Spring Garden Point Park
Project Overview:
This is a construction project to replace the entire failing seawall along the Seybold Canal, and
construct a kayak launch allowing non -motorized vessels only access to the Miami Rivera The
seawall is in danger of falling into the Seybold Canal, with a new seawall to be built in its place.
The kayak launch will be 60' long and 8' wide. Thirty feet from the Miami River shoreline to the
upland will be under water at high tide. The dry upland 30' feet will protect the park from water
intrusion since it will be higher than the riprap shoreline along the Miami River at its end point.
Brief History and Recommendations:
The current park site was scheduled to become 64 condominiums. The Trust for Public Land
purchased the property from the developer to keep the site open space and a wanted it to be a
future park. With the help of the State of Florida, The Trust for Public Land, and Miami Dade
County entered into an agreement to transfer the land to the City of Miami as a public park in
1999.
The City of Miami recommends if this is approved by the HEP Board to add two additional
restrictions.
1. No commercial activities of any kind will be allowed in the park, seawall, or riprap areas.
2. The park hours will remain the same as they are currently.

The U.S. Army Corps of Engineers (Corps) assigned your application for a
Department of the Army permit, which the Corps received on June 15, 2017, the file
number SAJ-2002-01581. A review of the information and drawings provided indicates
that the proposed work would result in the construction of a new 480 square foot kayak
ramp/tremie slab within the footprint of the authorized riprap along the Miami River. 65sf
of the ramp will be waterward of the mean high water line. Re -arrangement of
approximately 192sf of the riprap waterward of the mean high water line to
accommodate the new ramp. Repair of 297 linear feet of vertical bulkhead along the
Seybold Canal by placing sheet pile wall within 18 inches waterward of the existing
bulkhead with a 24" x 27" concrete cap running the length. The project is located along
the Miami River and Seybold Canal, at 601 NW 7th Street Road, Spring Garden Point
Park, legally described as SPRING GARDEN PB 5-38 LOT 18 LESS N2FT OF E140FT
BLK 12, in Section 37, Township 54 South, Range 41 East Miami, Miami -Dade County,
Florida (Folio # 01-3135-027-1330)
Your project, as depicted on the enclosed drawings, is authorized by Nationwide
Permit (NWP) Number 3 and a Nationwide Permit (NWP) Number 36. In addition,
project specific conditions have been enclosed. This verification is valid until March 18,
2022. Furthermore, if you commence or are under contract to commence this activity
before the date that the relevant nationwide permit is modified or revoked, you will have
12 months from the date of the modification or revocation of the NWP to complete the
activity under the present terms and conditions of this nationwide permit. Please
access the U.S. Army Corps of Engineers' (Corps) Jacksonville District's Regulatory
Internet page to access Internet links to view the Final Nationwide Permits, Federal
Register Vol. 82, dated January 06, 2017, specifically pages 1879 — 1881 and 1917 and

Please be aware this Internet address is case sensitive and should be entered as it

"Nationwide Permits." These files contain the description of the Nationwide Permit
authorization, the Nationwide Permit general conditions, and the regional conditions,
which apply specifically to this verification for NWP 3 and Nationwide Permit (NWP)
Number 36. Enclosed is a list of the six General Conditions, which apply to all
Department of the Army authorizations. You must comply with all of the special and
general conditions and any project specific condition of this authorization or you may be
subject to enforcement action. In the event you have not completed construction of
your project within the specified time limit, a separate application or re -verification may
be required.
The following special conditions are included with this verification:
1. Reporting Address: The Permittee shall submit all reports, notifications,
documentation and correspondence required by the conditions of this permit shall be
submitted to the following address:
a. For standard mail: U.S. Army Corps of Engineers, Regulatory Division,
Enforcement Branch, 9900 Southwest 107th Avenue, Suite 203, Miami, Florida
33176.
b. For electronic mail: CESAJ-ComplyDocs@usace.army.mil (not to exceed 10
MB).
The Permittee shall reference this permit number, SAJ-2002-01581 (NW-PMG), on all
submittals.
2. Self -Certification: Within sixty (60) days of completion of the authorized work or
at the expiration of the construction authorization of this permit, whichever occurs first,
the Permittee shall complete the attached "Self -Certification Statement of Compliance"
form (attached) and submit to the Corps. In the event that the completed work deviates,
in any manner, from the authorized work, the Permittee shall describe, on the Self -
Certification Form, the deviations between the work authorized by the permit and the
work as constructed. Please note that the description of any deviations on the Self -
Certification Form does not constitute approval of any deviations by the Corps.
3, Assurance of Navigation and Maintenance: The Permittee understands and
agrees that, if future operations by the United States require the removal, relocation, or
other alteration, of the structures or work herein authorized, or. if in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall
cause unreasonable obstruction to the free navigation of the navigable waters, the
Permittee will be required, upon due notice from the Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to

