WHEREAS, Spring Garden Apartments, LLC ("Applicant") has submitted an application for the vacation and closure of a portion of an easement located along 1005,1015, and 1025 Spring Garden Road, 1200 Northwest 10 Avenue, and 1000 and 1010 Sunnybrook Road, Miami, Florida which is approximately .041 acres (1,797 square feet) of land; and WHEREAS, the proposed easement closure lies within the limits of the approved Spring Garden Apartments Tentative Plat (#1898-A); and WHEREAS, the existing easement is approximately ten (10) feet in width and 179 feet in length and is proposed to be closed along the west side of Northwest 10 Avenue from Sunnybrook Road to Spring Garden Road; and WHEREAS, a portion of the existing ten (10) foot utility easement located to the west of the proposed easement closure will remain open; and WHEREAS, the Department of Public Works and the Plat and Street Committee have reviewed the subject vacation and closure and determined that it will not affect pedestrian or vehicular traffic circulation or access for public service; and WHEREAS, the Plat and Street Committee at its meeting on July 20, 2017, reviewed the easement closure application and determined that all technical requirements have been met and by a vote of six to zero (6 - 0), recommended approval with conditions of the vacation and closure as set forth; and WHEREAS, based on the testimony and evidence presented, after due notice and an opportunity to be heard has been afforded to all parties and members of the public, there is substantial evidence in the record to recommend approval of the closure, vacating, abandoning, and discontinuing for public use a portion of the platted easement; City of Miami Page 9 of 2 File ID: 2.919 (Revision: A) Printed On: 9112112017 NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami Planning, Zoning and Appeals Board ("PZAB") recommends that a portion of the platted easement be closed, vacated, abandoned, and discontinued for public use to the City Commission. Section 3. The PZAB recommends that if the City Commission approves the closure, vacating, abandoning, and discontinuing for public use a portion of the platted easement, the approval should comply with the following conditions: A. The Applicant, owner, or its successor shall comply with the conditions of approval stated for the Application for Vacation and Closure of the platted easement in a letter dated August 17, 2017 issued by the Department of Public Works, attached and incorporated as Exhibit "B". B. The Applicant, owner, or its successor shall comply with all development standards identified in Ordinance No. 13114, as amended, the Zoning Ordinance of the City of Miami, Florida, and all other applicable Local, State, and Federal regulations. C. The approval should be valid for a period of four (4) years. Section 4.
