HomeMy WebLinkAboutR-17-0498City of Miami Legislation Resolution R-17-0498 File Number: 3070 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/26/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY"), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE MAYOR'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE IN A TOTAL AMOUNT NOT TO EXCEED $10,000.00 TO JESUS CHRIST ARCH ANGELS LIBERTY SQUARE INC., A FLORIDA NOT FOR PROFIT CORPORATION, FOR THE AFTER-SCHOOL SNACK PROGRAM; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, Jesus Christ Arch Angels Liberty Square Inc., a Florida not for profit corporation ("Jesus Christ Arch Angels"), provides a variety of individual and team sports services to complement cultural, educational, and tutorial classes for residents; and WHEREAS, the Mayor wishes to grant funds from the Mayor's share of the City of Miami's ("City") Anti -Poverty Initiative in an amount not to exceed $10,000.00 ("Funds") to the Jesus Christ Arch Angels specifically for its After -School Snack program ("Program") offered concurrently with the above referenced services; and WHEREAS, the City Manager has made a written finding, attached and incorporated as Attachment "A," pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), that competitive bidding is not practicable or advantageous for the City; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute an agreement, in a form acceptable to the City Attorney, for the allocation of Funds for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, attached and incorporated as Attachment "A," that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to City of Miami Page 1 of 2 File ID: 3070 (Revision:) Printed On: 2/8/2018 File ID: 3070 Enactment Number: R-17-0498 Section 18-85(a) of the City Code and waiving the requirements for said procedures, is ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate Funds from the Mayor's share of the City's Anti -Poverty Initiative to the Jesus Christ Arch Angels in an amount not to exceed $10,000.00 for the Program. Section 4. The City Manager is authorized' to execute any and all necessary documents, in a form acceptable to the City Attorney, for said purposes. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 i ria i "ndez, City Attor ey 10/1612017 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