the United States. No claim shall be made against the United States on account of any
such removal or alteration.
4. Sea turtle and smalltooth sawfish conditions: The Permittee shall comply with
National Marine Fisheries Service's "Sea Turtle and Smalltooth Sawfish Construction
Conditions," dated March 23, 2006, attached to this permit.,
5. Manatee Conditions: The Permittee shall abide by the enclosed standard
construction conditions designed to protect the endangered West Indian manatee,
2011, attached to this permit.
6. Turbidity Barriers:
a. Shall be used throughout construction to control erosion and siltation and
ensure that turbidity levels within the project area do not exceed background
conditions.
b. Shall be made of material in which listed species cannot become
entangled (i.e., reinforced impermeable polycarbonate vinyl fabric [PVC]), and
shall be monitored to ensure listed species are not entangled or trapped in the
project area.
C. Shall be removed promptly when the work is complete and the water
quality in the project area has returned to background conditions.
d. . Shall not block entry to or exit from designated critical habitat.
7. Posting of Permit: The Permittee shall have available and maintain for review a
copy of this permit and approved plans at the construction site.
8. Agency Changes/Approvals: Should any other agency require and/or approve
changes to the work authorized or obligated by this permit,, the Permittee is advised a
re -verification to this permit instrument is required prior to initiation of those changes. It
is the Permittee's responsibility to request a re -verification of this permit from the Miami
Permits Section. The Corps reserves the right to fully evaluate, amend, and approve or
deny the request for re -verification of this permit.
9. Historic Properties:
a. No structure or work shall adversely affect impact or disturb. properties listed in the
National Register of Historic Places (NRNP) or those eligible for inclusion in the NRHP.
b. If during the ground disturbing activities and construction work within the permit
area, there are archaeological/c,ultural materials encountered which were not the
subject of a previous cultural resources assessment survey (and which shall include,
but not he limited to: pottery,, modified shell, flora, fauna, human remains, ceramics,
stone tools or metal implements, dugout canoes, evidence of structures or any other
physical remains that could be associated with Native American cultures or early
ME
colonial or American settlement), the Permittee shall immediately stop all work and
ground -disturbing activities within a 100 -meter diameter of the discovery and notify the
Corps within the same business day (8 hours). The Corps shall then notify the Florida
State Historic Preservation Officer (SHPO) and the appropriate Tribal Historic
Preservation Officer(s) (THPO(s)) to assess the significance of the discovery and devise
appropriate actions.
c. Additional cultural resources assessments may be required of the permit area in
the case of unanticipated discoveries as referenced in aQcordance.with the above
Special Condition; . and if deemed necessary by.the SHPO, THPO(s), orCorps, in
accordance with 36 CFR 800 or 33 CFR 325, Appendix C (5). Based, on the
circumstances of the discovery, equity to all parties, and considerations of the public
interest, the Corps may modify, suspend or revoke the permit in accordance with 33
CFR Part 325.7. Such activity shall not resume on non-federal lands without written
authorization from the SHPO for finds under his or her jurisdiction, and from the Corps.
d. In the unlikely event that unmarked human remains are identified on non-federal
lands, they will be treated in accordance with Section 872.05 Florida Statutes, All work
and ground disturbing activities within a 100 -meter diameter of the unmarked human
remains shall immediately cease and the Permittee shall immediately notify the medical
examiner, Corps, and State Archeologist within the same business day (8 -hours). The
Corps shall then notify the appropriate SHPO and THPO(s). Based, on the
circumstances of the discovery, equity to all parties, and considerations of the public
interest, the Corps may modify, suspend or revoke the permit in accordance with 33
CFR Part 325.7. Such activity shall not resume without written authorization from the
State Archeologist and from the Corps.
10. The project must be completed in accordance with the enclosed construction
drawings (pages 1-8), date-stamped June 15, 2017 by the U.S. Army Corps of
Engineers (Corps), and the general and special conditions which are incorporated in,
and made a part of, the permit.
11. Endangered Species: The permittee agrees to comply with all of the activity
specific Project Design Criteria (PDCs) listed in the National Marine Fisheries Service's
(NMFS) Statewide Programmatic Biological Opinion (SWPBb), dated December 4,
2015. Failure to comply with these conditions could result in enforcement action by the
Corps and/or NMFS.
12. Right Whale Protection: It is illegal to approach within 500 yards of a right whale
by vessel, aircraft, or any other means (50 CFR 224.103 (c). Any vessel finding itself
within 500 yards of a right whale must depart immediately at a slow speed.

