A. GENERAL INFORMATION:
REQUEST: Pursuant to Article 7, Section 7.1.2.8 of Ordinance 13114, as amended, the applicant is
requesting a change of zoning for three (3) properties by changing the classification from T4 -R
"General Urban Transect Zone -Restricted" to CS "Civic Space Zone".
SUBJECT PROPERTIES: The subject properties are located within the Upper Eastside NET area,
and is comprised of three (3) abutting properties located on the south side of Northeast 61 Street
within the block bounded by Northeast 5 Avenue on the east, Northeast 4 Court on the west and
Northeast 60 Street to the south.
These properties exist within the Palm Grove Historic District, designated by the Historic and
Environmental Preservation Board by Resolution HEPB-2009-12. The properties addressed as 460
and 480 NE 61 Street are vacant properties; 490 NE 61 Street has an improvement which is not
listed in the resolution as a contributing structure to the historic district.

proposes to change the Future Land Use Map (FLUM) designation from "Medium Density Multifamily
Residential" to "Public Parks and Recreation" of these parcels in the Miami Comprehensive

B. BACKGROUND:
The current request is to rezone a City -owned properties, acquired by the City of Miami with
approximately 18,000 square feet. Under Zoning Ordinance 11000 the subject properties were zoned
R-3 "Multifamily Medium -Density Residential" and subsequently, on April 2010, upon adoption of
Miami 21 Code, the subject properties were rezoned to T4 -R (General Urban Transect Zone -
Restricted).

C. ANALYSIS
The application for the proposed rezoning complies with the technical requirements of Miami 21
Code in regard to successional zoning, area, and frontage length on one street.
Criteria For rezoning: A change may be made only to the next intensity Transect Zone
or by a Special Area Plan, and in a manner which maintains the goals of the
Miami 21 Code to preserve Neighborhoods and to provide transitions in
intensity and building heights.
Analysis The subject site has an existing zoning of T4 -R which corresponds to prior
of 11,000 zoning ordinance category R-3 and has never been changes to reflect
Criteria existing use on site.

The proposed rezoning is appropriate as it relates to the immediately abutting
properties, which are zoned CS "Civic Space", part of an existing city -owned
park (Eaton Park), and will allow for opportunities to enhance the design and
functionality of Eaton Park.
Finding The request is consistent with the goals and objectives of Criteria 1.

2 or by a Special Area Plan, and in a manner which maintains the goals of the
Miami 21 Code to preserve Neighborhoods and to provide proper transitions
in intensity and scale.
Analysis The proposed rezoning is appropriate as it relates to the immediately abutting
of properties, which are zoned CS "Civic Space",and will provide for future open
Criteria space opportunities for the established neighborhood and an amenity for its
2 residents.
The additional park space will be added to the parks and open space existing
inventory capacity of park land for the City residents to access.
Finding The request creates a transition in intensity and scale, which demonstrates a
consistency with the goals of the Miami 21 Code.
D. CONCLUSION
The proposed change of zoning from T4 -R (General Urban Transect Zone -Restricted) to CS (Civic
Space/Parks) provides the proper transitions and protections to the adjacent properties. In addition,
the designation of CS (Civic Space/ Parks) Transect Zone will add additional park land capacity to
the existing Park LOS.

Staff finds the change of zoning request for this site to be consistent with the goals of the Miami 21 Code
as it will be compatible with the surrounding zoning districts as well as for the enhancement of Eaton
Park. This rezone will result in a positive impact for the City of Miami in general.
E. RECOMMENDATION:
Pursuant to Article 7, Section 7.1.2.8 of Ordinance 13114, as amended on the aforementioned,
the Department of Planning and Zoning recommends to approval for the change of zoning designation
from T4 -R "General Urban Transect Zone -Restricted" to CS "Civic Space Zone" for the properties located
at 460, 480, and 490 Northeast 61 Street, Miami, FL 33130.
