HomeMy WebLinkAboutO-13747City of Miami Legislation Ordinance: 13747 File Number: 3422 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/22/2018 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO.13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, MORE SPECIFICALLY BY AMENDING ARTICLE 1, SECTION 1.1, ENTITLED "DEFINITIONS OF BUILDING FUNCTION: USES," AND ARTICLE 6, TABLE 13, ENTITLED "SUPPLEMENTAL REGULATIONS"; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Wifredo Gort WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on January 17, 2018, following an advertised public hearing, adopted Resolution No. PZAB-R-18-005 by a vote of eight to zero (8-0), Item No. PZAB.7, recommending approval of the Zoning Text Change as stated herein; and WHEREAS, on October 22, 2009, the City Commission adopted Ordinance 13114, the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and WHEREAS, it has been determined that amending Article 1, entitled "Definitions of Building Function: Uses," and Article 6, entitled "Supplemental Regulations," to clarify regulations related to Auto -Related Commercial uses will improve the effectiveness of the Miami 21 Code's requirements for these establishments; and WHEREAS, this amendment will provide specific regulations regarding which operations within auto sales establishments must take place within confined indoor spaces; and WHEREAS, this amendment will help promote business investment associated with the development of auto sales establishments as clearer regulations will provide investors with direction to appropriately design the construction of new facilities; and WHEREAS, the City Commission has conducted a public hearing on the proposed text amendment; and WHEREAS, the City Commission has considered whether the proposed amendment will further the goals, objectives, and policies of the Miami Comprehensive Plan, the Miami 21 Code, and other City regulations; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. DEFINITIONS 1.1 DEFINITIONS OF BUILDING FUNCTION: USES Enactment Number: 13747 Auto -Related Commercial Establishment: A place of business serving auto -related needs including, but not limited to: car rental, car wash, gas station, mechanic offering minor repairs, retail sales such as auto parts, tire store, +weer car sales. Uses not included: major mechanical work; body work; painting; steam cleaning; welding; outdoor car sales; storage of automobiles not in operating condition; commercial parking Lot or commercial garage; or any work involving undue noise, glare, fumes or smoke, all of which are considered auto -related industrial activities. See Article 6. Section 3. Article 6 of the Miami 21 Code is hereby mended in the following particulars:' "ARTICLE 6. SUPPLEMENTAL REGULATIONS. TABLE 13 T5 — URBAN CENTER ZONE OPEN AUTO RELATED COMMERCIAL Auto Sales: For new Buildinas. the disDlav of vehicles and sales transactions must be located indoors Building disposition, configuration, and all applicable standards must meet the minimum requirements defined in Article 5. T6 — URBAN CORE ZONE Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Building disposition, configuration, and all applicable standards must meet the minimum reauirements defined in Article 5. *„ Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
