3) Miscellaneous Permits and Inspections Fees Certificate of occupancy (C.O.) and certificate of compliance (C.C.). In accordance with the requirements of the Florida Building Code. 3. Extensions of T.C.O. or T.C.C.: The T.C.O. or T.C.C. can be extended two times at the same original rate charged for a period of ninety 90) days; if further extensions would be required, they shall be charged at a rate equal to fifty percent J50%) PeFGeRt of the building/trade permit line. For projects qualifying as a Phased Project as defined in Section 55-1 of the City Code, the T.C.O. may be issued as follows: a. T.C.O. may be issued for an initial period of three hundred sixty-five (365) days at the original rate charged; b. T.C.O. may be extended for an additional three hundred sixty-five (365) days at the same original rate charged; c. T.C.O. may be extended a second time for an additional one hundred eighty (180) days at double the original rate charged; and d. T.C.O. may be extended a third and final time for an additional one hundred eighty (180) days at a rate equal to fifty percent (50%) of the building/trade permit line. *„ Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.2 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
