Specifically, the Applicant is requesting an amendment to the MCNP's Future Land Use Map ("FLUM") designation for the Subject Property from Medium Density Multifamily Residential ("MDMR") to Medium Density Restricted Commercial ("MDRC") pursuant to the small scale amendment procedures of Florida Statutes, Section 163.3187. This Application seeks to correct the City's FLUM to accurately reflect the Subject Property's land use designation and to ensure consistency with the Subject Property's zoning under Miami 21. I. PROPERTY INFORMATION Under Miami 21, the Subject Property is zoned T5-0 and located within the Coconut Grove Neighborhood Conservation District (NCD -3). The Subject Property is bound by South Dixie Highway ("US -1") on the north, Virginia Street on the east and SW 30 Court on the west. According to the enclosed survey of the Subject Property, prepared by Jorge L. Cabrera, dated June 1, 2016 (the "Survey"), the Subject Property's lot area is approximately 45,155 square feet or 1.03 acres. The Subject Property currently contains a seven (7) story multifamily apartment building. Below is an aerial image depicting the location of the Subject Property and the surrounding area. Letter of Intent for FLUM Amendment 2890 Virginia Street, Miami, Florida ANALYSIS FOR COMPREHENSIVE PLAN AMENDMENT The Subject Property's current FLUM designation is MDMR. The Applicant is requesting an amendment to the Subject Property's FLUM designation to MDRC. For the reasons outlined below, the proposed FLUM amendment is appropriate for the Subject Property and should be approved. 1. The proposed FLUM amendment is consistent with the Subject Property's T5-0 zoning designation and will realize the City's vision for the Subject Property. Pursuant to the MCNP's Correspondence Table (excerpted below), the equivalent FLUM designation for the Subject Property's T5-0 zoning is MDRC. However, the Subject Property's current FLUM designation is MDMR. As explained below, it is evident from the history of the adoption of Miami 21 that the appropriate FLUM designation for the Subject Property is MDRC. To ensure that the MCNP was consistent with Miami 21, the City Commission enacted Ordinance 13115 (the "Ordinance"), which amended the City's MCNP and FLUM to "implement appropriate land development regulations and elements in accordance with the Miami 21 Atlas." For ease of reference, a copy of the Ordinance is attached as Exhibit "A". As part of the adoption of Miami 21, the Subject Property and the adjacent properties located at 3050 South Dixie Highway and 2950 South Dixie Highway were rezoned from R-3 to T5-0 but the FLUM designation for these properties was not properly amended from MDMR to MDRC to reflect the new zoning designation as intended by the City. The transmittal package forwarded by the City to the Florida Department of Community Affairs ("DCA") for review in connection with the approval of the Ordinance clearly reflects the City's desire to establish commercial uses along its commercial corridors, including the US -1 corridor which directly abuts the Subject Property. As depicted below, the presentation prepared by the City's Planning staff and presented to the City Commission as part of the adoption of Miami 21 provides that the R-3 zoning designation under former Zoning Ordinance 11000 would be reclassified to T5 -L / T5-0 under Miami 21 with a corresponding land use designation of MDRC. Additionally, the proposed 2020 FLUM dated January 2009 which was included as part of the transmittal package identifies the area encompassing the Subject Property as MDRC under the FLUM. The package that was transmitted and reviewed by DCA at the time also included several maps which depicted the Subject Property as an area suitable for increased density, intensity and commercial uses. An analysis of the development and use patterns for the vicinity of the Subject Property supports the proposed FLUM amendment. The Subject Property is located on US -1, one of the City's major commercial thoroughfares and a federal highway. The requested FLUM amendment will allow the Subject Property to be developed with the uses permitted by the existing T5-0 zoning designation, including light commercial and lodging uses. The analysis below considers properties in the vicinity of the Subject Property, including those properties that, as the Subject Property, front US -1. • The property located at 2800 SW 28 Terrace (about a block east of the Subject Property) has a FLUM designation of Restricted Commercial and is improved with a 135 unit Hampton Inn Hotel. See Image 1 below. Image 1 • The property located at 2720 South Dixie Highway (also about a block east of the Subject Property) has a FLUM designation of Restricted Commercial and is improved with a commercial shopping center which includes, among others, a gas station, a fast food restaurant, a pet supply store, a dry cleaner and a cellular phone retail store. See Image 2 below. See Image 3 below. Image 33 • The property located at 3100 South Dixie Highway (approximately 350 feet west of the Subject Property) has a FLUM designation of Restricted Commercial and is improved with a multi -story office building. See Image 4 below. Image 4 As depicted above, lodging and commercial uses are prevalent in the area surrounding the Subject Property. As discussed below, the proposed FLUM amendment contemplates a minimal change in the permitted uses at the Subject Property and is consistent with the development and land use patterns of the surrounding area and US -1. 3. The proposed FLUM amendment does not increase the Subject Property's development capacity. The proposed Application will not increase the development capacity of the Subject Property as both the MDMR and MDRC FLUM designations permit the same development capacity. The only difference between the MDMR and MDRC FLUM designations is that the latter permits lodging uses and "commercial activities that generally serve the daily retailing and service needs of the public, typically requiring easy access by personal auto, and often located along arterial or collector roadways." The Subject Property is located, and provides easy access by car, to US -1, a major thoroughfare and commercial corridor. As such, the proposed FLUM amendment is appropriate for the Subject Property. Additionally, the Subject Property is ideally suited for the commercial, lodging and mixed-use development envisioned by the FLUM amendment given its location on US -1 and convenient access to public transit. III. CONCLUSION In light of the foregoing, the Applicant respectfully requests that the Subject Property's FLUM designation be amended to MDRC in accordance with the MCNP's Correspondence Table and the intent of the City Commission. The intent of the Ordinance was to amend the City's FLUM to ensure that it was "in accordance with the Miami 21 Atlas." The City zoned the Subject Property T5-0 under Miami 21 but failed to amend its FLUM designation accordingly. Additionally the Subject Property's location on US -1 near existing commercial and office uses makes the requested FLUM amendment appropriate. Finally, attached as Exhibit "C" please find an analysis of the general planning principles and goals and objectives of the MCNP demonstrating that the proposed FLUM amendment is in conformity with the MCNP.
