LOCATION: Approximately 1005, 1015, and 1025 Spring Garden RD, 1200 NW 10 Ave, and 1000 and 1010 Sunnybrook Rd [Commissioner Keon Hardemon - District 5] APPLICANT(S): Javier Avino, Esq. on behalf of Spring Garden Apartments, LLC PURPOSE: This will close, vacate, abandon and discontinue for public use a portion of a platted easement. FINDING(S): PLANNING DEPARTMENT: Recommended approval, with conditions PLAT & STREET COMMITTEE: Recommended approval by a vote of 6-0 PLANNING, ZONING AND APPEALS BOARD: Recommended approval, with conditions, on November 15, 2017, by a vote of 7-0. File Number: 3401 City of Miami Legislation Resolution Enactment Number: R-18-0035 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date:1/25/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), CLOSING, VACATING, ABANDONING, AND DISCONTINUING FOR PUBLIC USE A PORTION OF A PLATTED EASEMENT LOCATED AT 1005, 1015, AND 1025 SPRING GARDEN ROAD, 1200 NORTHWEST 10 AVENUE, AND 1000 AND 1010 SUNNYBROOK ROAD, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Plat and Street Committee ("PSC') at its meeting on July 20, 2017, reviewed the easement closure application and determined that all technical requirements have been met and by a vote of six to zero (6-0), recommended approval with conditions of the vacation and closure as set forth herein; and WHEREAS, the Department of Public Works and the PSC reviewed the subject vacation and closure as set forth herein and determined that it will not affect pedestrian or vehicular traffic circulation or access for public service; and WHEREAS, the Planning, Zoning, and Appeals Board ("PZAB") at its meeting on November 15, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R- 17-088 by a unanimous vote of seven to zero (7-0), Item No. PZAB. 5, recommending approval with conditions of the vacation and closure as set forth herein; and WHEREAS, the City Commission finds that it is in the best interest of the general welfare of the City of Miami ("City") and its inhabitants to grant the vacation and closure of this portion of a platted easement as set forth herein and deems it advisable to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The portion of the platted easement located at approximately 1005, 1015, and 1025 Spring Garden Road, 1200 Northwest 10 Avenue, and 1000 and 1010 Sunnybrook Road, Miami, Florida, as more particularly described in Exhibit "A," is hereby closed, vacated, abandoned, and discontinued for public use. Section 3. The City Commission approves the closure, vacating, abandoning, and discontinuing for public use a portion of the platted easement with the following conditions: A. The Applicant, owner, or its successor shall comply with the conditions of approval stated for the Application for Vacation and Closure of the platted easement in a letter dated August 17, 2017 issued by the Department of Public Works, attached and incorporated as Exhibit "B." B. The Applicant, owner, or its successor shall comply with all development standards identified in Ordinance No. 13114, as amended, the Zoning Ordinance of the City of Miami, Florida, and all other applicable Local, State, and Federal regulations. Section 4. Approval of the requested vacation and closure shall be valid for a period of four (4) years and shall remain independent of the referenced tentative plat during this period. Section 5. The approved final plat must be recorded within the four (4) year approval period of the requested vacation and closure. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