13. Species reporting: Any collision(s) with and/or injuries to any sea turtle,
sawfish, whale, or sturgeon occurring during theconstruction of a project, shall be
reported immediately to NMFS's Protected Resources Division (PRD) at (727-824-
5312) or by email to takereport.nmfsser@noaa.gov and CESAJ.-
ComplyDocs@usace.army.mil. Sea turtle and marine mammal stranding/rescue
organizations' contact information is available by region at
http://www.nmfs.noaa.gov/pr/health/networks.htm. Smalltooth sawfish encounters shall
be reported to http://www.fimnh.ufl.edu/fish/sharks/sawfish/sawfishencounters.html.
*Failure to report take of. a federally listed threatened or endangered species may lead
to suspension, revocation, or modification of this authorization. (From Section 3(18) of
the Federal Endangered Species Act: The term 'take' means to harass, harm, pursue,
hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such
conduct.)
14. Marine Life Entrapment: Neither structure nor material or the method of
construction shall pose more than minimal risk of entrapping fish, marine turtles, or
marine mammals. In-water lines must be industrial grade metal or heavy cables that do
not readily loop and tangle. All in-water lines (rope and cable) must be rigid and cannot
have excess line in the water. Lines may be enclosed in a plastic or rubber sleeve/tube
to add rigidity.
15. Noise Effects BMPs: All projects shall comply with the requirements of the
attached "Noise Best Management Practices (BMPs) for Piling Installation" (see
attachment)
16. Educational Signage: The permittee shall install Educational signs in a visible
location on the structure(s) to alert the public of listed species in the area susceptible to
vessel strikes or hook-and-line captures. The most current version of the signs are
available at

17. Monofilament recycling bins: Monofilament recycling bins must be installed
and maintained in accordance with the information provided http://mrrp.myfwc.com.
18.. Manatee Signage: Within 30 days of completion of the dock. installation, the
permittee is required to install signs on the floating structures that will be clearly visible
from the waterway that read "motorized vessel docking prohibited" and "manatee
awareness signs". Signs should be constructed with reflective materials so that they are
also clearly visible at night. Letters must be a minimum of 3 inches in height. The
permittee agrees to replace the signs in the event the signs fade, become damaged or
outdated, and maintain these signs for the life of the facility. The on-site locations and
types of signs must be acceptable to the FWC, which can, be contacted at:

