Subject: Authorize Procurement - Recyclable Materials Processing Services
Purpose of Item:
The nature of this item is to establish a resolution of the Miami City Commission, with
attachments, authorizing the procurement of recyclable materials processing services
from Progressive Waste Solutions of FL, Inc. ("Progressive"), for the Department of
Solid Waste ("Solid Waste"), pursuant to Section 18-111 of the Code of the City of
Miami, Florida as amended, utilizing the competitively solicited and existing City of
Hialeah, FL ("Hialeah") Contract No. 2013/14-9500-00-011 through September 29,
2019, subject to any extensions and/or replacement contracts by Hialeah; authorizing
the City Manager to execute the Supplemental Agreement in substantially the attached
form.
Background of Item:
The City is seeking to establish an agreement for the processing of the recyclable
materials the City collects. Accessing the Hialeah Contract #2013/14-9500-00-011, will
allow the City to enter into a revenue agreement with Progressive that will pay a rebate
for the approved recyclables it processes. The rebate per ton processed will be
calculated as follows:
• Progressive will calculate the average market value ("AMV") of the recycled
materials delivered by the City each month, based upon material values provided by
Recyclingmarkets.net, which serves as a commodity pricing index for post -consumer
recovered materials.
• A $50.00 Fee to Progressive, will be subtracted from the AMV for each ton
processed.
• Progressive will pay the City a rebate of 35.5% of the remaining amount (AMV
minus the $50.00 Fee).
• During any month in which the AMV is less than the $50.00 Fee retained by
Progressive, the City will not be required to pay any funds to Progressive.
March, 2017's AMV for the City was $80.72 per ton, resulting in a rebate of $10.90 per
ton. This amount may vary, based upon fluctuating commodity values and periodic
composition audits.
This contract is effective through September 29, 2019, with the option to renew for five
(5) additional one (1) year periods after that date. The estimated annual revenue
generated through this contract is $119,900, based upon a projected volume of 11,000
tons.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE PROCUREMENT OF RECYCLABLE MATERIALS PROCESSING
SERVICES FROM PROGRESSIVE WASTE SOLUTIONS OF FL, INC., FOR THE
DEPARTMENT OF SOLID WASTE ("SOLID WASTE"), PURSUANT TO SECTION 18-
111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, UTILIZING
THE COMPETITIVELY SOLICITED AND EXISTING CITY OF HIALEAH, FLORIDA
CONTRACT NO. 2013/14-9500-00-011 EFFECTIVE THROUGH SEPTEMBER 29,
2019, SUBJECT TO ANY RENEWALS, EXTENSIONS, AND/OR REPLACEMENT
CONTRACTS BY THE CITY OF HIALEAH, FLORIDA; AUTHORIZING THE CITY
MANAGER TO EXECUTE THE SUPPLEMENTAL AGREEMENT, IN SUBSTANTIALLY
THE ATTACHED FORM; FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND MODIFICATIONS TO THE SUPPLEMENTAL
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE
NECESSARY FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") is seeking to establish a contract for the processing
of recyclable materials; and
WHEREAS, the accessing of the City of Hialeah's Contract #2013/14-9500-00-011 for
Recyclable Materials Processing Services will enable the Department of Solid Waste ("Solid
Waste") to enter into an agreement that will pay Solid Waste a rebate for the acceptable
recyclable materials it delivers for processing; and
WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer determined that said City of Hialeah
contract was entered into pursuant to a competitive process in compliance with the City's laws,
policies, and procedures;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The procurement of recyclable materials processing services from Progressive
Waste Solutions of FL, Inc., pursuant to Section 18-111 of the City Code, utilizing the
competitively solicited and existing City of Hialeah, Florida Contract No. 2013/14-9500-00-011
effective through September 29, 2019, subject to any renewals, extensions, and/or replacement
contracts by the City of Hialeah, Florida, is approved.
Section 3. The City Manager is authorized' to execute the Supplemental Agreement, in
substantially the attached form.
Section 4. The City Manager is further authorized' to negotiate and execute any and all
amendments, renewals, and modifications to the Supplemental Agreement, in a form
acceptable to the City Attorney, as may be necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
