AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED,
BY CHANGING THE ZONING CLASSIFICATION FROM 73-0," SUB -URBAN
TRANSECT ZONE -OPEN, TO 74-R," GENERAL URBAN TRANSECT ZONE -
RESTRICTED, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 2222
AND 2260 NORTHWEST NORTH RIVER DRIVE, MIAMI, FLORIDA, AS MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on October
4, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R-17-058 by a
vote of seven to zero (7-0), recommending approval of the zoning change as stated herein; and
WHEREAS, the properties located at approximately 2222 and 2260 Northwest North
River Drive, Miami, Florida ("Properties") are currently zoned 73-0," Sub -Urban Transect Zone -
Restricted; and
WHEREAS, the Properties are located within the Middle River as defined in the Miami
River Corridor Urban Infill Plan and Miami River Greenways Action Plan; and
WHEREAS, the applicant has submitted a request to change the zoning classification to
74-R," General Urban Transect Zone -Restricted; and
WHEREAS, the proposed zoning change will not disrupt the established character of the
multi -family neighborhood; and
WHEREAS, the proposed zoning change will result in an increase in residential density
from 18 units per acre to 36 units per acre and allow multifamily housing by Right; and
WHEREAS, the size and scale of the adjacent uses and structures within the existing
neighborhood support this proposed increase in density and intensity; and
WHEREAS, the proposed zoning change is appropriate in light of the intent of Ordinance
No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"),
particularly in relation to the effects on adjoining properties; and
WHEREAS, the City Commission has considered the recommendations of the Planning
Director and the PZAB and the evidence presented; and
WHEREAS, the City Commission has considered the goals, objectives, and policies of
the Miami Comprehensive Plan, the Miami 21 Code, and all other City of Miami regulations; and

WHEREAS, the City Commission has considered the need and justification for the
proposed zoning change including changing and changed conditions that make the passage of
the proposed zoning change necessary;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in his Section.
Section 2. The City Commission amends the Zoning Atlas of Ordinance No. 13114, as
amended, by changing the zoning classification from 73-0," Sub -Urban Transect Zone -Open,
to 74-R," General Urban Transect Zone -Restricted, for the Properties, as more particularly
described in Exhibit" A," attached and incorporated.
Section 3. The applicant has voluntarily proffered a covenant, attached and
incorporated as Exhibit "B", which is accepted by the City Commission.
Section 4. This Ordinance shall become effective thirty-one (31) days after second
reading and adoption thereof, pursuant and subject to Section 163.3187(5)(c), Florida Statutes.'

' This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
