GENERAL INFORMATION: REQUEST: Pursuant to Article 7, Section 7.1.2.8 of Ordinance 13114, as amended, the applicant is requesting a change of zoning for the southern portion of a parcel zoned T4- 0 "General Urban -Open" to T5-0 "Urban Center - Open". The subject property is part of the Percival Plat formally known as the Cocoanut Grove and is located within the Coconut Grove NET area and the Village West Island & Charles Ave Neighborhood Conservation District (NCD -2). The parcel is zoned T4-0 and T6-8-0 and has an approximate lot area of 2.10 acres of which only 0.63 acres is the subject of the rezoning. The parcel is located on the northwest corner of Day Avenue and SW 37 Avenue. (Complete legal description is on file with the Hearing Boards Section). B. BACKGROUND: The subject site consists of a single -story, 25,488 sq. ft. masonry office building constructed in 1967. The building currently houses Miami -Dade County Social and Child Development Services. The applicant is currently seeking a change of zoning for a portion of the lot zoned T4-0 to T5-0 and has voluntarily proffered a declaration of restrictive covenant, attached hereto as Exhibit A entitled "Covenant" restricting the development to a set of plans attached hereto as Exhibit B entitled "Platform 3750". The Applicant is seeking a change of zoning in order to construct an eight (8) story, 295,814 sq. ft. mixed -used building with 403 parking spaces and 192 dwelling units, of which 20 -percent of the units will be dedicated towards workforce housing as stipulated in the covenant. On November 16, 2016, the Urban Development Review Committee (UDRB) recommended approval with conditions to the Planning and Zoning Director for the applicants plans entitled "Platform 3750" pursuant to UDRB resolution, attached hereto as Exhibit C. The recommendation of approval is contingent upon the successful rezoning of this request. File ID: 1300 Page 1 of 6 C. COMPREHENSIVE PLAN: The requested zoning designation of T5-0 is inconsistent with the current Miami Comprehensive Neighborhood Plan (MCNP) designation of Low Density Restricted Commercial. As such, the applicant has submitted an application to amend the land use designation from "Low Density Restricted Commercial" to "Medium Density Restricted Commercial", as a companion item under File No. 1299. D. ANALYSIS: The following is a review of the request pursuant to a rezoning criteria at Article 7, Section 7.1.2.8 (a)(3) & (f)(2) of Miami 21. The Background section of this report is hereby incorporated into the analysis and its corresponding criteria by reference: Criteria: For rezoning's: A change may be made only to the next intensity Transect Zone or by a Special Area Pian, and in a manner which maintains the goals of the Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity and building heights. Analysis: The subject site is a legally platted parcel located within the Percival Subdivision and lies within the norther edge of the Village West Island and Charles Ave Neighborhood Conservation District (NCD -2 Overlay). Staff finds the proposed zoning request is consistent with the goals of the Miami 21 Code and the (NCD - 2 Overlay) as the request is compatible with the surrounding zoning districts and provides a transition in height and intensity. Staff notes that the site is comprised of two zoning designations, of which 1.47 acres is zoned T6-8-0 and .63 acres is zoned T4-0. The parcels to the west are zoned T6-8-0, T5-0 and T4-0. The northern portion of the lot fronts a major commercial arterial thoroughfare known as (US -1 1 South Dixie Hwy). In addition, staff notes that the parcel is approximately within 265 -feet of the Douglas Road Metrorail Station, a major north south transit hub surrounded by T6- 12 and T6-8 transect zones. The T6-12 and T6-8 Transect Zones permit a maximum density of up to 150 dwellings units per acre. The abutting parcels to the west have active auto related commercial uses. See Image 9 below. Rezoning the southern portion of the site would provide a transition in height and intensity between the T6-8-0 to the north and the T5-0 to the east. Furthermore, the rezoning would clearly demark Day Avenue as the clear boundary between the commercial uses to the north and the residential uses to the south. Rezoning the southern portion will allow for additional commercial uses as listed below. However the county seeks to build office and parking within the subject area as part of a larger development. The rezoning will allow for additional height of up to five (5) stories where currently a maximum of three (3) stories is permitted. This will allow for an appropriate transition in height and intensity with the abutting T6- 8-0 to the north, which allow up to maximum of twelve (12) stories with Public Benefits as provided in Miami 21 if the southern portion is rezoned from T4 to T5. Furthermore, staff finds the rezoning request to be aligned with the goals and objectives of the Miami Comprehensive Neighborhood Plan pursuant to: Objective LU -1.3 states, the City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhanced the physical character and appearance of existing buildings; encourage the development of well designed, mixed-use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where capacity of existing public facilities can meet or exceed the minimum standards for the Level of Services (LOS) adopted in the Capital Improvement Element (CIE). Policy LU1.3.15 states, the City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. Policy LU -1.1.10 states, the City's land development regulations will encourage high density residential development and redevelopment in close proximity to Metrorail and Metromover stations. To reduce its parking footprint, Tenant shall have space dedicated to a carsharing service on the Property. 8. During construction, the Owner and Tenant shall use best efforts to relocate the Frankie Rolle Center to a location accessible to the community it serves. 9. Tenant shall diligently work to promote the use of Metrorail as well as the proposed Underline linear park, if and when completed. 10 -As the existing pedestrian bridge located on the Property is currently underutilized due to poor design, Tenant will work with Miami -Dade Transit (MDT) and Owner to re -design the pedestrian bridge to Metrorail into a more open concept in the event MDT and/or Owner allows redevelopment of said pedestrian bridge, subject to approval from all permitting agencies and available funding. Section 3. Effective Date. This Declaration is effective at the date of execution hereof.