This letter of authorization does not obviate the necessity to obtain any other Federal,
State, or local permits, which may be required. Prior to the initiation of any construction,
projects qualifying for this Nationwide permit must qualify for an exemption under
section 403.813(1), Florida Statutes or 373,406, Florida Statutes, or otherwise be
authorized by the applicable permit required under Part IV of Chapter 373, Florida
Statutes, by the Department of Environmental Protection, a water management district
under section 378.069 Florida Statutes, or a local government with delegated authority
under section 373.441, Florida Statutes, and receive Water Quality Certification and
applicable Coastal Zone Consistency Concurrence or waiver thereto, as well as any
authorizations required for the use of state-owned submerged lands under Chapter 253,
Florida Statutes, and, as applicable, Chapter 258, Florida Statutes. You should check
State -permitting requirements with the Florida Department of Environmental Protection or
the appropriate water management district.
This letter of authorization does not include conditions that would prevent the 'take' of
a state -listed fish or wildlife species. These species are protected under sec. 379.411,
Florida Statutes, and listed under Rule 68A-27, Florida Administrative Code. With
regard to fish and wildlife species designated as species of special concern or
threatened by the State of Florida, you are responsible for coordinating directly with the
Florida Fish and Wildlife Conservation Commission (FWC). You can visit the FWC
license and permitting webpage (http://www. mvfwc.com/license/wild life/) for more
information, including a list of those fish and wildlife species designated as species of
special concern or threatened. The Florida Natural Areas Inventory
(httn://www.fnai.org/ / ) also maintains updated lists,. by county, of documented
occurrences of those species.
This letter of authorization does not give absolute Federal authority to perform the
work as specified on your application. The proposed work may be subject to local
building restrictions mandated by the National Flood Insurance Program. You should
contact your local office that issues building permits to determine if your site is located
in a flood -prone area, and if you must comply with the local building requirements
mandated by the National Flood Insurance Program.

1. The time limit for completing the work authorized ends on March 18, 2022.1
2. You must maintain the activity authorized by this permit in good condition and in
conformance with the terms and conditions of this permit. You are not relieved of this
requirement if you abandon the permitted activity, although you may make a good faith
transfer to a third party in compliance with General Condition 4 below. Should you wish
to cease to maintain the authorized activity or should you desire to abandon it without a
good faith transfer, you must obtain a modification of this permit from this office, which
may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while
accomplishing the activity authorized by this permit, you must immediately notify this
office of what you have found. We will initiate the Federal and state coordination
required to determine if the remains warrant a recovery effort of if the site is eligible for
listing in the National Register of Historic Places.
4. If you sell the property associated with this permit you must obtain the signature of
the new owner in the space provided and forward a copy of the permit to this office to
validate the transfer of this authorization. ,
5. If a conditioned water quality certification has been issued for your project, you must
comply with the conditions specified in the certification as special conditions to this
permit. For your convenience, a copy of the certification is attached if it contains such
conditions.
6. You must allow a representative from this office to inspect the authorized activity at
any time deemed necessary to ensure that it is being or has been accomplished in
accordance with the terms and conditions of your permit.

STANDARD MANATEE CONDITIONS FOR IN -WATER WORK

The permittee shall comply with the following conditions intended to protect manatees from direct project

C. Siltation or turbidity barriers shall be made of material in which manatees cannot become
entangled, shall be properly secured, and shall be regularly monitored to avoid manatee
entanglement orentrapment. Barriers must not impede manatee movement.
d. All on-site project personnel are responsible for observing water -related activities for the presence
ofnnanotee(m). All in -water operations, including voeGe|S' must be shutdown if manatee(s)
comes within 5Ofeet ofthe operation. Activities will not resume until the n08n has moved
beyond the 50 -foot radius of the project operation, or until 30 minutes elapses if the manatee(s)
has not reappeared within 50feet ofthe operation. Animals must not beherded away Orharassed
into leaving.

