HomeMy WebLinkAboutR-18-0239City of Miami 1 i.RR cl Legislation alldl 1 l + Resolution: R-18-0239 File Number: 4071 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 6/14/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") FUNDS IN THE AMOUNT OF $203,473.00 FROM THE SMALL MULTIFAMILY EMERGENCY REHABILITATION LOAN PROGRAM TO THE PARKS AND RECREATION DEPARTMENT FOR PARK IMPROVEMENT ACTIVITIES AT JOSE MARTI AND RIVERSIDE PARKS, AS FURTHER SPECIFIED IN ATTACHMENT "A", ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS INCLUDING AMENDMENTS, RENEWALS, EXTENSIONS, AND MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR THE COMPLETION OF SAID PARK IMPROVEMENT ACTIVITIES, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS. WHEREAS, pursuant to Resolution No. 17-0514 adopted on November 16, 2017, the Miami City Commission ("City Commission") approved funding in the amount of $415,578.10 for the Small Multifamily Emergency Rehabilitation Loan Program ("Program"); and WHEREAS, pursuant to Resolution No. 18-0215 adopted on May 24, 2018, the City Commission approved the transfer of $733,118.00 to the Department of Parks and Recreation for park improvement activities ("Improvements") at Jose Marti and Riverside Parks ("Parks"); and WHEREAS, due to unforeseen complications related to the Program, there are additional unspent funds available for use; and WHEREAS, these Program funds must be spent prior to July 31, 2018, to help the City of Miami ("City") achieve the Community Development Block Grant ("CDBG") funds' timeliness test by August 1, 2018; and WHEREAS, the Parks continue to be in need of funding to complete the Improvements; and WHEREAS, the City Administration recommends the transfer of CDBG funds in the amount of $203,473.00 from the Program to the Department of Parks and Recreation ("Department") for the Improvements at the Parks, as further specified in Attachment "A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The transfer of $203,473.00 in CDBG funds from the Program to Department for the Improvements the Parks, as further specified in Attachment "A", attached and incorporated, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all documents including amendments, renewals, extensions, and modifications, all in a form acceptable to the City Attorney, as may be necessary for the completion of said Improvements, subject to all federal, state, and local laws that regulate the use of such funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS 1 i ria i "ndez, Gity Attor ey 6/1/2018 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
