Pro er . The Property is located within the City of Miami ("City"), on the southeast side of South Dixie Highway (US 1), just west of Douglas Road (SW 37 Avenue). Specifically, the Property, which was the subject of Miami -Dade County ("County") Request for Proposal ("RFP") No. 00207, is located directly across South Dixie Highway (US 1) from the Douglas Road MetroRail Station. The proposed structure varies in height from five (5) stories in the southern portion of the Property to twelve (12) stories in the northern portion. The Project is not only unique, but also a first -of -its kind mixed use and mixed income development that will include approximately 264 workforce and market -rate housing rental units, approximately 28,500 square feet of office space, and approximately 28,698 square feet of retail space. The Project will serve to introduce new office, retail and residential uses to a sub- market that has had diminutive new office and retail projects, as compared to the overall, bustling South Florida market. The proposed retail space will focus on opportunities for businesses that provide services and jobs to neighborhood residents. Amenities for the Project will likely include features such as a spa, rooftop pool, common gourmet kitchen, in-house movie theatre, coffee bistro, and others. Above all, the Project is innovative and distinctive as it will serve as a direct connection to the Douglas Road MetroRail Station through the integration of a pedestrian bridge. As such, the Project will significantly reduce vehicular traffic and encourage mass transit and activate the intersection of two (2) major transportation arteries. The Applicant's proposal optimally utilizes the Property's prime location on South Dixie Highway (US 1) to link its mixed use development to the Douglas Road MetroRail Station in an effort to utilize existing County transit opportunities. By doing so, the Applicant's mixed use proposal is the quintessential transit oriented development targeted to Miami's workforce. Requests. The Applicant seeks a MCNP amendment of the southern half of the Property from Low Density Restricted Commercial use to Medium Density Restricted Commercial. In order to construct the Project, the Applicant also seeks a rezoning of the northern portion of the Property from T6-8-0 to T6-12-0, as well as a rezoning of the southern portion from T4-0 to T5-0. The Applicant requests the MCNP amendment and rezoning of the southern half of the Property in order to construct the Project, which proposes five (5) stories in height on the southern half of the Property to accommodate sufficient parking for the Project, where the T4-0 transect merely permits a maximum of three (3) stories. See Article 3, Section 3.14 of Miami 21. However, the proposed rezoning of the northern half of the Property from T6-8-0 to T6-12-0 will permit the same height as would be permitted by utilization of the Public Benefits Program, not additional height. Article 7, Section 7.1.2.8.c. of Miami 21 states that a rezoning of land will only be considered where the proposal involves an extension of an existing transect boundary, unless the rezoning involves at least 40,000 square feet of land area or 200 feet of street frontage. The Applicant is requesting an extension of an existing T6-12-0 transect zone boundary that directly abuts the Property to the north. Further, the Property has approximately 230 feet of street frontage on Day Avenue and approximately 389 feet of street frontage on SW 37 Avenue (Douglas Road). The Property is also approximately 95,867 square feet in size, more than double the 40,000 square foot requirement. Thus, the requests satisfy the minimum requirements pursuant to Article 7, Section 7.1.2.8.c. of Miami 21 for a rezoning of land. As further required by Article 7, Section 7.1.2.8.0.(d) of Miami 21, the owner of the Property, the County ("Owner") will join in the application to rezone the Property. For the analysis pursuant to Article 7, Section 7.1.2.8(c)(2)(g) of Miami 21, please refer to Exhibit 4. Criteria. Article 7, Section 7.1.2.8.f. of Miami 21 provides the criteria for amendments to Miami 21. The provision states, "[f]or all amendments: (a) The relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations. (b) The need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary." The requests are consistent with the goals, objectives and policies of the MCNP. The Property is located within areas designated on the FLUM for Restricted Commercial use and Low Density Restricted Commercial use, The Applicant requests an amendment to the MCNP for the southern portion of the Property from Low Density Restricted Commercial to Medium Density Restricted Commercial, which is more consistent with the existing, abutting Restricted Commercial designation on the north portion of the Property. The Applicant requests the aforementioned MCNP amendment and rezonings in order to enhance the commercial character of the Property and better utilize the already commercially designated area. Thus, approval of this application would encourage commercial development within an existing commercial area. Further, Policy LU -1.3.15 of the MCNP states, "[t]he City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other." The Property is abutted by commercial uses to the west and east, as well as duplex residential and multi -family residential structures. The Project also proposes a wide mix of uses, including residential, commercial and office uses. Thus, approval of this application, which would permit the mixed use Project, encourages a development pattern that enhances the existing neighborhood by allowing for development that provides a balanced mix of uses. The Applicant respectfully requests the aforementioned rezonings in order to construct the mixed-use Project. Due to current initiatives in the City and County for utilization of public transit, there has been a revitalization of properties near existing transit stops and corridors, such as the Property which is adjacent to a MetroRail Station, As a result, the area has been and will continue to be economically revitalized and reenergized.