SEA TURTLE AND SMALLTOOTH SAWFISH CONSTRUCTION CONDITIONS
The permittee shall comply with the following protected species construction conditions:
a, The permittee shall instruct all personnel associated with the project of the potential presence of
these species and the need to avoid collisions with sea turtles and smalltooth sawfish. All
construction personnel are responsible for observing water -related activities for the presence of
these species.
b. The permittee shall advise all construction personnel that there are civil and criminal penalties for
harming, harassing, or killing sea turtles or smalltooth sawfish, which are protected under the
Endangered Species Act of 1973.
c. Siltation barriers shall be made of material in which a sea turtle or smalltooth sawfish cannot
become entangled, be properly secured, and be regularly monitored to avoid protected species
entrapment. Barriers may not block sea turtle or smalltooth sawfish entry to or exit from
designated critical habitat without prior agreement from the National Marine Fisheries Service's
Protected Resources Division, St, Petersburg, Florida.
d, All vessels associated with the construction project shall operate at "no wake/idle" speeds at all
times while in the construction area and while in water depths where the draft of the vessel
provides less than a four -foot clearance from the bottom. All vessels will preferentially follow
deep -water routes (e.g., marked channels) whenever possible.
e. If a sea turtle or smalltooth sawfish is seen within 100 yards of the active daily
construction/dredging operation or vessel movement, all appropriate precautions shall be
implemented to ensure its protection. These precautions shall include cessation of operation of
any moving equipment closer than 50 feet of a sea turtle or smalltooth sawfish. Operation of any
mechanical construction equipment shall cease immediately if a sea turtle or smalltooth sawfish is
seen within a 50 -ft radius of the equipment. Activities may not resume until the protected species
has departed the project area of its own volition.
f. Any collision with and./or injury to a: sea turtle or smalltooth sawfish shall be reported
immediately to the National Marine Fisheries Service's Protected Resources Division (727-824-
5312) and the local authorized sea turtle stranding/rescue organization.
g. Any special construction conditions, required of your specific project, outside these general
conditions, if applicable, will be addressed in the. primary consultation.

Amajority of the Spring Garden Civic Association's board members have voted in favor of the
item before you that consists of the new Seawall and Kayak Launch at Spring Garden Point Park on the
basis that that seawall is in dire need of repairs and because the Class 1 permit application in fields 4, 5
and 6 states the proposed use is only for non -motorized recreational vessels (kayaks) and that the
seawall does not allow commercial use and or boat docking as the permit does not include elements like
davits, fender piles, etc. Thus, the Spring Garden Civic Association supports the item before you aoit
does not allow the future use (docking) of motorized recreational vessels or any type of water taxis at
the new improved seawall.
in the future, the Spring Garden Civic Association will use all Its resources to oppose a permit
request or amending the permit for the commercial use of the seawall or any portions of Spring Garden
Point Park and advocate for the residents ofthe Spring Garden Historic District.

The Trust for Public Land supports the City of Miami's application to the Florida Inland Navigation
District (FIND) for Spring Garden Point Park -Phase 2 -Seawall and Kayak Launch. The Trust for Public
Land is a national not-for-profit conservation organization with a mission of conserving land for people
to enjoy as parks, gardens, and other natural places, ensuring livable communities for generations to
come.
The Trust for Public Land was instrumental in the planning for the Miami River Greenway, a
comprehensive effort to improve public access to the river, serve as an attractive destination for
residents and visitors, help sustain the maritime industry, and improve the river's water quality by
stabilizing the shoreline. Replacing the collapsing sea wall around Spring Garden Point Park by utilizing

River, helping with the issues presented by sea level rise, and improving the water quality of Wagner
Creek and the Miami River.
The Spring Garden Point Park was the first park acquisition on the Miami River Greenway, The site was
slated for development as a 64 -unit condominium complex until The Trust for Public Land acquired the
small parcel. Miami -Dade County and the City of Miami jointly applied for half of the funding from the
Florida Communities Trust program and the remainder came from the 1996 Miami -Dade Safe
Neighborhood Parks Bond referendum, In May, 1999, in the Miami -Dade legislation authorizing the Sale
and Purchase, between The Trust for Public Land, as seller, and the City of.Miami, Miami -Dade County
and The Florida Communities Trust, as buyer, it was specifically stated that: "The site has strong
potential for hammock restoration, greenway connection and canoe/boat launching."
It Was always anticipated that Spring Garden Point Park would remain .. City of Miami park.
Some of the outdoor recreational activities considered to be passive are walking/hiking, nature
observation, and canoeing or kayaking opportunities. These activities require a minimum of facilities
and have a minimal impact on recreational sites. In the case of Spring Garden Point Park a canoe or

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying
memorandum, a copy of which is incorporated herein by reference,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board hereby
authorizes the Option Agreement for Sale and Purchase in substantially the form attached hereto
and made a part hereof, between the Trust for Public Land, as seller, the City of Miami, Miami -
Dade County and Florida Communities Trust, as buyer, of a 1.1 acre parcel of land known as
The Spring Garden Point Park located at the confluence of the Miami River and the Seybold
Canal, to be used as a neighborhood park within theCity of Miami; and authorizes the County
Manager to execute the Option for and on behalf of Miami -Dade County, upon proper
execution of the Option by the Trust for Public Land and the City of Miami; and approval by
the County Attorney's Office, and authorizes the County Manager to exercise any and all other
rights conferred therein.

