AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE ZONING
ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE
ZONING CLASSIFICATION FROM "T6 -24A -O," URBAN CORE TRANSECT
ZONE — A — OPEN, TO 76-2413-0," URBAN CORE TRANSECT ZONE - B —
OPEN, FOR APPROXIMATELY .56 ACRES (24,700 SQUARE FEET) OF REAL
PROPERTIES LOCATED AT APPROXIMATELY 1441, 1445, AND 1455 NORTH
MIAMI AVENUE, 1412, 1418, 1428, AND 1432 NORTHEAST MIAMI COURT,
AND 25 AND 31 NORTHEAST 14 STREET, MIAMI, FLORIDA, AS MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, 14th Street Development, LLC ("Applicant") has submitted an application
to change the zoning classification from "T6 -24A -O," Urban Core Transect Zone — A — Open,
to 76-2413-0," Urban Core Transect Zone — B — Open, for the properties located at
approximately 1441, 1445, and 1455 North Miami Avenue, 1412, 1418, 1428, and 1432
Northeast Miami Court, and 25 and 31 Northeast 14 Street, Miami, Florida ("Properties"); and
WHEREAS, the Applicant voluntarily proffered a covenant that offers certain
restrictions and covenants, which is attached hereto as Exhibit "B" and incorporated herein by
reference; and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on
October 16, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R-
17-065 by a vote of seven to four (7-4), Item No. PZAB.5, recommending approval of the
proposed zoning change with the condition that a minimum five percent (5%) of workforce
housing be attached by the Applicant as detailed in the covenant; and
WHEREAS, the proposed zoning change is in harmony with the established land use
pattern and the adjacent and nearby districts; and
WHEREAS, the proposed zoning change will not increase the density permitted at the
Properties; and
WHEREAS, the proposed zoning change is not out of scale with the needs of the
neighborhood and the City of Miami ("City"); and
WHEREAS, the proposed zoning change will create an area of 76-2413-0," Urban
Core Transect Zone — B — Open, where "T6 -24A -O," Urban Core Transect Zone — A — Open,
currently exists cohesively with neighboring properties to the north, east, and west; and
WHEREAS, the proposed zoning change will maintain the same or similar population
density patterns and thereby does not increase or overtax the load on public facilities such as
schools, utilities, and streets; and

WHEREAS, the proposed zoning change and development is in keeping with the
goals, objectives, and policies of the City's Comprehensive Neighborhood Plan; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare of the City and its inhabitants to
approve this proposed zoning change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Zoning Atlas of Ordinance No. 13114, as amended, should be further
amended by changing the zoning classification from "T6 -24A -O," Urban Core Transect Zone —
A — Open, to 76-2413-0," Urban Core Transect Zone — B — Open, for the Properties.
Section 3. The covenant as voluntarily proffered by the Applicant is accepted by the
City Commission.
Section 4. This Ordinance shall become effective ten (10) days after approval at
second reading.'

This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
