City of Miami City Hall Jr 3500 Pan American Drive �FFI �i++�F PZAB Resolution Miami, FL 33133 .` www.miamigov.com + rx.4►� Enactment Number: PZAB-R-17-059 File ID: 2756 Final Action Date: 10/412017 A RESOLUTION OF THE MIAMI PLANNING, ZONING, AND APPEALS BOARD, WITH ATTACHMENTS, RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM T3 -R, "SUB -URBAN TRANSECT - RESTRICTED", TO CS, "CIVIC SPACE ZONE", FOR THE PROPERTY LOCATED AT 1301 SW 21 AVENUE MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, property located at 1301 SW 21 Avenue, Miami, Florida is currently located in a T3 -R Transect Zone, "Sub -Urban Transect - Restricted"; and WHEREAS, the applicant has submitted a request to change the zoning classification to CS, "Civic Space Zone", to provide more parkland in the City of Miami ("City"); and WHEREAS, the site is 0.19 ± acres in size and would provide a Passive Mini Park to the community, creating green space to improve quality of life and general health and overall ecology of the surrounding environment of the Shenandoah North neighborhood; and WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB") has considered the recommendations of the Planning Director; and WHEREAS, PZAB has considered the goals, objectives, and policies of the Miami Comprehensive Plan, the Miami 21 Code, and all other City regulations; and WHEREAS, PZAB has considered the need and justification for the proposed change, including changing and changed conditions that make the ,passage of the proposed change necessary; and WHEREAS, PZAB, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants to recommend approval of this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 7 of 2 File ID: 2756 (Revision: A) Printed On: 10/6/2017 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The PZAB recommends that the City Commission amend the Zoning Atlas of Ordinance No. 13114, as amended, by changing the zoning classification from T3 -R, "Sub- Urban Transect Zone - Restricted", to CS, "Civic Space Zone", of 0.19 ± acres (8,434 square feet) of real property located at 1301 SW 21 Avenue, Miami, Florida, as more particularly described in "Exhibit A", attached and incorporated. Section 3. This Resolution shall become effective upon adoption by the PZAB.
