PURPOSE: This will allow for a Rezoning for the properties located at 70 NE 17 St, 90 NE 17
St. and 1642 NE 1 Ave.

AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION FROM "T6 -24A -O," URBAN CORE
TRANSECT ZONE -A -OPEN, TO "T6 -24B -O," URBAN CORE TRANSECT ZONE -B -OPEN,
FOR THE PROPERTIES LOCATED AT APPROXIMATELY 70 NORTHEAST 17 STREET,
90 NORTHEAST 17 STREET, AND 1642 NORTHEAST 1 AVENUE, MIAMI, FLORIDA, AS
MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING
A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, NR Investments II, LLC ("Applicant") has submitted an application to
change the zoning classification from "T6 -24A -O," Urban Core Transect Zone -A -Open, to 76-
24B -O," Urban Core Transect Zone -B -Open, for the properties located at approximately 70
Northeast 17 Street, 90 Northeast 17 Street, and 1642 Northeast 1 Avenue, Miami, Florida
("Properties"); and
WHEREAS, the Applicant voluntarily proffered a covenant that offers certain
restrictions and covenants, which is attached hereto as Exhibit "B" and incorporated herein by
reference; and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on
October 16, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R-
17-066 by a vote of seven to four (7-4), Item No. PZAB.6, recommending approval with one
(1) condition of the z oning change as stated herein; and
WHEREAS, the proposed zoning change is in harmony with the established land use
pattern and the adjacent and nearby districts; and
WHEREAS, the proposed zoning change will not increase the density permitted at the
Properties; and
WHEREAS, the proposed zoning change is not out of scale with the needs of the
neighborhood and the City of Miami ("City"); and
WHEREAS, the proposed zoning change will increase the intensity of allowed uses;
and
WHEREAS, the proposed zoning change will maintain the same or similar population
density pattern and thereby does not increase or overtax the load on public facilities such as
schools, utilities, and streets; and
WHEREAS, the proposed zoning change and development is in keeping with the
goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan; and
WHEREAS, the PZAB, after careful consideration of this matter, determined that it was
in the best interest of the general welfare of the City and its inhabitants to recommend that this

proposed zoning change as hereinafter set forth be approved contingent upon there being a
minimum of five percent (5%) of workforce housing attached to the project by the Applicant
which may be accomplished by a Covenant or similar instrument proffered by the Applicant to
the City Commission and subject to approval by the City Commission, and by the City
Attorney as to legal form and correctness;
NOW, THEREFORE, BE IT ORDAINED BY COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Zoning Atlas of Ordinance No. 13114, as amended, is further
amended by changing the zoning classification from "T6 -24A -O," Urban Core Transect Zone -
A -Open, to 76-2413-0," Urban Core Transect Zone -B -Open, for approximately .56 acres
(24,700 square feet) of the Properties, as more particularly described in Exhibit "A".
Section 3. The City Commission accepts the Applicant's voluntarily proffered
covenant, attached and incorporated herein as Exhibit "B."
Section 4. This Ordinance shall become effective ten (10) days after approval at
second reading.'

' This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
