HomeMy WebLinkAboutR-18-0319City of Miami 1 i.RR cl Legislation alldl 1 l + Resolution: R-18-0319 File Number: 4363 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 7/26/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR REIMBURSEMENT GRANT FUNDING TO THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE BEAUTIFICATION GRANT PROGRAM IN THE AMOUNT NOT TO EXCEED SIXTY-NINE THOUSAND FIVE HUNDRED DOLLARS ($69,500.00) ("GRANT") FOR THE BEAUTIFICATION OF A PORTION OF THE CORRIDOR ON UNITED STATES HIGHWAY 1/FLORIDA STATE ROAD 5/SOUTH DIXIE HIGHWAY ("PROJECT"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, NECESSARY FOR THE SUBMISSION OF SAID GRANT APPLICATION AND, IF AWARDED, THE ACCEPTANCE OF SAID GRANT FUNDS, INCLUDING ANY GRANT AGREEMENT(S) AND ANY AND ALL OTHER NECESSARY DOCUMENTS, APPLICATIONS, RENEWALS, EXTENSIONS, AMENDMENTS, AND MODIFICATIONS THERETO REGARDING THE GRANT FOR FISCAL YEAR 2018-2019 AND COMPLIANCE FOR THE PROJECT WITH THE BEAUTIFICATION GRANT PROGRAM. WHEREAS, the City of Miami ("City") wishes to beautify a portion of the corridor on United States Route 1 ("U.S. 1")/Florida State Road 5 ("SR 5")/South Dixie Highway in the City ("Project"); and WHEREAS, the Project consists of xeriscape landscaping, which incorporates both trees/palms and groundcover vegetation which are drought tolerant, shade tolerant, and are site appropriate; and WHEREAS, the City previously approved and executed a Maintenance Memorandum Agreement ("MMOA") with the Florida Department of Transportation ("FDOT") for U.S. 1/SR 5/South Dixie Highway; and WHEREAS, the total estimated cost of this Project is one hundred thirty-eight thousand dollars ($138,000.00); and WHEREAS, pursuant to Section 339.2405, Florida Statutes, and Chapter 14-40, Florida Administrative Code ("F.A.C."), the maximum amount of reimbursement grant funding potentially available to the City from FDOT through its Beautification Grant Program for the Project is sixty- nine thousand five hundred dollars ($69,500.00); and WHEREAS, the City wishes to apply for reimbursement grant funding from the Beautification Grant Program for the Project in the amount not to exceed sixty-nine thousand five hundred dollars ($69,500.00) ("Grant"); and WHEREAS, Grant funds awarded to the City, if any, and City funds required for the completion of the Project are to be allocated and appropriated by separate Resolution(s); City of Miami Page 1 of 2 File ID: 4363 (Revision:) Printed On: 11/5/2018 File ID: 4363 Enactment Number: R-18-0319 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to submit an application for reimbursement grant funding to FDOT for the Beautification Grant Program in the amount not to exceed sixty- nine thousand five hundred dollars ($69,500.00) for the Project. Section 3. The City Manager is further authorized' to negotiate and execute any and all documents, in a form acceptable to the City Attorney, necessary for the submission of said Grant application and, if awarded, the acceptance of said Grant funds, including any Grant agreement(s) and any and all other necessary documents, applications, renewals, extensions, amendments, and modifications thereto, regarding the Grant for Fiscal Year 2018-2019 and compliance for the Project with the Beautification Program in order to implement this Resolution. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS 1 Una ndez, City Attor ley 7/12/2018 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