STAFF RECOMMENDATION
The attached Option Agreement for Sale and Purchase of a 1.1 acre parcel of land, known as the
Spring Garden Point Park (The Point), has been prepared by the Florida Communities Trust, a
non regulatory agency of the Department of Community Affairs (FCT). The Option Agreements
for Sale and Purchase are standard documents which are required by the State when States
funds are used to acquire property .

PURCHASE PRICE:
$550,000.00 (95% of the appraised value)
JUSTIFICATION:
The Spring Garden Point Park (The Point) is a 1.1 acre property located where the Seybold
Canal meets the Miami River in the historic Spring Garden neighborhood. Once the site of
Alligator Joe's Farm and Tropical Gardens, a Henry Flagler attraction, this park will provide
valuable recreational opportunities to some of the most open space deficient areas of Miami -
Dade County, including East Little Havana, Overtown and Spring Garden. The site has strong
potential for hammock restoration, greenway comzection and canoe/boat launching, and was
identified by the Miami River Study Commission in its January 1998 State Legislative Report
as an important acquisition for the restoration of the river. The Point meets all of the definitions
of a neighborhood park as outlined in the Comprehensive Development Master Plan, and will
be a City of Miami park.
The acquisition will be funded from a combination of grants from the Florida Communities
Trust and The Safe Neighborhood Parks Bond Challenge Grant Program. The park will be
owned by the City of Miami, and operated by the Spring Garden Homeowners Association
(SGHOA). Because of the financial difficulties experienced by the City at the time this project
was initiated, the County stepped in to facilitate project funding and contract negotiations for
acquisition. No County funding other than the Challenge Grant will be utilized for this project.
Since the property will be a local park in the City of Miami, it is not eligible for county -wide or
unincorporated area general fund revenues.
The land is part of an estate for which settlement is pending until the sale of this property. The
site had been slated for development as a 64 -unit condominium complex. The Trust for Public
Land (TPL), a national not-for-profit land. conservation organization, recognized the need and
urgency to preserve this important undeveloped site, and entered into a purchase option
agreement with the estate of the property. This option will expire in July, 1999. City of Miami
Resolution #98-389 authorized its City Manager to jointly apply with the County for state
funding and to execute all necessary agreements for the purchase of this property. Upon the
closing with TPL, title to the property will be conveyed to the City of Miami. The City is in the
process of preparing an interagency agreement with the 30 -year old Spring Garden
Homeowners Association for the operation and maintenance of the park. The SGHOA has
maintained this property while it was privately owned for the last ten years. Neither the City nor
the County will incur any impacts to the operating budget. The SGHOA will also be responsible
for the state mandated management plan for the ongoing natural resource restoration and
management of the site
MIAMI RIVER COMMISSION
On April 27, 1999, by Resolution No. R-448-99, the Board instructed staff to request input from
the Miami River Commission regarding all resolutions or ordinances that impact the Miami
River. Attached is a letter from the Miami River Commission supporting the acquisition of "The
Point" for use as a riverfront park.
PRIOR BOARD ACTION:
As directed by Resolution R-344-98, which was sponsored by Commissioner Barbara Carey -
Shuler on March 31, 1998, the Miami -Dade County Park and Recreation Department prepared a
joint Florida Communities Trust (FCT) agreement with the City of Miami for the acquisition of
Spring Garden Point property. In May, 1998, the Citizens Oversight, Committee for the Safe
Neighborhood Parks Bond Program approved a Challenge Grant as a 50%, match to the FCT
funds.
On December 1, 1998, the Board of County Commissioners approved Resolution R-1313-98
authorizing the County Manager to receive and expend a grant in an amount not to exceed
$300,000 from the Florida. Communities Trust (FCT) for the purchase of The Spring Garden
Point Park on the Miami River,
