A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO WORK WITH FLORIDA POWER & LIGHT ("FPL") TO ESTABLISH
A POLICY PRIORITIZING AFFORDABLE SENIOR HOUSING, NURSING
HOMES, ASSISTED LIVING FACILITIES ("ALFS") CATERING TO THE
ELDERLY, AND OTHER SIMILARLY SITUATED CITY OF MIAMI SUBSIDIZED
ELDERLY LIVING UNITS, AS DEFINED BY DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT ("HUD") GUIDELINES, BY DESIGNATING THEM AS
CRITICAL FACILITIES IN THE POWER RESTORATION EFFORTS FOLLOWING
HURRICANES AND MAJOR STORMS; FURTHER DIRECTING THE CITY
MANAGER TO REPORT BACK TO THE CITY COMMISSION WITHIN THIRTY
(30) DAYS.

WHEREAS, the City of Miami ("City") has a vibrant and sizeable population of elderly
residents; and
WHEREAS, the City is committed to providing a high quality of life for all its residents;
and
WHEREAS, hurricanes and major storms are frequent occurrences in the City and the
South Florida area, often resulting in widespread power outages that may take weeks to restore;
and
WHEREAS, the prolonged power outages following Hurricane Irma resulted in the death
of eight (8) elderly persons in a Hollywood nursing home; and
WHEREAS, residents who occupy our senior affordable housing, nursing homes,
Assisted Living Facilities ("ALFS") catering to the elderly, and other City subsidized elderly living
facilities are more susceptible to heat strokes and other heat related complications; and
WHEREAS, Florida Power & Light Company's ("FPL") current policy prioritizes restoring
power to critical facilities such as hospitals, police and fire stations, communication facilities,
water treatment plants, and transportation providers; and
WHEREAS, in light of possible failing medical conditions as a result of prolonged power
outages in senior affordable housing, nursing homes, ALFs catering to the elderly, and other
City subsidized elderly living facilities, the City Commission directs the City Manager to work
with FPL to prioritize all such similarly situated housing units by designating them as critical
facilities in FPL restoration efforts in order to minimize the possibility of ailments or death
caused by prolonged power outages;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated and incorporated as if fully set forth in this Section.
Section 2. This City Commission directs the City Manager to work with FPL to establish
a policy prioritizing affordable senior housing, nursing homes, ALFs catering to the elderly, and
other subsidized living units as defined by Department of Housing and Urban Development
guidelines by designating them as critical facilities in the power restoration efforts following
hurricanes and major storms and further directs the City Manager to report back to the City
Commission within thirty (30) days.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
